Charlie's

The Project Review Committee met today and discussed the relocation of the
access drive at Charlie's. He proposed to move the existing drive on Holleman
Avenue to align with the H.E.B. drive across the street. The Committee asked
that Charlie add the following items to the site plan:
_ a cross section of the pavement; and,
_ show how the existing entrance will be closed.
Staff asked Charlie to submit 4 or 5 copies of the revised site plan for approval.
I reminded Charlie that the remaining landscaping requirements would have to be
completed by 8:00 a.ill., Friday, July 9, 1993 in order to give staff time to inspect
the work and if necessary, cash the bond.
Nanette Manhart met with Charlie and discussed what exactly needed to be
completed prior to the July 9th deadline. (See the previous file note pertaining
to the asphalt removal.)

Dear Mr. Piper:
This letter is a confirmation of the fact that the City must have a letter of credit or bond
covering the above named property before a Certificate of Occupancy can be issued if the
Landscape requirements are not completed. (Asper Section 11 of the Zoning Ordinance).
Section 11.6A of the Zoning Ordinace allows for a 4 month extension for compliance
with the Landscape requirements with the presentation of said letter of credit or bond in
the dollar.amount of 5 times the points required.
On this property.the point requirement is 1973 points. The bond or letter must be in the
am()unt of at l~ast$9865.00. The due date maybe up to 4 months from the issue date or
C'()'. date or any time shorter than that. Within that time period, once requirements
cov~red under the Landscaping Section of the Zoning Ord. are completed, inspected and
detetmined tomeetthepointrequiremel}t as indicated above, meets other ordinance
req1.lirern,ents and matches the submitted and approved landscape plan, the bond or letter
will be released.

SUBJECT: Owner's Responsibility for Maintenance
The question of who is responsible for maintenance of certain
appurtenances has come up recently in connection with the
sprinkler system atCharlte's Ni.ht Club.
Bill Riley indicated that the City has no mechanism for
bolding the properly owner responsible for proper maintenance,
and that the City has always been responsible for inspection
and maintenance of those items.
Upon checking several sources, the BUildin,g' Inspection area
believes .theCity currently has. in place ordinances which hold
the property owner responsible for maintenance of those, as
well as other items.
Section 101.3.5 of the 1991 St andard Build i ng Code is at t ached
for your reference, and addresses maintenanceot naIl devices
or safeguards which are required by the technical codes" as
beingt<he owner's responsibility.
We also. have the "Automatic Sprinkler Systems Handbook" which
is based on the 19~1 edition of NFPA 13, ~tandardfor the
Installatlon of Sprinkler Systems. This handbook helps
explain the requirements found on those standards.
NFPA13: Chapt.er 9, Section 9-1.1 indicates that "a
sprinkler system installed in accordance with this standard
shall be maintained.. .The owner shall be responsible for
maintaining the system......
NFPA 13A: Chapter 1. Section 1-5.1 indicates that "The
responsibility for properly maintaining a sprinkler system is
the obligat/ion of the owners of the property.. .By means of
periodic tests, the equipment is shown to be in good operating
condition ...Suchtests are made...at the owner's
responsibility and risk...".
While I realize we are only looking at specific sections of
ordinances without looking at the whole picture, it would seem
tome in this instance several different codes place the
responsibiUty,not only for installation, but of maintenance
as well, is the obligation of the owner of the property, and
not of the City.
I hope this information is helpful, and if additional
information is neede(J, the books are available for use in the
Build i ng Inspect! on area.

Re: Appeal To Commissioners Decision
I am writing an Appeal to the Commissioners decision on Thursday, January 7, 1993. The
reasons for requesting an Appeal to the Commissioners decision are:
-The church was not given a fair hearing in the matter of granting a permit
to Mr. Charles Piper. College Station Zoning Ordinance stipulates that an
establishment located in a commercial area comply with certain zoning requirements:
distanced at least 250 to 300 feet from a church or school. My point is that
the measurements were not measured straight across from building to building
but from building to corner on a right angle. This is hypocrisy, we are
playing games here. I would like to see a measurement straight across from
building to building.
-As President of Brazos County Community Prevention Coalition which is an
Alcohol and Substance Abuse Program in Bryan and College Station, I think
it is time the City Planners set an example for the youth and young adults
of our great cities that alcohol is merely a legalized drug. However alcohol
is viewed, it is dangerous to our health. The city is waging a war against
drugs but you are painting a false picture by granting permits for establishments
to serve alcohol, especially in the same area where a church is located.
-With all of the advertisements concerning the use and sell of alcohol,
it would appear it would warn the City Council about the product ALCOHOL.
The Commissioners voted strictly for economics, but I appeal to the City
Council to vote down the permit. I do not care if the building is vacant,
there is a thing such as morality. The city should be considering a Youth
Club rather than a night club. People want changes within the community,
positive changes and yet we see substantial amounts of money spent on Wolf Creek.
Which appears that the Night Club is being allowed simply to compliment the Wolf
Creek Enterprise. The community needs an establishment that will benefit its
residents. I recall vividly a morning after the annual BonFire in this community
when the young people have been consuming alcohol. The area is totally
cluttered with litter and alcoholic beverage containers.
As a concerned citizen and Pastor I ask that you not grant a permit to operate the vacant building
in discussion for the purpose of selling and using alcohol, thereby, denying Mr. Piper's request.
