MINUTES Planning & Zoning Commission CITY OF COLLEGE STATION, TEXAS April 7, .1994 7:00 P.M. COMIVIISSIONERS PRESENT:.. Commissioners Mariott, Smith, Lane, Hall, Herring and Gribou. AGENDA TI'EM NO. 1: Approval of minutes from the meeting of March 17, 1994. Commissioner .Gribou moved to approve the minutes. from the meeting of .March 3, 1994 as written. Commissioner .Mariott seconded he motiod which passed unopposed (5 - 0); Commissioner Herring was not present during the approval of minutes. AGENDA ITEM NO. 2: Public hearing to consider a rewning request for 17.33 acres .located .along the' south side of Roek Prairie Road approximately 650' east of State Highway 6 from G2 Commercial Industrial to R-5 Medium Density Apartments. (94-108 Staff Planner Kuenzei presented the staff report and .recommended. approval of the proposed rezoning. Staff originally recommended denial of. the C-2 and maintains that .the R-5 designation that is now .requested would be preferable to the current. zoning. The R-5 zoning would be a better reflection. of the Land Use Plan and would meet- the recommended development policy regarding land use patterns along major roadways.. The: subject property was rezoned in 1986 from Agriculture/Open Space to the current C-2 designation. The C-2 tract located to the west of the subject .property and... the A=P tract to the east and south were included in the original request.. At the time of the public hearing, staff pointed out that the Land Use .Plane reflected .this property as medium density residential, and that the. request for the subject property was not in compliance. with the Plan. The ntenf of the Plane is to allow commercial zoning .near the Highway 6 intersection and to buffer the residential zoning to the south and east through step down zoning. The request pushed commercial use further. away from the intersection than. would be desirable under: the Comprehensive Plan. As a compromise solution, the applicant offered the A-P tract to the :east and south as a buffer zone. Fifteen surrounding property owners were notified with no response. Commissioner Hall: opened. the public hearing. Seeing no one present to speak in favor of or in opposition to the proposed rezoning request, he closed the public hearing.. Commissioner Gribou moved to recommend approval of a rezoning .request of 17.33 acres located .along the south side- of Rock Prairie. Road approximately 650' east of State Highway.. 6 from C-2 Commercial- .Industrial to R-5'Medium Density :Apartments.. Councilman Mcllhaney seconded the motion which was approved unanimously. 7-0. Agenda Item No. 3 - A public hearing on the question of rezonin a 54.99 acre tract (the: proposed Devonshire Park subdivision) located at the southeast corner of the intersection of Rock 'Pra'irie Road and Texas Avenue (SH6) from Agricul Ural-Open District-A-O to Commercial- Industrial District C-2. Jerry Bishop.& Associates, a licant; Joe A. Ferreri, -owner. (86-100) Assistant to Director of Planning Jim-Call.away presented this item. He noted this tract'is vacant wtha commercial .building (vacant) and church to the north. Balance of area is A-0 with scattered residen- tal`uses. Thies tract is located in an area planned for commercial and medium ;density residential uses. The planned medium density resi- dential area serves as a buffer between the commercial'area north of Rock 'Prairie Road and the low density residential areas planned to the east and south, He pointed out that establishing C-2 zoning on this entire tract will push commercial zoning well into areas planned as buffers and low density residential areas, and then providing adequate buffers. around the C=2 tract would push the "buffer. zones" further into areas planned for low density residential uses. He also noted the area to the. west of the tract (across Tx. Ave.) is zoned C-2 and the commercial area along the west side of Tx. Ave, was planned to extend south to Graham Road. He stated that the applicant revised his rezoning request by providing a 26'.63 acre A-P area along the east and southern portion 'of the tract: This would-establish a-buffer approximately 6.00' wide .across those ,portions of the tract.. He further stated the proposed commercial :and =office-commercial areas still `extend into areas reflected as medium and low density residential on the land use. plan. Mr. Callaway noted that the Planning and Zoning Commission voted 5-2 to deny this rezoning request. Mayor Halter opened the public hearing. Larry Wells of Jerry Bishop & Associates came forward as a representative of the owner of the land. He distributed brochures which explain the'bwner's plans for development. The area of development will be considered as a medical subdivisionto answer various needs of the cortgnunity. He referred': to Map A showing the concession the applicant made for a buffer. Mr. Wells stated that in order to build the medical subdivision, he would amend therequest from C-2 to C-1 if asked to do so by the council. He stated that the Comprehensive Plan is a guideline, and