In reviewing the plat, it does not appear that the signatures of .First American Bank or the other owners of the adjacent parcel are required, since no public dedication of any sort is being made... Please note the form of the Certificate of Ownership and Dedication which recites that the applicable party "hereby dedicate(s)'to the use of the public forever all streets, alleys, parks, easements and public places thereon. shown...". There are no such dedications being made with respect to the adjacdnt property. My supposition is that. in lieu of having FAB and the other adjacent owners sign the plat, the city will require that the;applicable private access. easement be executed and recorded. As per the attached map, the City will require access to Rock` Prairie Road to be shared by the subject 1.5 acre tract and the parent "Tract A". The subdivision of the 1.5 acre. tract from the parent tract occurred. without platting which is in violation of thee. City's"Subdivision Regulations. Therefore, before any development can occur. on either tract, a,preliminary plat and associated impact studies for both tracts must be submitted. Additionally, a final plat along with associated construction documents, .where required, must also be submitted. If one tract is ready for development prior to the other, a final .plat may be submitted on the first tract to be developed if a master preliminary plat is submitted covering the entire parent property. However, a master preliminary plat is valid for only one year. L. O. Ball .Memorial Subdivision plat TO WHOM IT MAY CONCERN: In response to a phone .call from John Hamilton regarding a .question about access to Lot 1 of the L. O. Ball Memorial Subdivision, the City has indicated that if owners` signatures cannot be obtained for the. private access easement on the final plat which .was approved by the City Council, the. City has no ..problem with allowing access from Rock Prairie Road to this subdivision to be taken from. a driveway located oNy on Lot 1, with. the remaining :access to Rock Prairie Road to be taken from the extension. of Longmire Drive. If that. option is chosen by the developer, the access easement. should be .shifted on the plat to reflect where the access will .actually be. Because this is a minor shift and meets the intent regarding access that.. was discussed and approved by both P&Z and Council, the document will. not have to go back through the review process. Timing on getting this plat filed for record at the County is at the option of the developer. The only requirements the City is waiting for are signatures of all owners of all property included in the plat, and. a financial guarantee for the sewer line which must be built and dedicated to the'City. Bryan: y~.~~~' In response to your request to the' City to attempt to run the Preliminary and Final .Plats simultaneously hrough the review and approval process, i would like to inform you that staff is making every attempt to do so. To update you on the status of your plats, we have made a second review of impact studies submitted for, the preliminary ..plat, and are preparing to .return them to the engineering firm, Municipal Development Group, for additional requi[ed information. Should this information not be forthcoming, staff recommendations will re#lect that information has not been submitted. We understand the urgency behind-your request for consideration ofthese. plats simultaneously, but we need to point out that a State of Texas Statute requires that all public sanitary sewer lines be submitted to the T.N.R:C.C.;for review and approval prior o construction. To date,, we have not received a letter from that agency indicating review and approval of those plans, therefore we have an 'additional question to ask: How can we .help you if we are_not able to file the plat for .record,. -and thus .enable you to `complete your eland .purchase transaction., before. the end of November. This is the critical date you. spoke of earlier. Both Bryan staff engineers and College Station.. staff engineers, along with representatives .from the T.N.R.C.C., met with local professional .engineers early in the summer to explain these regulations for which enforcement was being instituted_ College .Station. staff engineers sent a letter. to local engineers informing them that the City would no longer accept final plats which require construction documents for .public sewer lines. without an accompanying letter from the T.N.R.C.C. indicating those plans had been submitted and approved through that agency. In this particular case, the .City is considering waiving that requirement to try to help you expedite your land purchase, and to accept the .plat and construction documents for review and consideration by staff, the Planning.. and Zoning Commission and the City Council. The best scenario outcome would be that. staff .could 'recommend, .and City .Council could approve, conditional approval of the final plat, pending a letter of approval from the T.N.R.C.C. prior to filing the plaf for record. To date, we have not received this information, and we j will not need them until it comes time to file the .plat for record. We wanted to let you know that this is a required item, so you would not find yourself in a.bind at the last minute to get the plat filed. Ball right turn lane In looking at the site plan of the First National Bank. and the prelimary plat of the. site, it appears that the right turn lane has indeed been required and right-of-way dedioated during the development of the bank. We were mistaken in saying the. ROW for the right .turn lane had been deleted. As the remainder of the property on Rock Prairie develops we need to get. any additional ROW from it as well. Ball Memorial Subdivision Dear Mr. Hamilton: It is my understanding there is .currently some difficulty in obtaining the shared access agreement on Rock Prairie Road between the above referenced property and the parenf tract surrounding it. ..The purpose of this letter is to confirm that access. to .Rock Prairie Road for .this .1.43. acre corner tract is an alternative if a shared access agreement is not worked out. Such an access point would have to be moved entirely on to :Lot 1 and located directly along the western. property line in order for it to' still align ahnost directly across from the .existing .driveway on the opposite side. of the street. Furthermore, it should be clearly understood that a driveway not shared and located entirely on Lot 1 may preclude the parent tract from having access: to Rock Prairie Road. Access to this tract would then be taken from the future extension of Longmire Drive and possibly: the S.H. b East Frontage Road. The implementation of the .City's Driveway Ordinance is such that the location of existing driveways essentially dictates the location of future access points. In other words, which ever tract develops first, be it the L.O.
