Jim Smith, Sanitation Superintendent Laverne Akin, GTE Representative Don Fazzino, Lone Star Gas Representative SUBJECT: Parking Lot Plan -City Stickers; proposed restaurant to be located on .lot A2 in the D. A, Smith Subdivision on Live Oak Street between Taco Cabana and La Quinta Inn. (94-402) This site plan alternative includes a shared curb cut between this site .and the adjacent Taco Cabana restaurant along Live Oak Street. A Project Review Committee meeting was held Wednesday, February 23, 1994 to discuss the above mentioned parking lot plan. City Engineer David Pullen moved to approve the site plan with the following conditions: CONDITIONS OF APPROVAL: _ Provide a location for two electrical .transformers in the existing 20' public utility easement .located between .Taco .Cabana and the 707 Shopping Center near the existing dumpster. Screening of the transformers is recommended by staff. _ Provide a 10' public utility easement to cover the electrical service to the building. s f,.. a PRC Report City Slickers Case #94-402 Page. Z _ Revise the parking legend to include the number of parking spaces on the Taco Cabana site existing and proposed. Since the Taco Cabana site is non- conforming in terms of the number of parking spaces available, at a minimum, the Taco Cabana site cannot lose any parking spaces. Since shared access is provided on this site plan alternative, an additional fire hydrant is not .required; however, the .curbs must be painted -red to discourage parking in these areas. _ Provide water demands .and sanitary sewer loadings on the site plan. The entire site must comply with the. Stormwater Management Policy. _ Verify that .the original final .plat of the subject property did not make any provisions or designation or a single building plot for the purposes of access and signage. _ The small parking island located in the southeast corner of the site closest to the building near parking. spaces 29, 30 and 39 and 40, will be allowed to be less than the required 360 square feet because it ties into a planted area with the condition that,the surface between the parking spaces is decorative pavers instead of vegetation. _ Staff recommended that the applicant file an as built amending plat dedicating all necessary easements for access and public utilities once construction is complete. _ Provide a 12 x 20 enclosed "roll-off dumpster service" area and proposed screening on the .subject property regardless if a dumpster is shared with the adjacent Taco Cabana site. If ':the :grease tank is to be included in this area, additional square footage will be required and screened accordingly. If the dumpster service is shared with Taco Cabana, the angle of the area must be .approximately the same angle as the adjacent parking spaces for access and the dumpster must be screened in accordance with current ordinance requirements. If the angle of the dumpster is changed such that the dumpster is not visible from- Texas Avenue, .gates may not be required. _ .The proposed dumpster .location on the City Slickers site cannot be counted toward the parking requirements. Staff Planner Kuenzel seconded the motion .which passed unopposed (3 - 0). City Engineer Pullen moved to determine that this site which includes a shared access drive with Taco Cabana along Live Oak Street is preferred. over. the previous site plan that does .not allow for shared access, case #94-401.. Staff Planner Kuenzel seconded the motion which passed unopposed {3 - 0). The. following comments were made by the various reviewing agents: ~ y.i PRC Report City Slickers Case #94-402 Page 3 COMMENTS/CONCERNS: _ It is the developer's responsibility for the placement of all conduit and twenty percent of the cost for electrical service. Submit a letter requesting electrical service and agreeing to pay .the associated costs.. The electrical service as shown on the site plan cannot be placed under the building. _ Telephone service lines will be placed in the same trench as electrical lines as much as possible. Coordinate telephone service with G.T.E. Representative Laverne Akin at (409) 821-4723 and schedule a meeting on site to discuss conduit placement and associated costs. Provide one 2" conduit with the electrical service to provide for future cable service. Coordinate details. with TCA Cable Representative Mike Lavender at (409) 846-2044. Distinguish between private and public water and sanitary sewer lines. Show water meter location. _ Verify and show the location of the existing water service tap on the subject property. If possible, the existing tap should be used to provide service to the proposed development. Revise the parking legend to include a break down of the interior and exterior seating area square footage and parking requirements. Provide a revised landscape plan. A drainage development permit is required to any site work. The minimum driveway opening width is 24'. If the driveway opening is existing, a width of 23' is acceptable; however,-if the- opening is-proposed, either request a variance to the driveway width or increase the opening to 24'. SUBMIT 4 COMPLETE SETS OF CONSTRUCTION DOCUMENTS WITH THE REVISED SITE. AND LANDSCAPE PLAN ATTACHED AND 4 ADDITIONAL REVISED SITE PLANS ONLY TO CONTINUE. WITH PHASE II OF THE BUILDING PERMIT PROCESS. APPEAL PROCESS: An applicant may appeal the decision of the .Project Review Committee to the Planning .and Zoning Commission"within five days after the PRC Committee meeting. Failure to appeal the PRC action shall constitute a contractual acceptance of all conditions imposed, and a waiver and surrender of all complaints, defects, or potential invalidity, whether under state or .federal law. An applicant appealing the decision of the PRC shall file :ten copies of the final site plan as approved by the PRC, showing all changes and requirements imposed by the PRC, and accompanied by a written explanation of those items .being appealed. Until said copies are on file, no further development approval shall occur, and no further action by the Commission shall take .place. An applicant may appeal only certain aspects of site plan review, and in the absence of discretionary review by the Commission, or review pursuant to a petition, all other aspects of the site plan shall. be .final. Any notice of appeal shall state with particularity the aspects which are to be appealed. Coordinate appeal process through Development Coordinator Shirley Volk at (409) 764-3741.