as needs change the council-should make decisions according to the changes. He also'stated this would not be strip-zoning. Mr. Wells reques ed affirmative action 'from the Council to zone this area C-l with the A -P buffers. Councilman Tongco-questioned what area would be changed to C-1. Mr. Wells replied everything requested as C-2 on Map-A could be downgraded to C-1 with the A-P buffer adjacent 'to the property. Councilman Tongco asked Mr. Callaway what the major differences are between C-2 and C-1 zoning. Mr. Callaway replied that C-2 zoning districts :allow all the C-1 uses. plus light industrial uses. Councilman Brown asked what is the C-3 area next to the Woodcreek Addition. Mr. Callaway responded that this is a vacant area and is part of the Woodcreek Addition. Councilman Bond asked. why the area is zoned C-3. Mr. Callaway noted that Woodcreek Developers included this in the zoning request, for possible service businesses and shopping centers,. Mayor Halter asked if this is in compliance with the.Comprehensive Plan. Mr. Callaway responded negatively. Jerry Bishop spoke on behalf of the owner, Joe A. Ferreri, to :explain Mr. Ferreri's plans for a professional complex. He stated that the objections of the P&Z Commission were (1) the C-2 zoning, and (2} the ..area to be rezoned did not .comply with the Comprehensive Plan. He stated that he disagreed with the P&2's comments. Mr. Bishop referred to the Land Use Map, to Plan B, and to page 33 of the Comprehensive Plan which states De velopment Suitability. He commented on the existence of commercial zoning along Texas Avenue inconsistent with the Land Use Plan, and quoted from page 3 and page 5 of the Comprehensive Plan. Mr Bishop distributed copies of a memorandum written by Al Mayo to the P&Z. He discussed the contents of the memo and stated points with which he disagreed. r REGULAR MEETING OF'THE CITY COUNCIL. He stated that thi's tract is able to handle the traffic generated. within the development. Mr. Bishop quoted _a statement made by Mr. Mayo comparing this tract to the area bounded by Lincoln, Munson, Francis, and Walton. Mr. Bishop stated that this tract is vacant and wide open and is not a comparison. Councilman Runnels asked if Mr. Bishop is requesting C-2 for the entire tract. Mr. Bishop replied they are asking for 26..6.3 acres to be zoned A-P at the back of the tract., for C-2 zoning. for the front part of the tract with 28 acres, or, for C-1 for the front if necessary. Jim•Gardner, 1216 Ridgefield Circle N, addressed the Council and referred to the Comprehensive Plan. _He commented that the Plan should not be taken lightly.. He asked Council to consider two points l) Is his area a reasonable: size .for this type of request; and, 2) the location of Humana Hospital across a major freeway. He commented on the "development:suitability".guideline as .suggested by the Comprehensive Plan. No one else. spoke. The public hearing was closed. Agenda Item No. 4 -Consideration of an ordinance rezoning the above tract Councilman Runnels asked Director of Planning Mayo if the Land Use Suitability Maps necessarily `correspond with the Comprehen- sive Study. Mr. Mayo responded by saying every piece of`property is noted on the Land Use Maps and each has different suitabli- ties. The Comprehensive Plan makes other considerations, Mayor Halter .stated that the Comprehensive Plan says 960 acres of already zoned and"yet undeveloped commercial tracts are aval- able, and other tracts which have. note. been rezoned. ;He referred to Mr. Mayo's statement about vacancy rates and unfilled office space which will probably take years to absorb, and questioned Mr. Mayo about the additional commercial areas reflected in the Comprehensive Plan.. ~_ ., REGULAR MEETING OF THE CITY COUNCIL THURSDAY, FEBRUARY 13, 1986 PAGE 5 After additional discussion relating to-commercial zoning requests and the Plan 2000., Councilman Tongco moved approval of Ordinance No`. 1632 to rezone: the 54.99 acre tract from A=0 Agricultural-Open to C-2 Commercial Tndustrial with A-P buffers. He explained the 'Staff recommendation that the Council make any approval of thisrequest. contingent upon the extension of Stallings Drive. He also noted that at the time ..the. Comprehensive-Plan was adopted, the ,proposed width of the Holleman Drive extension was 39 feet in a 60-foot right-of-way. -In 1984 the proposed width was increased to 47 feet in a 70-foot right-of-way. This tract does not have access to Holleman Drive and a proposed ex ensign of Stallings to Holleman would provide access to the Holleman Dr<ive area..