Dear Commission Members:
Ths College Station Independent School District continues to be opposed to rezoning
of the property ocated at the southeast corner of F.M. 2818 and Welsh Avenue to
any type of zoning that is less restrictive than its current C-N Neighborhood
Commercial I believe that both the Commission and the Council are .well aware of our
concerns. As both the Commission and the Council are aware, granting a C-3 zone
would limit the control that our elected representatives on the Council will have over
the use of that property.
We were pleased with the Planning and Zoning Commission's earlier ruling which denied
the request for a C-1 zoning because we felt that it was made in the best interest of
our children.:. Please continue to considerthe students of College Station, and most
especially those 1600 plus students at A&M Consolidated High School, as you make a
decision.

ITEM: Public hearing and `consideration of a rezoning. request :from C-N to C-3 fora 2.0 acre
portion of Lot Al, Southwood Valley 30; (94-107)
ITEM SUMMARY: The applicant would like to locate a-convenience store/service station on
the Lot A1. The proposed store .would not meet C-N requirements because of size restrictions
and the fact thaf'the business will not be strictly oriented to' he neighborhood. On February 24,
1994, the Council heard a rezoning request for the subject property and the adjoining C=3 dots to a
C-1 designation. The request failed by a unanimous .vote. Some. of he major concerns .expressed
by he Council were the magnitude of the request and the fact that C-1 would .open this. corner to
any general commercial use. =Council ar that time also voted to waive the:-180 day waiting period
fore submittal of another rezoning. on the same: piece of property. The applicant has changed the
request to include only the C-N portion of Lot Al and to request C-3 rather than a less restrictive
C-1 designation. The remainder of Lot Al is already zoned C-3.
STAFF RECOMMENDATIONS: The rezoning to commercial from R-1 in 1983 constitutes a
change in condition that could justify this rezoning; Staff therefore has no problem with this
request. Any potential problems arising from additional traffic in .this area could be addressed
through strict application of the Driveway Access Location and Design Ordinance. The applicant
has.. replatted all of Southwood Valley. 30 to include. access points that satisfy ordinance.

The Planning and Zoning Commission voted 3 to 1 to recommend approval of the request. C-3
also. requires P&Z review of each individual use "to ensure that the intent of the Planned
Commercial district is met. The P&Z also indicated that the proposed convenience store wilLmeet
the purpose of the C-3 district.
