(94-302) ~.: Staff ,Planner Kuenzel presented the staff reports for the..proposed rezoning and preliminary plat of the Pontalba Apartments. This request would result in the continuation of the apartment. pattern that: exists in this area. 'The low density residential Land Use Plan designation that exists on the back portion of the property is not likely to occur-considering the configuration of property in the area and the fact `that there is a common .property. line .between this area and the A&M Consolidated bus parking lot. Due to the fact that the rezoning. is in compliance with the .Land Use ..Plan and is not in conflict with surrounding eland uses, staff recommended., approval of the rezoning request and `the preliminary plat with "the provision of access easements allowing lots one and two .access to the public right=of-way. Chairman. Hawthorne opened the public hearing. Engineer Larry Wells of the Municipal Development Group. approached the Commission and offered. to answer any questions concerning the proposed rezoning and preliminary plat. Chairman Hawthorne closed the public. hearing. Commissioner .Mariott moved to recommend approval of-the. rezoning of 4.02 acres located- along the south side of Southwest Parkway approximately .400' west of the Welsh_Avenue intersection from G1 Generale Commercial to R-5 Low Density Apartments. Commissioner Lane seconded the motion which. passed unopposed (6 - 0): Commissioner Mariott moved to recommend approval of 'the preliminary plat for the Pontalba Apartments.. Phase One with staff recommendations. :Commissioner Lane seconded he motion z which passed, unopposed (6 - 0). AGENDA ITEM NO. 5: Consideration of a preliminary plat for the Southwood Forest Phase Five Subdivision. (94-303) City Planner Kee presented the staff report and recommended approval of the preliminary plat as ..submitted. Commissioner. Gribou moved to 'recommend approval. of the preliminary plat for the Southwood Forest Phase. Five Subdivision, Commissioner Mariott seconded the motion which. passed unopposed (6 - 0). Application is in the name of Larry Landry. (94-302) ITEM SUMMARY: The applicant wishes to prepare the subject property farar development as an apartment complex consisting. of 15, fourplexes. Lot 3 is the` only lot with direct access to a public right-of way. Lots 1 and 2 would be nand-locked without private access easements. A rezoning from C-1 to R-4 is pending and has,been scheduled for .the: Council meeting of March 10, 1994: FINANCIAL SUMMARY: Fiscal Impact Analysis shows a negative net revenue of $7,234 under the proposed development and a positive net gain of $25,.695 at average C-1 type uses. STAFF RECOMMENDATIONS: Staff and the Planning and Zoning Commission recommend approvat with the condition that. Lots. 1 and 2 be provided with private access easements. Representative Mike Lavender, TCA Representative SUBJECT: Preliminary Plat - Pontalba Apartments Phase One; approximately 4.02 acres consisting of three R-4 low density apartment lots generally located on the south side of Southwest Parkway approximately 400' west of the intersection of Welsh and Southwest Parkway. (94-302) A Presubmission Conference was held Wednesday, February 2, 1994 to discuss the above mentioned preliminary plat. The following comments were made by the various reviewing agents: PLANNING: Correct the total acreage figure in the title block. Add the statement, "Not for Record" in the title block. Provide a cross access. easement between all three lots. .. ENGINEERING: _ ` A drainage conference is required prior to further processing. Submit a comparison. of the 19$3 floodplain study of the subject property and compare it with the new study. There is not statement in the impact study concerning the controlling of run-off. The storm water flow up or downstream of this facility for 1/4 mile must be shown. WATER/WASTE WATER: _ Water service must be .provided to lots one and two via a loop system. _ .Concerned that the existing 8" sanitary sewer line may not be adequate to serve the proposed development. PUBLIC SERVICES: _ If the proposed 20' drainage .easement contains any proposed improvements, then the improvements should be shown on the preliminary plat. If the easement does not contain improvements, there should not be an easement dedicating the unimproved ditch to the City for maintenance. ELECTRICAL: Provide a 20' public utility easement along the southernmost property line, to run parallel with the Christine Lane gravel road. _ Show off-site easements including the public utility easement located east of the subject property.