- Mayor Halter opened the public hearing. No one poke. The public hearing was closed. Jerry Bishop & Associates, applicant; Joe A. Ferreri, owner. Mr. Callaway pointed out-the location of ,the land on a map on the wall, then explained area.. zoning and. land. uses. He informed the: Commission that the adopted Land Use Plan reflects the area at the intersection bf Rock Prairie Road and Texas Avenue as commercial and medium densi y residential, with the commercial uses located along the-north side of Rock Prairie Road and the medium density residential uses along the south side. He went onto explain that the areas to the south and east of the subject tract are reflected as low density residential, and the subject tract is in the area planned as a medium density residential buffer between commercial uses to the north (across'Rock Prairie Road) and low density residential uses to the south and east: He pointed out that establishing C-2 zoning on thin entire tract will push commercial zoning well into areas planned as buffers and low density residential, and then providing adequate buffers around the C-2-:tract would push the "buffer" zoneseven further into areas planned for low density residential uses. He went on to explain that a commercial area along the west side of Texas Avenue was planned to extend.south to Graham Road, however in May,_19$5, a 10.? acre C-Z .district was established along the west side of Texas Avenue south of Graham Road, with an R-6 area established to-serve as a buffer between the C-2 district and .planned low density residential areas, as well as to provide a "breaking point" for commercial zoning tothe south. _1 P&Z Minutes 1-16-$6 He pointed out that the location of commercial zoning on the portion of this tract at the intersection of a major'and a minor thoroughfare would be consistent. with the City's"development policies for.. commercial locations. ,He indicated that the realignment of Rock Prairie Road`is included in the Cty's_thoroughfare plan, with the intersection of Rock Prairie Road and Texas Avenue being moved to the north, aligning with the 'portion of 'Rock Prairie Road on the west side of Texas Avenue, and the portion of Rock Prairie Road between Texas Avenue 'and. the point at which the realignment begins will remain as-a collector street. He said staff is concerned with the request because rezoning a tract this large would provide for a much larger commercial area than planned for this location, and if approved; commercial uses would intrude into areas planned formedum and low density residential uses.. He explained that establishing.C-2 zoning only on the western portion of his tract would not be inconsistent with development .policies with respect to location, as long as the commercial zoning does not extern in a strip to the south along Texas Avenue.. He reminded the Commission that a preliminary-plat has been approved for-this tract which included a 5.98 acre tract at the intersection of Texas Avenue and Rock Prairie Road. He explained that the eastern boundary of this proposed 5.98 acre tract is at the same depth off Texas Avenue as the C-l zoning district on the north side of Rock Prairie Road, and staff recommends that any commercial zoning granted in this. area be limited to that depth, with the balance of the area zoned medium and low density residential in accordance with the land use plan... Mr. MacGilvray asked if pushing the buffer areas.further from the intersection is. bad and Mr. 'Callaway replied only because doing 'that would make a larger commercial area. Discussion followed regarding the C-2 and R-6'zoning on the west side of Texas Avenue from 'this tract, how the area along.. Graham Road appears to be developing, location of the city limits, as wel as the preliminary plat previously approved for this 55 acres. The public hearing was opened. `Larry Wells of Bishop & Associates came forward as a representative of the owner of the land and passed around brochures which he explained represent the owner's plans for developing the area. (A copy of this. brochure is-included with these minutes.) Mr. Wells stated that at the time another rezoning request was being considered, an area resident stated during the meeting that it was his opinion that commercial development/zoning may well have less impact on a residential area than a:medium/high density apartment "buffer area" in .that the commercial development would generate less noise, traffic and general impact on 'the area than an apartment complex occupied by students. He added that a precedent had been set at that time, when the request to.rezone land from low density residential to commercial, with no stepdown buffering, was. approved. (Area referred to is the northeast corner of the ,intersection of Southwest Parkway and Wellborn Road, Ordinance No. 1561.) Mr. Wells continued with his presentation by explaining that the approximate center of the developed area of the city is SH30,-but in-the future when full 'development of the city takes place, the center of the. city will be located approximately at this intersection. Mr. Wells the explained that Lick Creek is a natural buffer o areas to the south,: and the future extension of Bird Pond Road (which will become a major street) where it meets Rock Prairie Road will create an isolated area, and if stepdown zoning. is required,`it could be accomplished in the small area between the subject tract, and 2 P&Z Minutes I-16-86 the extension of Bird Pond Road to the east, and Rock Prairie Road and Lick. Creek to the south. (Mr. Wells had a mag on the wall which reflected the areas he referred to :in his presentation.