I have pulled the file for the Preliminary Plat & the Final Plat to reconstruct what the conditions for approval were, but it seems to me ';i that I heard that the right handl9nd requirement has been. eliminated from the list of conditions of approval by p&Z 8c Council. 'There isn't a note in the fill, so Pm not sure. Would someone let me know asap what needs to be done if the bank (or a buyer) comes into develop this property so I .can adequately advise this customer. Thanks. Re: Development of the Reserve Tract: of the L.O.Ball Memorial Subdivision ~ Dear Mr. Olson: I have :enclosed the various staff reports and agenda item cover sheets which indicate the conditions with which the plats submitted- were approved. You will. notice that two of the conditions are the inclusion of Longmire with .any other. platting: and the right hand turn lane along Rock Prairie Road. The next step in the processfor you would be to .determine if you aze going to leave the property in the configuration shown.on the Preliminary Plat.. If so, you will need to have an engineer prepaze the required construction documents and the Final Plat itself. If not, an additional Preliminary Plat will be required along with the necessary impact studies. These, also, must be prepared by a professional engineer. Perhaps this. information will help you decide whether you need to bring an engineer to a predevelopment meeting or not. Volk Development Coordi for cc: File Printed by Shirley Volk 9/28/94 2:07pm From: Sabina Kuenzel To: Veronica Morgan Subject: fwd: tac realty ==NOTE====_-=_=_=====9/28/94=10:51am-========-=-=--------°=_______=______= CC: Jane Kee, Jim Callaway, Tom Brymer jane•and•jim•and•i•met•with.tom•this•morning•because~hickson~has•gotten••••• involved in this thing.. he has received a call from tim bryant, who is trying to purchase lot l (which was not supposed to have been but was sold off in the past without a legal plat).. we discussed the following constraints between tim, the owner of the larger reserve tract don adam: tim bryant is going to lose his ernest money at the end of november. after this, .lot 1 will increase in price from $6.20 a sf to about $8.00. therefore tim wants to get a final plat approved (and filed.) befroe this date. there are several problems that need to be addressed before a final plat can be filed: 1. the longmire extension needs to be shown to line up with the existing street on the preliminary plat. ii ' 2. the impact studies need to be corrected - we have serious concerns with the ones that were submitted 3. a final plat needs to be submitted for .lot 1- we can probably get this .item placed on the special council meeting for annexation on november lb at 4:OOpm. how long in advance of that meeting do you need submittal to have taken place? ~, 4. we may have to address lot 1's share of longmire before the plat is filed. we discussed either letting it go for now and documenting the ~ concern thru notes on the plat, reference in staff reports and minutes. or we can require a development agreement before the plat is filed.. but this ';I'; needs to take place before november 3,0, if possible. As per the attached map, the City will require access to Rock Prairie `Road to be shared by the subject 1.5 acre tract and the parent "Tract A". The subdivision of the 1.5 acre tract from the parent' tract occurred-without platting which is in violation of the City's"Subdivision Regulations. Therefore, before any development can occur on either tract, a preliminary plat and associated impact studies for both tracts must be submitted. Additionally, a final plat along with associated ~ construction documents,. where required, must also be submitted. If one tract is ready for development prior to the other, a final plat may be submitted on the. first tract to be developed if a master preliminary plat is submitted covering the entire parent property. However, a master preliminary plat is valid for. only. one year. If there is no final plat submitted.. on the remaining-tract within that year, the entire process must begin again when that tract is ready for development.
