(94-221) A Presubmission Conference Meeting was held .Wednesday, June 15, 1994 to discuss the above mentioned final plat.. The Conference recommended approval of the final plat with the following conditions: CONDITIONS OF APPROVAL: Access to lot 33, block 7 and .lot 1, block 9 will be reviewed at the time of building permit. Verify that all public utility easements match up with the proposed utilities. Provide a 15' public utility easement between lots 7 and. 8 of block 9 for electrical and telephone utilities. _ The public utility easement along the rear of blacks 7 and 10 should also be noted as a drainage easement. _ Verify that lots 21 and 22 of block 7 are at least 50' across the front at the required 25' setback line. Include the street name of the cul-de-sac extension of Lorikeet Court. Cypress.Meadows Phase II contains 72 lots on 20.5 acres and the Common :Area contains O lots on 18:22 acres. The Common Area contains all the floodplain located within the Sprin~brook Subdivision: The`South Fork of Lick Creek runs through this common area and is being left in rt s natural state and a Homeowner's Association will be established to maintain this area: Longinire from the creek (including the .bridge structure crossing the creek) to the northerly-most property line will be .constructed with this plat. This is all per a previously a proved development agreement between the City of College Station and this developer. A Preliminary .plat of Cypress Meadows Phase II was approved by Council on. April 27, 1994. It was approved with the .variance. to the cul-de-sac requirements. on Eagle Avenue and Long~nire. A Presubmission conference was held on June 15, 1994. All concerns made. at that time have been addressed. The Planning and Zoning Commission heard this item at their July 7, 1994 meeting and recommended approval.. With the construction of this bridge, an 18" sanitarryy sewer and a 12" waterline, the developer is requesting ~, oversize participation in the amount of $154,060.77. However Staff finds that the amount requested-for bridge and drainage items ($112,..110.07) is beyond the ordinance limitations. According to Section 9 of the Subdivision :Regulations, bridges and culverts are the only draina e improvements eligible for City participation, and a (imitation on .the participation amount is placed. at 30% of the construction cost of the structure(s). By including the 30% of the estimated cost ` of the .proposed structure, the drainage articipanon amount should be $18,000 which .reduces the :participation amount recommended by staff to 59,950.70. STAFF RECOMMENDATIONS: Staff recommends approval of the plats with reduirement of formation of a Home Owners Association prior to filing. of'the. plat, and the payment of oversize participation as outlined below. FINANCIAL SUMMARY:. Oversize participation is recommended in the amount of $59,950..70 for the construction of the bridge, an 8" sanitary sewer line and a 12" waterline. City Engineer Re; City Participation and Cost Estimate for Cypress Meadow Phase Two Dear Mrs. Morgan This letter is to officially request .city participation in the cost of some items in the above referenced project. Items for city participation are delineated on a per item basis in the ~ enclosed cost estimate. Justification for each item is offered on the; enclosed "Justification for City Participation" sheets. CITY PARTICIPATION - STORM DRAIN ITENS Storm drain is .extended to the-.adjoining. property. lines .for the benefit of futuYe development and does not benefit this development. The cost of the storm drain extension and oversize is calculated by an independent analysis of the system without the offsite drainage areas. The analysis howl that without the offsite storm water, the system would require only 67%:of the storm drain pipe .and .inlets required with the offsite water. Two special inlets and the flume are considered the cost of .the City only. The cost of the 3 - 10' X 8' box culvert is divided based on the onsite versus offsite-area draining to the culvert: JUSTIFICATION FOR CITY PARTICIPATION - SANITARY SEWER ITEMS Due to the location of the project, a trunk sewer line is required in this project. The project would require an 8" sewer line_(at most) without this encumbrance. Because the trunk .sewer line is for the benefit of the City and not the project, the cost of the oversize is requested for City Participation. The_cost is calculated based on the cost difference between the 18" PVC trunk sewer line and the 8" which would otherwise be required. Because the 18" trunk'sewer line requires five foot diameter manholes, the cost difference for these manholes is also included. In addition. to the trunk line, an 8".sewer connection 'is provided for the benefit of :the adjoining property owner. The cost of this connection Wand the one additional manhole is calculated for City Participation. JUSTIFICATION FOR CITY PARTICIPATION.