Water Public water service is available from an 8 inch line within the eastern right of way of Dartmouth Street. Should additional water be required, an off site extension can be accommodated from the west end of the tract to another existing line located at the terminus of Cornell Street. Sewer Public sanitary sewer collection is available from existing collection lines along both the north and south boundaries of the tract. Should additional capacity be required, an off site extension can be accommodated from the east end of the site to another existing line located within Dartmouth and between the subject tract and Holleman Drive. Electric Public electric service sufficient for single family use currently exists along the southern and northern boundaries of the site, and multi-phase service is available from the east side of Dartmouth Street Storm Draina2:e Existing topography indicate that the site drains to the northwest and to a lesser extent, to the northeast. In both cases, current City policy requires that such a development would meet one or more of the following criteria: 1. Provide (and maintain) onsite detention facilities to prevent any increase in flows leaving the site. Home of Texas A&M University '" 2. Provide an offsite analysis that shows that the offsite runoff pathways from the site to the nearest primary drainage facility (in this case, Wolf Pen Creek) can accept the increase in flow generated by the proposed development and yet remain within the basic design requirements for such improvements 3. Provide improvements as needed to convey the increased flows to the primary system within the basic design requirements for such improvements. In all three cases, all hydrologic and hydraulic calculations and designs shall be presented by a registered Civil Engineer for review. We would like to arrange a time with your staff when we can dlscussthese matters. A preliminary construction cost estimate has been included for your use. As aninitial discussion point, in the interest of saving time, we would like to offer to the following suggestion. Since the Cornell Street connection may be some time in occurring, Troy. would offer to install the connecting water line, with the necessary valves and appurtenances; provide for engineering design of the new street; and pay for the rough gradin.g and site preparation. This is a fair discharge of our obligation to assist.in the devel~~ment of this area. This approach allows us to proceed with our project without having to conduct lengthy negotiations with the estate, or other tasks better suited for. the City, but which the City may not want to fund at this time. I have called you on several occasions regarding this invoice but you have been unavailable. During conversations we had several months ago, we discussed the invoice and you told me to disregard them as you had directed your accountant to cease the billings until we had a signed contract. Your accountant has not complied with your request and has added a sentence regarding possible legal action for recovery. The City is more than willing to pay MDG for their services on the project, but will not pay for those services that should have been charged to your Jefferson Ridge client. We have discussed several areas where MDG was asking the City to pay for portions of the design that the City felt should have been absorbed by Jefferson Ridge. If you will please send us a modified proposal, detailing only that work that the City requested of MDG and not that which Jefferson Ridge was required to perform., we will be !happy to prepare the contract paperwork and process any invoice in accordance with that contract. In addition, we have not received any of the final design work on the Cornell project. Last we saw, MDG was in the process of refining the final design but it has not been approved for construction_ The reason for mentioning this is to remind you of that obligation in accordance with the development agreement that the City currently has with Jefferson Ridge. Approval of those documents is an obligation stated within that development agreement. ITEM SUMMARY: The Troy subdivision (site of the Waterford Apartments) consists ofa portion of a larger tract that was once presented to the City as a single development. The Troy subdivision occupies. over half ( %) of the parent tract. Staff identified this situation as "another Welsh" where the remaining portion of the development could not carry the cost of Cornell St., a collector streetplanned to cross from the Brentwood to the KFO subdivisions. Additionally, development of the Waterfordapartments requires tha,t a waterline be extended through the remnant tract to the Waterford site. The "problem" tract isinan estate and the developer of the TroylWaterford project does not have any control over the property. The best solution for the developer and the City is to enter into a development agreement where: The City use its power of eminent domain to acquire easements and/or ROW as required to facilitate the development of the area; The developer pays for the cost of acquisition that is necessary for the developffil~nt of his tract; The developer pays for waterlines necessary for the development of his tract; The developer posts financial surety for a portion of the cost of Cornell street through cash and constlUction documents. I got it from Grace a couple days ago. I have a client who is looking to develop the vacant property where Cornell will connect. According to the Development Agreement it states that "City agrees to use the twenty-five (25%) of the estimated construction cost for Cornell Drive paid by Developer to partially fund the. construction of the roadway at the time of development of the adjacent property. I am trying to ascertain if my client will be responsible for ANY cost of Cornell other than dedicating the. right-of-way. It appears to me after reading the d.a. that the City and Troy Assets were responsible for the design and construction of Cornell and the City would just wait to construct it until development pressures warranted it. Partly I believe because they did not want to go acquire the right-of-way at the time of development of the Troy property. Can someone there research this issue for me and send me a response? I will need it in writing for my client. I realize that this research will probably be messy! I have already talked to Larry Wells with MDG to try and pick his brain and he and I are remembering things that make this thing ugly!!! I will be happy to come do a brain dump to get ya'lI started because there are several issues that will be important and some of them involve accounting and a separate contract that the City had with MDG on this project. City Engi~ May 4, 1994 Troy Subdivision, Developer Participation in the Construction of Cornell Drive From: Date: Subject: I met with Barry Gillingwater and Greg Targert Thursday, April 28 to discuss the Troy Subdivision share of the Cornell Drive connection. Find attached a letter from Mr. Targert to Jane Kee. It contains the cost estimate for Cornell. Gillingwater has proposed to pay for the items with the asterisk to their right. It would leave the city with a water line in place, the final design and specifications for Cornell ready to bid, the right-of-way legal description for Cornell and. an estimated $54,678 of construction expense to make the street connection. We did not discuss any ROW cost or the potential for Gillingwater participating in that cost. Gillingwater will need construction ROW to prosecute his part and a permanent easement for the water line. I discussed the ROW with. Greg Targert this morning. He expressed a desire for the city to use its purchasing power to secure the Cornell right-of-way. Apparently an estate owns the property and there is conflict within the group. He stated that in his opinion, condemnation will likely be required. According to the engineer's estimate the developer will be paying about 23% of the cost. It should be pointed out that the waterline cost may be attributed to the developer's cost to develop his property. If that were the case the developer's percentage contribution would be about 20%. Again, that does not include right-of-way costs. Gillingwater's project can be constructed without the water line connecting through Cornell. In my opinion, that is not the best solution available. Money has not been budgeted for Cornell. Cornell is not a part of the current list of potential projects for bond election consideration. I recommend we present thispropos~l to council for consideration in a 'semiconceptual' form.