} He then went on to .say that water. and sewer demands for C--Z development would be approximately the same as those for medium density residential .development, and that Rock..Prairie Road willhave an 80 foot. right-of- way which can readily handle any traffic..generated by the proposed type. development.' Mr. MacGilvray questioned Mr. Wells regarding his statement that. someone had :made a statement. that they preferred commercial development over apartment development next to low density. residential uses. Mr.`We1ls,replied that when the. rezoning request regarding land at the northeast corner of the intersection of Southwest Parkway 'and Wellborn was being considered, someone made that statement. Mr.-Kaiser asked if Mr. Wells was making a direct quote, and Mr. Wellsreplied that. he was not, but that one resident had given-that opinion in the past. Mr. Kaiser. asked.. Mr. Wells if he is suggesting commercial uses right next to .low density: residential uses as a policy p annng guideline and Mr. Wells replied that development could be controlled without s epdown zoning, although it would-be difficult for the city to `control. He explained that it could be done in :this subdivision because of-the larger acreage-of the tracts which would provide more open space, unlike the development which has taken place at the regional mall. Mr. %aiser then pointed out that the proposal made in he brochure may never take place, and this Commission must keep this in mind, and consider whether or<not the subject tract is a good location-for C-2 zoning/development. Mr. Wells said that he believes that sometimes the Comprehensive Plan is used as an exact tool, and sometimes it is used as a plan, and that in this instance, he believes the'subject land is in a. good commercial location because of the location of 'the streets which 'will be carrying heavy"traffic in the future. He pointed .out that Bird Pond Road will become a very important.north/south corridor when the frontage roadbecomesa one-way road. Mr. Kaiser said that in his opinion, Mr. Wells has presented a very persuasive argument for further study of the area from the existing developed area of the City to the Industrial Tract at the southernmost city boundary, as well as exemplifying why this whole area should not be left A=0-indefinitely to be zoned on a piecemeal basis... No one else spoke. The public hearing was closed. Discussion followed concerning what uses could be allowed in G-2 zoning districts, the location of the city's largest C-2 zoning district now,. the fact that many of the Commissioners-had-believed the preliminary plat approved for the subject-land was for residential development, with Mr. Callaway explaining that the'staff report for that plat. had indcated'the size of the lots were not large enough for residential development, and that zoning of the land would have to be established before the land. was final. platted. Mr, Paulson said that he had always envisoned this area. developing similar to the area along Graham Road. Mr,- Kaiser asked if staff is indicating that C-2 zoning is not inconsistent with the plan,. and Mr. Callaway replied that at the intersection there is a tract which is the same-depth as the existing commercially zoned area on 3 P&Z Minutes 1-16-86 the north side of Rock Prairie Road, and staff does not' hnk some C-2 zoning at this location .would be 'inappropriate. Mr. Paulson said he thought commercial zoning. should be put 'in one "lump" rather than to create "strips". Mr. Wendler stated that he thinks the strongest point Mr. Wells made for rezoning this to commercial is the fact that the extension of .Bird Pond Road, the location of .Lick Creek,-Texas-Avenue and Rock Prairie. Road create an "island". Mr. Kaiser stated the Commission has been looking at the area in a piecemeal matter, and it should be looking at it in a larger content. He added that it is difficult to envision buffering, etc. when studying one. tract at a time, and he recommends that a broader study of this area be done., He-then. asked if staff ogposes this request. Mr. Callaway replied that'staff opposes any extension of .commercial zoning into areas reflected as residential on the adopted Land Use Plan. Mr. Kaiser asked if there had been consistency in the application of the plan acros Texas Avenue from this tract and Mr Callaway replied that rezoning had been consistent with the plan and the policies of the city. Discussion followed concerning the zoning in the;Woodcreek subdivision, with Mr. Kaiser reiterating that he has concern with what should take place between this area and the southernmost city limits. Mr. MacGlvray said. he has concern, regarding the project being proposed on this land. Mr.