AN ORDINANCE REZONING AN 11.00 ACRE TRACT OF LRND OUT OF AND
A PART OF A CALLED 112:86 ACRE TRACT OF LAND CONVEYED TO EAST
BY-PASS DEVELOPMENT GROUP IN A DEED RECORDED IN VOLUME 428,
PAGE 297 OF THE BRAZOS COUNTY DEED RECORDS,.. FROM R-1 SINGLE
FAMILY RESIDENTIAL TO C-1 COMMERCIAL..
WHEREAS,: on July 14, 1994, the City Council of the City of College Station
convened and pursuant to .notices-proscribed. bylaw held a public hearing with
regard to the application for he rezoning of an 11.00 .acres tract of land out of
and a part of a called ~ 12.86 acre tract of land conveyed to East By-Pass Devel-
opment Group in a deed recorded in Volume 428, Page.-297 of the Brazos
County Deed Records, said 11.00 acre tract being more particularly 'described
by metes and bounds as follows:
BEGINNING at a .point for the northwest corner of the herein described tract of
land, on the easterly right-of-way line of Texas State Highway Na. 6 (East By-
Pass), and from which poin# a 1/2" iron rod at the intersection of said easterly
right-of-way: line with the southerly. right-of-way line of Sebesta Road bears N
13°00'32" W - 219.1Q feet and N 05°20'16" W - 242.62-feet;
THENCE, N 44°25'10" E, through the interior of said 112.86 acre tract, a distance
of 485:72 feet to a point for the northeast corner of`the hereirr described tract of
land on a line 400 feet. east of, measured a# right angles and parallel o said east
erly right-of-way line of Texas State Highway No. 6 (East By-Pass);
THENCE, with said line 400 feet east of, measured at'right angles. and parallel to
said easterly. right-of-way, ine of Texas State Highway No. 6 (East By-Pass), and
continuing through the interior of said called 11:2.86 acre tract 'the following
courses
1) S 05°20'16" E, a distance of 69.83 feet to a point for angle;
2) S 13°00'32" E, a distance of 435.82 feet to a point for angle;
3) S 17°53'34" E, a distance of 431.06 feet to apoint for angle.; and
4) S 26°55'06" E, a distance of 278.62 feet to a point for southeast
corner; ':
THENCE S 44°25'10" W, continuing through the interior of said called 112.86
acre tract, a distance of 422.20 feet to a point for the southwest corner of the
herein described tract of land orf the aforesaid. easterly right-of-way'.line of Texas
State Highway No 6 (East By-Pass);
THENCE, N 26°55'06" W,..along-said .right-of-way line,. a distance of 445.29,feet
to a' Highway right-of-way marker for angle .point;
THENCE, N 17°53'34" W, 'along said right-of-way line, a distance of 479.68 feet
to a Highway right-of-way' marker for angle point;
THENCE, N 13°00'32" W,' continuing along said' right-of-way line, a distance of
260'.60 feet to the POINT 'OF BEGINNING and containing 11:00 acres of land,
more, or less.
WHEREAS, the above-described .property is currently zoned R-1 Residential
and the current use is vacant land;

~ WHEREAS, the owner of the above-described property,: East By-Pass.. Develop-
~ merit Group, has applied for the rezoning of the above-described property to C-1
Commercial zoning;
t WHEREAS, the .City Council of the City of College Station, Texas, heard
evidence as to the location of the property on the'-east side of State Highway 6,
immediately south of the intersection with Sebesta Road;
WHEREAS, evidence was. presented that this area of College Station is
developing and that this property is located on the frontage road of a high traffic
highway; and
WHEREAS, the City Council of the City of College Sta#ion, Texas has encour-
aged the .development of northern College Station and has concluded that the
development taking place in that area is a' changed condition that makes the
property more suited to commercial use;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE .CITY
OF COLLEGE STATION, TEXAS; that the above-described property is hereby
rezoned from R-1 Residential to C-1 Commercial, effective immediately.
PASSED and APPROVED this 14th day. of July, 1994.

,;- AN ORDINANCE RECEIVING CERTAIN TERRITORY ADJOINING THE CITY LIMITS OF THE CITY
OF COLLEGE STATION, TEXAS..
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS:
WHEREAS, the City Council has held a public hearing in the City Hall
,~~~ at 7:00 P.M. on .June 23, 1977 on the question of receiving certain territory
into. the city limits;
AND, WHEREAS, the City Council has heard all parties pertaining thereto,
has determined the. following:
Upon compliance with Article II, Section 7, of the. City Charter and
applicable laws of the State of Texas, the following territory shall be
incorporated within the city limits:-
BEGINNING at a point, said point being 'the most easterly corner of the existing _
corporate limits of the City of College Station, Texas, said point also lying
S'45°00'00" E a distance of 1124.0' from the southerly right-of-way line of
State Highway 30;
THENCE S 45°00'00" W, an approximately' distance of 2748 feet along the
existing city limits line to a point for a corner;
THENCE along the present city limits line, in a southerly direction parallel
to and a distance of 50D.00 feet from the east rght~of-way line of State
Highway 6 an approximate distance of 3130 feet to a point of intersection
with the most northerly property line of a tract conveyed to Raintree Development
Joint Venture in Volume 367, Page 61 of the Deed Records of Brazos County,
Texas;
THENCE in a northeasterly direction along the city limits line as defined
by Ordinance No. 1064 `for an approximate distance of .5707 feet to a point
for a corner, said point being on the common property line between the tract
~~ conveyed to Raintree'Development Joint Venture and a 20.69 acre tract
conveyed to Don Martell;
THENCE in a southwesterly direction along the southern property line of the
Raintree Development Joint Venture tract,'an approximate distance of 2262
feet to an iron rod, said point being the common property corner .between
Raintree Development Joint Venture tract and the 55 acre tract conveyed to
Glynn Williams;
THENCE in a northwesterly direction along the common property line between
the Glynn .Williams` 55 acre tract and the Raintree Development Joint Venture
tract an approximate distance of 1305 feet to an iron rod, said point being
a common property corner between these two tracts;
THENCE in a northeasterly direction along .the property line of the Raintree
Development Joint Venture tract, an approximate distance of 595 feet to an
iron rod;
THENCE in a northwesterly direction along the property line. of the Raintree
Development Joint Venture tract, an approximate distance of 812 feet to an

