AN ORDINANCE REZONING A 6.307 ACRE TRACT OF LAND SITUATED IN
THE MORGAN RECTOR LEAGUE, A-46, COLLEGE STATION, BRAZOS
COUNTY, TEXAS, FROM C-1 GENERAL COMMERCIAL TO R-5 APART-
MENT/MEDIUM DENSITY.

WHEREAS, on , 1994, the City Council of the City
of College Station convened and, pursuant to notices presCfibed by law, held a
public hearing with regard to the application forthe rezoning of 6.307 acres of
property situated in the Morgan Rector League, A46, College Station, Brazos
County, Texas, and being more particularly described as follows:
All that certain 6.3004 acre tract or parcel of land lying and being situated in the
Morgan Rector League, A-46, Brazos County, Texas, and being a p<.>rtion of a
33.63 acre tract conveyed to James E. Jett, mc. by W. R. Newton, Trustee, as
recorded by deed in Volume 515, Page 191,of the Official Records of Brazos
County, Texas, said 6.3004 acre tract being more particularly described by metes
and bOunds. as a 7.72 acre tract less a 1.4196 acre tract, as follows:
BEGINNING at the most southern comer of the aforementioned 33.63 acre tract,
same point being the south comer of Lot 19 of the Richards Subdivision, an addi-
tion to the City. of College Station as recorded in Volume 137, Page 25, of the
Official Records of Brazos County, Texas, same point also lying on the northwest
right-of-way of Richard Street;
THENCEN 460 05' 55" W along the southwest line of the aforementioned Lot 19
fora distance of 104.40 feet toa point for angle point, same point being the west
comer of the said Lot 19;
THENCE N 460 00' 55" W for a distance of294.54 feet to a point for comer;
TI-IENCE N 440 56' 55" E fora distance of 461.90 feet to a point for comer for
the beginning of a curve to the right;
THENCEN 570 53' 42" E along chord of said curve to the right for a distance of
432.40 feet to a point for end of curve and comer; (Curve data: Central angle =
250 53' 34"; Radius = 96?00 feet; Arc: = 436.10 feet; Tangent = 221.84 feet);
THENCE S 440 55' 05" E for a distance of299.53 feet to a point for comer, same
point lying on the northwest right-of-way of Richard Street;
THENCE S 44047' 09" W along the northwest right-of-way of Richard Street for
a distance of 875.75 feet to the place of beginning and containing 7.72 acres of
land, more or less.

Records, Brazos County, Texas, said 1.4916 acre tract being more particularly
described as follows, to-wit:

same point being the south comer of Lot Nineteen (19) of the Richards Subdivi-
sion, an addi.. 'tion. to the City of College Station, as recorded in Volume 137, Page
25, Official Records of Brazos County, Texas same point also lying on the

northwest right-of-way line of Richard Street; .
lHENCE S 440 47' 09" W along the northwest right-of-way of Richard Street for
a distance of 155.00 feet to the. place of beginning and containing 1 A 196 acres of
land, more or less.
Also being known as all of Lot Number Two (2), Holleman Place, an addition. to
the City of College Station, Brazos County, Texas, according to the plat thereof
recorded in.Volume 1040, Page485, OfficiaI Records of Brazos County, Texas.
WHEREAS, the above-described property is currently zoned 0-1 General
Commercial and the property is currently vacant;
WHEREAS, the owner of the above-described property, the City of College
Station, has applied for the rezoning of the. above-described property to R-S
Apartment/Medium Density;
WHEREAS, the City Council of the City of College Station, Texas, heard
evidence that the proposed rezoning is beyond the City's current Comprehen-
sive Plan;
WHEREAS, evidencewas presented concerning the general development in the
are~ overthe last several years; and
WHEREAS, the City Council for the City of College Station, Texas, has
concluded that there are changed conditions that justify the rezoning of the
subject property to R-S Apartment/Medium Density;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, that the above-described property is hereby
rezoned from C-1 General Commercial to R-5 Apartment/Medium Density, effec-
tive immediately.
