ACRES OUT OF AND A PART OF A CALLED 112.86 ACRE .TRACT OF LAND
CONVEYED TO EAST BY-PASS DEVELOPMENT GROUP IN A DEED

WHEREAS, on `September..22, 1994;. the City Council of the .City of College
Station convened and pursuant to notices proscribed by law, "held a public
hearing with regard to the application for the rezoning of six tracts of land consti-
tuting 69.84 acres out of and a .part of a called _112.86 acre tract of land
conveyed to East By-Pass Development Group in a. deed recorded in Volume
428, Page' 297, of the Brazos County Deed Records, said tracts being more
particularly described by metes -and. bounds as follows:
Tract A - 4.00 Acres..
BEGINNING at a 1/2" iron rod for the northwest comer of the herein described
tract ' of land, .same being the intersection of the easterly right-of way line 'of
Texas State Highway No: 6 (East By-Pass) with the southeriy right-of--way line of
Sebesta Road; ,
THENCE, N 44°25'10" E along said southerly..right-of-wayline of Sebesta Raad,
a distance of 400.00 feet to a point for northeast comer;
THENCE, leaving ..said southerly right-of-way line, S 25°2T33" E with a line
through the .interior of aid called 112,86 acre tract, a distance of 275.21 feet to
a .point for angle. on a line 400: feet east. of, measured at right angles to and

right-of-way ;line with the southerly righ#-of-way line of Sebesta Road bears

THENCE, N 44°25'10" E, through the interior of said 112.86. acre tract, _a
distance. of 485.72 feet to a point for the northeast corner of the herein described
tract. of land on a Tine 400 feet east of, measured at right angles to and parallel
to said easterly.right-of-way line right-of-way Tine of Texas State Highway No. 6
(East. By-Pass);
THENCE, with said line 400 feet east of, measured at right angles to, and paral-
iel to the easterly right-of-way ine of Texas State Highway No. 6 (East By-.Pass),

BEGINNING at a 1/2"Iron Rod set along the Sebesta Road right-of-way at the
west comer of the,125:9 acre T.D. Letbetter Tract as recorded in Volume 136,
Page 223 of the Deed Records of Brazos County, Texas, said point being the
POINT-OF-BEGINNING for the north comer of the herein described tract, said
point also bearing N 44°25'10" f a distance of 606.57 feet from a 1/2" Iron Rod
set of the southeast corner of the southerly. right-of-way line of Sebesta Road
and easterly .right-of-way line of line of Texas State ,Highway No: 6 (East By-
Pass);
THENCE S 44°25'10" W, a distance of 156.57 feet along said southerly right-of-
way line of Sebesta Road to a point for angle;
THENCE measuring at angles right, continuing through the interior of said ca{led.-
112.86 .acre tract the following courses:
1) S 25°2T33" E, a distance of 275.21 feet to a point for angle;
2) S 05°20'16" E, a distance of 215.80 feet to a point for angle;

along the southeriy right-of--way. of an access. road into the interior.: of the said

WHEREAS, the above-described Tracts A, B, and F are currently. zoned R-1
Single Family Residential and the current use is as vacant land9

Agricultural/Open Space and the current use is as vacant land;

WHEREAS, the owner of_the above-described property, East By-Pass Develop-
ment Group,.. has applied for the rezoning of Tracts A and B to C-1 .General
Commercial;
WHEREAS, the owner of the above-described property, East By-Pass Develop-
menu Group, has applied for the rezoning of Tract C to R-4 Apartment/Low
Density;
WHEREAS, the owner of the. above-described property,, East By-Pass Develop-
menf. Group, has applied #or the rezoning of Tract D o R-3 .Townhouse/Row-
house;
WHEREAS,. the owner of the above-described property, East By-Pass Develop-
ment Group, -has applied for the rezoning of Tract E to A-P Administra-
tive/Professional;
WHEREAS, the owner of the above-described property, East. By-Pass Develop-
ment Group,. has applied for the rezoning of Tract F to C-3 Planned Commercial;
WHEREAS, the City Council of the City of .College.. Station, Texas, heard
evidence'as to the location of the. propertyon the east side of Texas State. High-
way No, 6 (East By-Pass) jusf south of its intersection with Sebesta Road;
WHEREAS, evidence was presented that .the area of the City surrounding the
subject tracts is' being rapidly developed;
WHEREAS, the City Council. of the City of College Station, Texas has concluded
that the development taking place in .this area is a changed condition that makes
the subject property more suited to General Commercial and Planned Commer-
cial use; ;and
WHEREAS, the City Council of the City of College Station, Texas has concluded
that in order to adequately buffer the existing residential areas from the
proposed commercial. development, Townhouse/Rowhouse, Apartment/Low
Density, and Administrative-Professional tracts are necessary and will be effec-
tive,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, #hat the above-described Tracts A and B are
hereby rezoned from R-1 Single Family Residential to C-1 General Commercial,
the above-described .Tract C is hereby .rezoned from. A-O Agriculture/Open
Space to R-4 Apartment/Low Density, the above-described Tract D is hereby.
rezoned from A-0 Agriculture/Open Space to R-3 .Townhouse/Rowhouse, the
above-described Tract E is hereby rezoned from A-O Agriculture/Open Space to
A-P Administrative/Professional, and the above-described Tract F is hereby
rezoned from R-1 Single Family Residential to C-~3 Planned: Commercial effec-
tive immediately.
