Bair Associates 6389 'Westview Drive Houston, TX 77055 Re: Letter of 3/20/95 to David Moore, Building Official Dear Mr. Bair: 3 ~ ,~~~, We are in receipt of the subject letter in which you ask for clarification on certain requirements which were placed on the construction of the Brazos Valley Credit Union.. You point out in your .letter that those same requirements were apparently not placed on the shopping center across Longmire which was under construction at approximately the same time. I have done some research on both projects, and have. determined that the Albertson's site plan was approved in 1990 as a future phase of the Albertson's grocery store. At that. time, the Project Review Committee did. not have the authority to require sidewalks at site plan. review... The Zoning Ordinance was amended by City Council to give the PRC that authority in the fall of 8-26-93 with the adoption of Ordinance No. 2029. Your project fell. under the new ordinance requirement: The site plan which was part of the building plans approved for construction, and of which your contractor received a copy, showed .the fire lanes marked in red, as the contractor: was required to do. The City Codes which address Fire Lanes indicate "No building of any type construction for occupancy shall be constructed in such a manner Ghat any part of the structure is more than 150 feet from a public street.......such structure may be erected at a greater distance if the owner or developer designates,...and maintains a fire lane having a minimum width of 20 feet and a minimum height clearance of 14 feet, terminating within 150 feet of ,~ the furthermost point of such structure.... In another section. that same Code reads: "All curbs and curb ends. shall be painted red with .four inch white lettering stating 'NO PARKING -FIRE LANE -TOW AWAY ZONE". Wording may not be .spaced more than 15 feet apart.. In areas. where fire lanes are required but no continuous curb is available, one of the following methods shall be used, in conjunction with the curb markings, to indicate that the fire lane is continuous: Option #1: A sign 12" wide and. 18" in height shall be mounted in a Efo~e ~f ~rLras (~~?~~ ~.~`~na~e~s-~~ 4. conspicuous location at each .entrance to the property.. Option #2: From the point the fire lane begins to the point ...ends, including behind all parking spaces which. adjoin a fire lane,. shall be marked with one continuous 8" red stripe painted on the drive surface behind the parking spaces....". As you can see from the quoted sections of the City codes which address fire lanes, there is an option available to the wide stripe on the driving surface; .that being .certain specific signs at each entrance. Beyond that, the only relief from an ordinance requirement can be granted by the Construction Board of Adjustments and Appeals. If you would like to pursue that option, please .contact me and l will get you the application, fee information, etc. Fire Marshal Eric Hurt and I have scaled both site plans to ascertain that each meet the requirements of the ordinance.. The small shopping center falls well within the maximum distance of 150 feet from a public street,. and therefore, there are no fire lane requirements. Parts of the credit union building fa l beyond that 150 foot limitation from both Airline and. Longmire, and therefore, .thee.. site requires fire lanes. There are numerous codes and ordinances which each new project is required to follow, and it is impossible to verbalize each one of them to each developer. City staff meets', many times with potential developers to try to point out certain requirements which. may be different from other cities, but we make handout information available to try to cover others that may not have been mentioned. The Gity is very .pleased to have this new attractive, convenient facility in our community. I hope this letter answers any questions you may have regarding sidewalk and .fire lane requirements in yours, and other's projects. One of the stated demands was for a new sidewalk where none previously existed: along Longmire Drive, a distance of approximately 275 feet;.. This new walk .cost the Owner approximately $4,900. We observe that where the new retail- strip was built on the east side of Longmire directly opposite our property,. no sidewalk was required. We would appreciate knowing why we were required to add a sidewalk when the retail center, built at exactly the-same time,. was not required to .include a sidewalk. As our project was-being completed,-and without any prior notice, our contractor was instructed by the City personnel to paint broad, bright red, Fire Lane stripes on the parking lot pavement and curbs between the parking areas on the east and south sides of the building. .Although your dire Marshal's office ,made a detailed review of our drawings prior to issuance of a building permit, no mention had been made of these fire lane markings. We see that a description of this appears in the Fire Department's Development and Construction Guide, but bold markings like this. do not .appear in the parking lots across the street. Again,'we are wondering why`we were required to