ORDINANCE NO. 2083
AN ORDINANCE REZONING A 1.776 ACRE TRACT OR PARCEL OF LAND,
LYING AND' BEING SITUATED IN THE: RICHARD CARTER LEAGUE,
ABSTRACT NO. 8, COLLEGE STATION, BRAZOS-COUNTY, TEXAS, AND
BEING A PORTION .OUT OF THAT SAME 6.24 ACRE TRACT, CONVEYED
FROM BANKUNITED OF TEXAS, FSB, TO SUDHIR PATEL, AS DESCRIBED
BY DEED RECORDED IN VOLUME 1969, PAGE 131, OF THE OFFICIAL
RECORDS OF BRAZOS COUNTY, TEXAS, FROM C-1 GENERAL COMMER-
CIAL TO C-2 COMMERCIAL-INDUSTRIAL.
WHEREAS, on August 25,' 1994, the City Council of the City of College. Station
convened and pursuant to notices. proscribed by law, held a public hearing with
regard to the application for the rezoning. of a 1.776. acre tract or parcel of tend
lying and being situated-in the Richard Carter League, Abstract No. 8, College
Station, Brazos County, Texas, and being a portion out of that same 6.24 acre
tract, conveyed from BankUnited of Texas, FSB, to Sudhir Patel, as described by
deed recorded in Volume :1969, Page 131, of the Official Records of Brazos'
County, Texas, said 1.776 acre tract being more. particularly described as
follows:
BEGINNING at a 1/2" iron. rod found marking the west comer of said 6.24 acre
tract and .being also' the .north comer of .Lot 1, Harvey Road East Subdivision
(Amending Plat), as depicted by plat recorded in VOLUME 1123, PAGE 813 of
said Official Records, said comer lying also in the southeast line of Sam's
Subdivision, as depicted by plat recorded in VOLUME 1275, PAGE 13 of said
Official Records.
THENCE N 42° 18' 37" E - 170.00 feet with the northwest .line of said 6.24 acre
tract `and said southeast line of Sam's Subdivision to a 1/2" iron rod set for
comer.
THENCE S 33° 13' 01" E - 470.00 feet across said 6.24 acre tract to a 1/2".iron
rod set for comer.
THENCE S 42° 18' 37" W - 170.00 feet across said 6.24 acre tract to a 1/2" iron
rod found for comer, and being the east corner of said Lot 1, Harvey Road East
Subdivision.{Amending Plat).
THENCE N_33° 13' 01" W - 470:00 feet with the northeast line of said kot 1 to
the PLACE OF BEGINNING, and containing 1.776 acres of land.
WHEREAS; the above-described property is currently zoned C-1 General
Commercial and` the current use is vacant. land;
WHEREAS, the owners. of the above-described property, Sudhir D. Patel,. M.D.
and Alfred A. Martin, d/b/al Highway 30 Partnership, have applied. for the rezon-
ing of the above-described property to C-2 Commercial - Industrial zoning;
WHEREAS, .the City Council of 'the City of College :Station, Texas, heard
evidence as to the location of the property directly adjacent and to the rear of
Furrow Building Materials at 1501 East By-Pass;
WHEREAS, .evidence was presented that Furrow Building Materials is seeking
to expand its operation;

WHEREAS, evidence was presented that the proposed use of the property will
be for additional. employee parking and for storage of lumber and other burldmg
materials;
WHEREAS, evidence was presented that. the .proposed zoning change is in
accordance with the Comprehensive Plan; and
WHEREAS, the City Council of the City of College Station, Texas has concluded
..that the development taking place in this area is a changed condition that makes
the subject property more. suited to Commercial -Industrial use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COLLEGE STATION, TEXAS, that the above.-described property is hereby
rezoned from C-1 General Commercial to C-2 Commercial -Industrial, effective
immediately.
