'i along with the C-2 tract to the west and the A-P tract to the east had been rezoned from-A-O to
their present classifications in :1986. Staff had recommended denial` of commercial use of the
same .tract that is presently under consideration due to the belief that it was too far from an
intersection and therefore 'began to encroach into the planned residential areas to the"east and
south. The request was also not in compliance with the Land Use Plan, which shows medium
density .residential to act as a buffer between the commercial at-the intersection and the single
fanuly to the:east and-south.
STAFF RECOMMENDATIONS: Staff recommends approval due to compliance with the
Land Use Plan .and the compatibility of the R-5 with existing A-P to the east. The Planning and
Zoning Commission_voted unanimously to recommend approval:.
FINANCIAL SUMMARY: A Fiscal Impact Analysis will be available at the Council meeting.
CITY ATTORNEY RECOMMENDATIONS: No concerns expressed.
COUNCIL ACTION DESIRED: Approval or denial of request

ITEM: Public hearing and consideration of the-rezoning of 17.33 acres near the southeast corner

ITEM SUMMARY:. The applicant intends to prepare this property for apartment use. This tract
along with the C 2 tract to the west and the A-P tract to the east had been rezoned from A-0 to
their present classifications in .1986... Staff had recommended denial of commercial use of the
same tract that is presently under consideration due- to the belief that it was too far from an
intersection and therefore began to encroach into the planned residential areas to the east and
south. The request was also not in compliance with the Land. Use Plan, ..which shows medium
density residential to .act as a buffer between the commercial at the intersection and the .single
family tothe east and south.
This item had been postponed from an earlier Council'meeting at the request of the applicant. He
has now .requested: that the rezoning be placed back onto .the agenda.