-Kaiser instructed the Commissioners that those plans should be looked'at as idealistic gleans, but the P&Z should actually consider the merits of the rezoning request, including buffering, development policies and the comprehensive plan-itself. He added 'that in the past, this Commission has avoided. putting commercial zoning adjaeent_to low density residential zoning. Mr. Paulson`said this land is'undeveloped and has never been .zoned to other than A-O, and asked why the buffer can't be moved out. Mr. MacGilvray said it-might be even better if it were moved out. Mr. Kaiser said that Rock. Prairie Road will be an arterial and it makes sense to establish commercial zoning at that type of intersection, although it is not necessary to establish commercial zoning at_every'ntersecton of that type. He went'on to say that he can see the merits of C-2 zoning at this location, but he is 'bothered by the amount (55 acres )...and the buffering. aspects,. but added that. as Mr. Paulson has pointed out, the buffering could take. place off this site.. Mr. Paulson said he 'has no problem 'with the` ocation or the. acreage involved with this request, ,as in the past the city has rezoned many small tracts which added together have made large areas. Mr. Dresser said there is so much land zoned A-0 that he has trouble visualizing what the larger area will look like. He explained the Land Use Plan 'should be studied from Barron Road to Rock Prairie Road, because it now looks like it is all getting zoned commercial. Mr. Kaiser reminded 'the Commission that they must look at the options .for this request:`>to approve, to reject or to table the request to give the applicant the opportunity to work with staff in working out :.something acceptable to all parties.-'Mr. Callaway stated that staff has no objection to examining alternatives for this tract or-even for a larger area. Mr. Dresser said part of the problem is that the city doesnot zone exceptby application. Mr. Kaiser said that when land is annexed into the 'city it comes in as A-O, but he believes the city should not leave it zoned A-O indefinitely, and pointed out that this Commission can initiate rezoning. Mr. Paulson said he would not like to table this request because it could delay planned projects, and he believes the city would be better off if action was taken on this request with the larger area to be studied later., Mr..Kaiser disagreed, stating that he would prefer to give the applicant the. greatest. flexibility, and perhaps' abing.this request would do that, that is to work with staff on possible alternatives. Mr. Callaway explained that this item will not be heard by the council until February 13th,'therefore'it could 4 P&Z Minutes 1-16-86 be tabled at this meeting. and be acted on at the next P&Z meeting on February 6th 'without .interrupting-the advertised schedule. Mrs. Stallings the made a motion to table this item. Mr: Dresser seconded the motion: Mr. Wendler said he would like to see the addition of a stipulation to this motion to table to the effect that the applicant must get together. with staff and look at the entire 'area of the island which will be-created between Rock Prairie Road, Bird Pond Road,. Texas Avenue and Lick Creek. Mr. Kaiser said he agrees with Mr. Wendler, but would like to add to than stipulation that the addition of 'buffering, either on this site or off this site, should be considered. Mr, Dresser said the applicant has provided this Commission with his concept of buffering, and appears to 'be ahead of us. Votes were cast on the motion to table and carried by a vote of 5-1 (Paulson .against). "He pointed out area zoning and existing land uses,. adding that this area is I', reflected as office-commercial along Harvey Road with high density residential uses to-. the east,. south and west, therefore the: requested C-1 zoning would not be in compliance with the plan. He went on'the-explain, however,, that since the adoption of the plan in 1982, there have-.been several changes in conditions in the area, .including. establishment of 36.69 acres of C-l zoning and 15.52 acres of A-P zoning in 19$4, and'; in 1985,$.95 acres of'A-P"were rezoned to C-1 adjacent and to the south of subject tracts. In addition to these zoning changes since the adoption of the plan in 1982, the. proposed width of the Holleman Drive extension has been .changed from 39 feet in a 60 foot right-of-way to 47 feet in a 70 .foot right-of-way (a commercial street section with sidewalks on both sides). He went on to point out that at this. time'-there are no land use or zoning conflicts associated with this request:;..that all adjacent tracts are currently zoned C-1 or R-6. He added that the subject tract has adequate depth and. area for commercial zoning. Mr. Callaway explained that since this item was tabled at the Last meeting, Mr. Wells from the office of the applicant has met with staff and Commissioner Wendler to discuss changing the request to better comply .with. the adopted Land Use Plan, and although a compromise has been offered by the applicant of approximately one- half of the area to be A-P with the remaining approximate one-half being C-2, taff''would point out that it stil does not comply. with the adopted Land .Use .Plan, however,. staff