WHEREAS, on December 8, 1994, the City Council of the. City of College Station convened and pursuant to notices proscribed by law held a public hearing wit~ regard to the application for the rezoning ofa 20.236 acre tract or parcel of land lYIng ~nd being situated in the Morgan Rector Survey, Abstract No. 46,in College StatIon, Brazos County, Texas, being a part of that 23.33 acre tract described in the deed from Hugo Harold Krenek to John Ben Carrabba, Jr., by deed recorded in Volume 470, Page 334 .of the. . Deed Records. of Brazos County, Texas, and being more particularly described by metes and bounds in Exhibit "A" attached hereto and incorporated herein by reference; WHEREAS, the above-described property i.scurrently zoned R-1 Single Family Resi.,. dential, andlhecurrent use "is vacant land; WHEREAS, the owner of the above-described property, Southwest Parkway Joint Venture, has applied for the rezoning of the above-described property to C-N Neigh- borhood Business, R-2 Duplex, and R-5 Apartment/Medium Density zoning; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the. C-N use was for one (1) acre of land within the tract; the R-5 use was for 12.038 acres within the tract, and the R-2 use was for 5.824 acres within the tract as depicted in the diagram attached hereto as Exhibit "B" and incorporated herein by reference; WHEREAS the City Council of the City of College Station, Texas, heard evidence that the proposed zoning change is in conformity with the City's Comprehensive Plan; WHERI2AS, the City Council of the City of College Statiqn, Texas, heard evidence as to the location of the property in College Station; WHEREAS, evidence was presented that this area of College Station is rapidly devel- oping and that there are a limited number of tracts available for said uses; WHEREAS, evidence was presented that the proposed use of the property as R-5 Apartment/Medium Density will be twenty-four (24) apartment units per acre; WHEREAS, evidence was presented that the proposed use of the property as R-5 Apartment/Medium Density at twenty-four (24) units per acre will satisfy some of the demand for apartments in this area; and WHEREAS, the City Council of the City of College Station, Texas has concluded that said rezoning is in accordance with its revised comprehensive plan and more suited to the aforestated uses; ,slcf;u ly94/rezonel 20.2 -' 60c J 2/09/94 " 2100 Ordinance No. Page 2 NOW, THEREFORE, BElT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the above-described property is hereby rezoned from R-1 Single Family Residential to C-N Neighborhood Business, R-2 Duplex, and R- 5 Apartment/Medium Density, effective immediately" PASSED and APPROVED this 8th day of December, 1994.