- WATER LINE ITEMS Due to the location of the project, a 12" water main is required in this project. The project would require an 8".water line (at most) without this encumbrance. Because the water main is for the benefit of the city .and not the project, the cost of the water main ,oversize is calculated '(as a percentage) for City Participation. MICHAEL R. The cost of the. storm drain extension and oversize is calculated by an independent analysis of the system without the offsite drainage areas. The analysis shows that without the offsite-storm water, the system would. require bn '67% of the storm drain pipe `and inlets required with the offsitewater. Two special inlets and the .flume are considered the cosh of the city only. .The cost of the 3 - 10' x 8' culvert is divided based on the onsite versus..offsite area draining to the culvert. Justification for City Participation-Sanitary Sewer Items Due to the location of the project, a trunk sewer line is required in this project: The project would-require an 8" sewer line (at most) without this encumbrance. Because the trunk sewer. line is'for the 'benefit of the .City and-not the .project ,, the cost of the oversize.: is_request for. City Participation.. The cost is calculated base on the cost difference between. the 18" PVC trunk. sewer line and the 8" which would otherwise be required. Because the 18" trunk sewerline requires five foot diameter manholes, the cost .difference for these manholes is also included. In'addtionalto the trunk line, an 8" sewer. connection is .provided for the benefit of the adjoining property owner. The cost of this connection and the one additional manhole is calculated for City Participation. Justification for City Participation-Water Line. Items Due to the location of the project; a 12" water main is required in this project. The project would require an 8"water fine (at most).. :.without this encumbrance. As part of that plat approval, the City approved the construction drawings, .plans, and specifications for the work within the subdivision. Fountainhead relied on the agreement reached with the City as part of such approval. Today, Fountainhead was notified by its contractor that the contractor had been told to perform the utility construction and installation at a different compaction sta~~dard tfiai3 the requirements of the construction drawings. ,'r~viously, Fountainhead entered into its contract with the contractor based on the construction drawings. Consequently, the .contractor has advised Fountainhead that it will not proceed with utility installation and construction today, as scheduled, until this question is resolved. Any change in the requirements for compaction affects Fountainhead in its contractual relationship with its contractor, in that it requires a different type of performance by the contractor. The announced delay by the contractor will affect Fountainhead contractually because the contractor has a certain time under the contract far performance, and any delays caused by the City could have the effect of extending the contractor's time for performance. Furthermore, the warm and reasonably dry vyeather we are en~oy~ing offers a uniq~ze opportunity for the, coA~tr~rtor to press ahead. Most of the lots are under contract at an agreed price, determined in part by the construction costs Fountainhead anticipates based on the. approved construction drawings. If Fountainhead incurs additional unforseen expenses, the damages it suffers on the selling side will also be .significant. Certainly, Fountainhead has not agreed to anv .changes. in the compaction. standards previously approved by the City. If the City wants to pay the cost of the higher construction standards, Fountainhead will authorize the contractor to proceed with the higher compaction standards. During this meeting they also complained about our standard requirement for water and sewer trench compaction. They evidently stated. that they were being picked on by us by being the only developer to be held to this requirement. As a result, Jim relayed Tom's request for additional information regarding our past compaction testing. 'This was relayed through Kent to myself to put together. On Thursday, while I was still compiling information, a decision was passed down to not test the trenches on this project. Basically, we have been testing the street crossing trenches far the past year, through our own inspectors, not through John Logan because he did not have the process to order' and pay for the tests. Subdivisions tested include Pebble Creek, Oak brook Talley, and even Myrad's own Elmcrest. Because the decision was made without this input, we have let Myrad off the hook regarding our requirements, thus opening us up to other complaints due to contractor communicatian. In response, Kent will be issuing a letter to all engineers .and developers that the requirement will be enforced at some specific future date. This includes the: compaction requirements for streets, drainage,_water and sewer systems.. These standards are public record and are available to all developers and engineers interested in working here.` It 'is the design engineer's responsibility to see that these .requirements are clearly stated on the plans and specifications for each project. The' fact that. the notation you referred to in your letter,was not caught in tha review process does not alleviate the developer from building the infrastructure ystcm to .City standards. I will forward your letter to the City Attorney's office for comment.. That office has researched the issue of errors on :construction plans which are .not caught in the. review process by government officials. Their research shows that the responsibility lies with the engineer and developer to meet the applicable standards, and there is no implied contract with the governmental entity that reduces these standards when it issues a construction permit.