would additionally point out that the compromise does provide on- site buffering (A-P} between the commercial zone and the adjacent areas which the Land Use Plan. indicates as low density residential. ~ Director of Planning Mayo came forward to express his opposition to thin request, pointing out'that it is in direct violation of the adopted Comprehensive Plan as it intrudes into an area. designated as residential on the Land Use Plan. He further explained that there is no need for additional C-2 zoning in this particular area as there is a large area of existing,_undeveloped C-2 Tand just across Highway 6 from this tract. He-pointed out that this land is almost 2000 feet from the location of the major 'intersection of Rock Prairie Road and Highway 6, adding that of the almost 140 acres of existing commercially zoned land around I P&Z Minutes 2-6-86 this.intersection, over l00 acres of .that land is undeveloped. He referred to a memo he had. written and made available to the Commissioners prior to-.the .meeting, in which he listed land use objectives in the Comprehensive Plan as being to protect integrity of single family areas, to encourage the use of vacant land within the'city limits and to avoid strip commercial development {which is also listed as an environment objective in the Plan}.' He went on to refer to the .projected .future commercial. market as-addressed on page 101 of the Plan, ':development strategies .from page 196 of the Plan ,.development policies from page 198, development plan from page 199, and locations of commercial activities from page Z00. He finalized his-presentation by stating `that if he were asked to make a recommendation, it would be that the front or western portion of this tract should be A-P with the back or eastern portion being single family or some other residential zoning district. Discussion followed regarding the existing zoning in'the immediate area to the south and the location of an existing oil well on this tract, with Mr.' Paulson adding that utilities for this tract are being put in so he does'not understand the concern with'eommercial development here. He went:on to indicate that development suitability on page 33 of the Comprehensive Plan shows some commercial at this location, whereas page 63 of''that same. plan indicates low: 'to normal suitability for R-1 development at the area. He added that in his opinion the`Plan is lacking in this entire southern: area of the City., The Commission then invited. Larry Wells, representative of the applicant forward to explain the current request of C-2 & A-P zoning, adding for the benefit of ;the audience that since the public hearing was held"on January 16th for this .item, no public hearing would held at this meeting... Mr: Wells came forward'andplaced two maps on .the wall which. he `referred tows Plan A and Plan B. He explained that Plan A exemplifies approximately 49% of the 54.99 acre tract as A-P with the remaining approximately 51% of 'the land as C-2, indicating that. his firm had persuaded the owner of the land that he should provide the buffering on-site which the City has expressed a desire to fiave. 'He pointed out that the'area being proposed as A-P exceeds 600 feet. in width, and because of its size, could'be developed separately from the 'remaining C-2 acreage. He stated that exclusive of anything else which is happening or has happened in the-City, this request represents normal zoning in the City by virtue of its location, as well as the fact that it would preclude strip zoning as the proposed tracts are shown in "acres" rather than 'in "feet". He stated `that C-2 zoning is desired by the owner on this tract as it allows for some type of light manufacturing should that be the demand in this rural type subdivision. Mr. Wells then addressed "Plan B", stating that''it represents the ocations of future potential commercial 'zoning. He further pointed out that although Mr. Mayo has presented numbers which_'indcate`an "overage" of available commercial zoning acres in the'Cty, he would ,like to include the fact that the City also seems to ..have a "overage" of available residential zoning in the City as well. 'He stated that the problem with "overage" is that some tracts simply never develop as predicted, and that a Comprehensive Plan is just that - a plan which does not. always develop. He went on to reiterate that this. plan does not constitute a "strip", but..rather .cluster zoning, as the.. applicant has squared off a commercial zone by lining up with zoning districts"`across the street, which is a major arterial at a major intersection where there is ''some commercial suitability. He stated that commercial 2 P&Z Minutes 2-6-$6 development here would not be a detriment to any residential zoning in the immediate vicinity;. that utilities are adequate for the requested zoning, and pointed out that hopefully nothing will develop right at the major intersection planned,.. as there will be an overpass-rather than simply an intersection as we are accustomed to. He went om to explain