THENCE in a southwesterly direction along the property line of the Raintree
Development Joint Venture tract, an approximate distance of 1379 feet to
a point for a corner, said point being on the existing city limits line, said
line being 500 feet from .and parallel to the east right-of-way line of
State Highway 6;
THENCE in a southerly direction parallel to and 500 feet from the east right-
of-way line of State Highway 6, an approximate distance of 10800 feet to a
point for a corner;
THENCE in a westerly direction. along the existing city limit line an approximate
distance of 740 feet to a point for a corner said point lying in the most
westerly right-of-way line of Texas Avenue (State Highway No. 6);
THENCE in a southerly direction along the west right-of way line of Texas
Avenue (State Highway No. 6) to the point of intersection of -the .west right-of-way
line of Texas Avenue (State H%ghway No. 6) and the westerly extension of the
northwest right-of way line of Rock Prairie Road;
THENCE in a northeasterly direction along the northwest right-of-way line
of Rock Prairie Road t the point of intersection of-the northwest right-of-way
line of Rock Prairie Road and the west right-of-way .line of Bird Pond Road;
THENCE in a northerly direction along .the west right-of way line of Bird
Pond Road to the common corner between the C. B. Godbey 77 acre tract

the Jimmy Akin 45 acre tract;
THENCE in a northwesterly direction along the common line between the C. B.
Godbey, Jimmy-Akin and L. L. Carrol tracts to the southerly boundary of
the Foxfire Subdivision as recorded in Volume 358, Page 291-.293, Deed Records
of Brazos County, Texas;
THENCE in a northerly and westerly direction along the west Boundary of
the Foxfire Subdivision as recorded in Volume 358, Page 291-.293., Deed Records
of Brazos County, Texas, to the south right-of-way line of Sebesta Road;
THENCE in a northeasterly direction along the south right-of .:way line of
Sebesta Road to the common corner between Foxfire Subdivision as recorded
in Volume 358, Page 291-293-.and Volume 351, Page 435-435a, Deed Records of
Brazos County, Texas, and the W. A, McKean 30,46 acre tract recorded in
Volume 218, Page 820, Deed Records. of Brazos County, Texas;
THENCE. in a southeasterly direction along the west boundary of the W. A. McKean
30,46 acre tract, said line also being the easterly boundary of the Foxfire
Subdivision;
THENCE in a northeasterly direction along. the common boundary between the
W. A. McKean 30.46 acre tract and the Foxfire Development Corporation
property as recorded in Volume 347, Page 840, Deed Records of Brazos County,
Texas, to the common corner between the Tony Jones 49.92 acre tract
recorded in Volume 218., Page 842 of the Deed Records of Brazos County, Texas,
and the W. A. McKean 30.,46-.acre tract;
THENCE in a northeasterly direction along the •common line between the Tony
Jones 49.92 acre tract and the Foxfire Development Corporation tract to the
common corner between the Tony Jones 49.92 acre tract and the 67 acre Jett-
Schultz Venture 101 tract;

THENCE in a northeasterly direction along the common line between .the Jettr
Schultz Venture 101 ract and Foxfire Development Corporation property as
recorded in Volume 347, Page 840 of the Deed Records of Brazos County, Texas.,
to the common corner of the 67 acre Jett~Schultz Venture 101 tract and Clyde
F. Goen 64 .acre tract;
THENCE in a northeasterly direction along the common line between the
Clyde F. Goen 64 acre tract and the Foxfire Development Corporation.property
recorded in Volume 34.7, Page 840, Deed Records of Brazos County, Texas, to the
centerline of Carter's Creek;
THENCE in a northwesterly direction along the meanders of Carter's Creek same
being the existing boundary of the A&M Consolidated Independent School District
an approximate distance of 3.2 miles to point of intersection with the
existing city limits line as defined; by Ordinance No. 269, said point being
approximately 724 feet southeast of the Richard Carter-Morgan Rector survey
line;
THENCE in a southeasterly direction along the existing city limits line as
defined by Ordinance No. 2b9 an approximate distance-of 400 feet to the
POINT OF BEGINNING and containing 1600 acres, more or less.