have. these designations, but others are not required.: to do so. We would certainly appreciate your answers to our questions so we may pass ,the .information along to our client to satisfy his concerns,. This is the large concrete culvert box over which. the City had some protection pipes installed. We believe that the open. drain in this location constitutes a very real danger to the public. The pipes are far enough apart that a small child could fall through into the culvert. As a requirement of the State's accessibility standards, we were required to place a sidewalk near the culvert to allow for an accessible path from the public sidewalk along_Longmire Drive to the building. After we were under construction, the phone company installed a large in-the-ground vault in the path of our required sidewalk forcing us to move the walk even nearer to the open culvert.. The top of the culvert is four or five feet below the surrounding natural. grade creating a steep sloped embank- ment of soil all around the box. Since this hazard occurs right at the .main entrance to our new facility, the Owner does not want. to install a fence or a densely spaced protective railing all around the depression. Due to the steep slope on all sides, it is going to be nearly impossible to maintain grass or ground cover on the embankments as it will all wash into the culvert. A preferable solution for this problem would be to cover the top of the box, create a manhole above it and place a cover or area drain grating over the top of the manhole. Our property has all internal drainage and no area•is graded to drain into the open culvert so an~area drain top is not essential; a manhole cover would be satisfactory, Of course, if there is no need for the City to get at the open culvert at this location, then the manhole could be omitt2t3 and a solid top',placed on the culvert and the ground depression backfilled to grade.. Since this is a City owned culvert, we assume the City would stand the cost of a cover and whatever structures you required above the cover. The Owner will provide backfill to grade as necessary. On Friday, November 5, Natalie Thomas phoned me to say our initial pro- posal was not-satisfactory to you and to offer two alternatives. .The first alternative was to come in from Longmire on the joint access ease- ment opposite the Albertsons' drive. The .second alternative was to move southeast'to be at least 125.' away from .the Albertsons' drive. In either case, we were. told we must pravide the access off Longmire for the adjacent undeveloped lot. After reviewing these two alternatives, we have chosen 'to use the joint access easement, the first alternative, and I am resubmitting our revised diagram to you with that access shown. Also enclosed is a copy of a portion of the larger .site plan we have drawn showing in more detail this revised access. This location for the driveway will require that a power pole be moved. It is my .understanding that the City will do this at no cost to the Owner; please.. confirm this. Submit load data including size and type of service. _ The electrical department will design utility layout; however, the developer is responsible for installing the conduit. _ The existing 30' access easement may need to be widened to allow for utility placement. The existing utility pole can be relocated at the expense of the. developer. G.T.E.: _ Concerned. about the use of the existing 30' access easement for utility placement since it will eventually be paved.. Provide two 3" conduits from the building termination point to Longmire unless other public utility easements are dedicated. TCA CABLE: _ Install one 2" conduit from the building to the transformer for -future communication needs. Mr. Holster explained that the. owner would like to get rid of the existing 30' access easement and not have shared access. .Staff encouraged the use of the existing access easement but indicated that. shared access can occur with the drive opening..location as proposed with the appropriate cross access easement dedicated. _ The proposed. sign will have to be permitted separately or the sign details should be shown on the plan. _ Submit a landscaping plan on a .separate sheet; half of the required. points .must be in canopy trees. _ Show proposed dumpster location. Coordinate size and type with Jim Smith. The dumpster must be screened from all public rights-of-way. Show curb and pavement details. ENGINEERING: Suggested a sidewalk along the Longmre frontage. The city will discuss cost participation if the developer decides to install. the sidewalk. If the property is replatted, the sidewalk will be a requirement without. city participation. All drainage plans. must meet the current ordinance. A drainage development permit will be required prior to any site work. WATER/WASTE WATER: _ Show the existing water and sanitary sewer mains. Designate between proposed and existing and .show sizes. Add a vicinity map to the site plan. _ Show proposed water. and sanitary sewer services and label them as both proposed and private. _ Show the .existing fire hydrant and check to see if the proposed building will have adequate coverage.