there .are:. two types of commercial development; "impulse." development such as a MacDonalds Restaurant, and "service" development such as:businesses to which people plan ahead where they are ;going for a specific-service or product. He stated that service commercial development does not need. to be located immediately at a major. intersection. Mr. Dresser asked-if there are plans `to change. the plat which this Commission has reviewed and Mr. Wells stated that to his knowledge there are no plans to change the plat unless changes are required for right-of-ways, easements, etc. Mr, Kaiser said. the plat had been prepared with C-2 .development.. in mind, and:. perhaps it would not be suitable for A-P development. Mr. Paulson reminded the Commission that only a Preliminary, Plat has to date been approved. Mr. Kaiser asked if the applicant or owner has and adjacent to the proposed C-2 ;under ownership or option. Mr. Wells replied that to his knowledge, neither the owner nor the applicant has additional adjacent. land under .ownership or option. Mr. MacGilvray asked why C-2 zoning is being requested, as it seems to him that perhaps M-l zonngjdevelopment is what the owner is leaning toward. Mr. Wells stated that would be a moot. point, as certain medical :facilities would require a Conditional Use Permit anyway. ,Mr. MacGilvray read the list of permitted uses in a C-2 zone, ..pointing out that if medical businesses never.came, other perm ted uses might be undesirable at this location. Mr. Wells said that even if"that should occur, it should not be a problem-as there is a buffer to the north, a buffer to the south, Texas Avenue to the west, and Rock Prairie Road to the east, which in itself would probably preclude the location of single family homes in the immediate area. He then-pointed out that this particular area will be heavily impacted by both traffic, and noise. Mr. MacGilvray stated that if he were the owner he would-try to find a zoning district tv comply with planned us$s, and M-1 would.. cover al 1. the owner has stated he is glanning. After discussion regarding what would be allowed in C-2 districts as opposed. to what would be: allowed in M-l districts, Mr.- Kaiser reminded the Commissioners they should consider what uses would be appropriate in this cluster zoning area.. Mr. Brochu said he believes that the Commission should consider how-this would fit into the whole City as well as to consider what has happened in other areas rather than to'simply consider this location. exclusively. Mr. Paul'sorr said the Plan indicates commercial zoning at major intersections. He pointed out that there are lOl acres of .commercial development on one steat Harvey Road and the East Bypass (Post -0ak>Mall}. He continued by pointing out that we know this triangle is isolated from surrounding areas by either roads or a creek. He then stated that there must be something lacking in-the Comprehensive Plan if the Commission or the Council determines that additional studies of specific areas are required. Mr. Wells stated .that ,if the developer does not control 'uses within his subdivision other-lots will not be 'saleable; so it would be to his-advantage to retain same control;. but in this particular instance he does not know what.'.the owner's plans are. Mr. Kaiser stated that this item had been tabled on 1-16-86 to allow time for the applicant to address buffering the requested C-2 zoning; and to meet with staff. The proposal of C-2 and A-P zoning followed the tabling of_the item and the meeting with staff. Then a memo from Mr. Mayo in opposition to the request was received by Commissioners.. 3 P&Z Minutes 2-~6-86 Jerry. Bishop of Bishop & Associates,.. Inc. was invited..forward'to speak and he stated that his representative had agreed to have this item tabled in January to study, and to meet with staff as directed. The results of which were to convince the owner to make a "reluctant" compromise of a change in the request fromall C-2 zoning to a combination of C-2 with A-P buffering-for the best-interest of the City. He stated his representative believed this newest proposal would have staff approval, but less than 24 hours before this meeting he got wordof amemo from Mr. Mayo; expressing opposition to this compromise reques He went on to state that at the last: meeting his representative had asked for C-2 zoning and further asked P&Z to consider all permitted uses in that district .even .though the: owner has plans far medical facilities at ..this location. Mr. Bishop then asked exactly what is .wrong with farm implement sales,;machne shops, etc. at this ovation since the City really would not lose control, but would retain control through sight.plan review, control`of access location, landscaping, etc,, and because these are large tracts,. the City retains even more control. Mr: MacGilvray askedwhy C-2 zoning is being requested rather than M-1 zoning... Mr. Bishop replied the owner prefers the allowable diversification of C-2 zoning, that although this subdivision s`planned to be medically oriented, retail sales are prohibited in M-1: zoning. Mr. Brochu said he would like to address the special. studies mentioned earlier by Mr. Paulson, adding that the. results of the individual studies conducted ao date largely supported the Comprehensive Plan. Mr. Paulson replied that this area is a fringe-area of the City, and in his :opinion, nat much-:study was .`given to-future uses of this land from here south to the City Limits'. Mr. Wendler stated that he had been concerned with. the previously proposed C-2 width at the eastern 'end of this tract, 'but now_with the proposal of A-P at that location, the plan seems to make sense. He added that he believes that. this future-major intersection will be a nucleus in the future, and perhaps the City should. begin to recognize that possibility. Mr. MacGilvray said that C-l or M-1 zoning at this location would not .bother him so-much, but the wide range of permitted uses in C-2 zoning could allow some undesireable uses to be established at this location. Mr.' Wendler said that the size of the lots might help control the uses. Mr, Kaiser said that he would like to briefly summarize some of the facts which have been presented; the first being that staff would not .oppose the C-2 request for the western .most ;tract if it was 'squared` off wththatacross. Rock Prairie :Road; secondly, the applicant has tried to shrink his C-2 request to"more comply with staff's recommendation,- so ''now this Commission is dealing with only 15-20 :acres more than staff,: is willing to accept; and finally, the applicant has now..provided on-site buffering. He went'on to state that some of the questions .which must be answered are (1}is commercial use of this land appropriate? {2}is the buffering, being proposed acceptable? and (3)how-much commercial zoning should be allowed at this major intersection? Mr. Paulson stated that there is C-2"zoning across the .highway from this, so why is it deemed 'inappropriate on this side of the highway? Mr: 'Kaiser continued by asking if G-2 uses. or uses other ..than residential are appropriate at this major intersection. General discussion followed regarding haw long, the land fill is planned to operate at this location, afterwhich Mr. Brochu made a motion to deny this request. Mr: Dresser seconded.the motion to deny the request. Mr. Mayo advised that the Council would.prefer that the Commission make some kind of recommendation rather than simply to deny a request. Mr. MacGilvray stated the 4 P&Z Minutes 2-6-$6 applicant makes a good point for this location not to be residential, at least on much_of this=property, but he added that he still has a-problem. with the C-2 portion of the; request and would prefer C-1 or M-1_at"this location.- Mr. Kaiser .addressed Mr. Mayo's statement regarding this Commission making a recommendation to the City. Council,'stating what rather than'to play the zoning game,_this Commission's'moton to deny this request-represents a reaffirmation of ..the Comprehensive Plan to the Council. Mr. MacGlvray pointed out that there are no commercial` uses shown at .all on the Plan for this. location. Mr. Kaiser stated-the fines on the Plane are somewhat imprecise. .. Mr. Paulson stated that. is true, but we tend to accept the lines hown as being precise. Mr. Wendler stated that there are some areas. which seem to be better suited for something other than residential, and this seems to be one of those locations due to the traffic and noise potential. He added that'he thinks it has only moderate suitability for residential development, and further, that he thinks there could be same sort of_steppng away from this intersection, and,the request presented seeans to be a good plan. Mr. Brochustated that he really does not disagree with the above statements, but that he is opposed to C-2 zoning at his'locaton. Mr. Dresser stated that'the applicant's "B" map seems to be valid and hat he is-concerned that positive action on this request would not be confined o this tract, but would carryover to adjacent tracts, and he is uncomfortable with. rezoning an area that large. He then stated that hehas no problem with..C-2'zonng on he approximately 6 acres next to the highway. .Votes were caste on the motion to deny, and the motion carried by a vote of 5-2 with Mr. Paulson and Mr. Wendler voting against the motion. AGBNDA ITEM N0. 4. 86-202s Final Plat - Herman F. Srenek Phase 2. Mr. Callaway explained that this final plat; represents aslight deviation from the approved preliminary, thus staff held a presubmission conference to review this plat. He added that the.conditions stated on"the presubmsson`conference report have. been met and staff .recommends approval as shown. Mr. Paulson made a motion to approve this plat; Mr. Wendler"seconded the motion which carried unanimously (7-0). AGENDA ITEM. NO. 5. 86-203: Final Plat - Replat of Lots 2 & 3 Block I'Bmerald,Forest Section Two.` Mr. Callaway explained this simple-replat is being done by"the owners of the two .lots to allow one lot owner to 'make an addition to his home.
