OVERVIEW OF OUR PHILOSOPHY
The Bull & Bear targets a neglected combination of restaurant/sportsclub and a scattering of high
quality gam~ an.d~tertainment ~capes, includitlg .world class pocket billiards. The restaurant portion
will be of high quality, known for its style anqpresentation while still being reasonably priced. The
restaurant will. be..a New York.Deli sty Ie with hot, spicy. appetizers served. We will open at 11: a.m. We
estimate 40% .of our business to occur during the daytime and 60% after working hours.
The nightclub portion willcorneali"eafter 8:00 p.rn.This phase of the operation will be
managed by a uniqu.e professional team schooled in creating atmosphere of socialization and
entertainment.diversity. Our target market will be young professionals and.graduate students, including
couples after the movie, and groups and singles seeking a warm, friendly environment of blending
romance and merrymaking. We will cater to! high character people, creating a reputation for successful
higher income singles to enjoy themselves in. aJl environment where chance, relationships and romance
can and will develop. State of the art audio lv ideo equipment will provide additional enjoyment in the
background.
We want to be the answer to the question, "Where do the good, successful, eligible men and
women go in College Station and Bryan area to enjoy their leisure time?"
We believe our.presencein the centerwillincrease.thepopularity. and round out the appeal.ofthe
entire center. We will develop a cooperative spirit where we promote the business of the other tenants
and vice-versa.. We believe a strong. sense of' community is critical to success.
North Arlington and College Station have been chosen as the markets to launch this venture. We
intend to cultivate the sqccessofthese projects,. clone the concept in other cities and eventually have a
track record and an anchor tenant appeal thatis strong enough totake the company public.
The ambiance will be that of British or Wall Street pub. The colors will be forest green and deep
wood paneling. We have collected and will continue to collect Wall Street artifacts and special sports
memorabilia to subliminally signal an establislnnentthatexudes success. We will cater to all the five
senses of our treasured clientele, .andgo a. step beyond, creating an. overall specialness that makes the
social public want to be a part of "The Bull & Bear Pub"experience.W e intend to play off a Wall Street
image with quote machines available to allow businessmen and women to check the latest price on their

There seems to have been some misunderstanding as to my explanation of the law to
you and Jim Callaway last Thursday, December 16, 1993. The owner's designation of
his property as · a "shopping. center" for the purpose of calculating parking requirements
is not a odnveyanceofan interest in property. At the time of the designation the
property was under one ownership. There Were no crOss parking agreements, implied
or otherwise. Whether theproperty was subsequently subdivided or not does not affect
the shopping center designation for the purpose of calculating the number of total
parkingspaces.,.The. subdivision.. of . the. property. merely;..allowed both. successors in
interestto remove tnedesignation.lnmy opinion the Tymoval of the designation by
either requires. both. properties to come into compli89ce. with current ordinances
pertaining to. the provision of parking s~aces. underth~. C.ity's land use ordinances.
Where the. removal of the design~tion. creates adeficienpy .in parking, it appears that
these successors in interest to have ,two options. One,Rrovid~ the additional parking
spaces or two, remove some of their square footage from the certificate of occupancy.

Dear Ms. Kuenzel:
As you are aware, my wife and I own in fee simple the professional
office building located on Lot 2, Block F, Col'lege Heights
Resubdivision according to plat'recorded in Volume 466, Page 145,
Deed Records of Brazos County, Texas locally known as 511
University Dr. E. This ,1.18 acre site lies immediate'-ly East of the
subj ecttract and' separates it from the tract dev:elope4 as the
Randall"sShoppingCenter. Among other rights and privileges
attendant to our fee ownership, is the right to use the parking
spaces on this. property to the exclusion of all, third parties in
that there are no reciprocal parking easements of public record to
encumber ourv.ested title.
Our principle concerns with the.. request for a. Condi tional Use
Permit at 505 University Dr. are twofold. First is whether the
appJJicantcandemonstrate that sufficient parking spaces exist 'to
accommodate the proposed nightclub use. And secondly" thatsucIl use
wil'l not negatively damage , affect or curtail the professional uses
in our adjacent office building.
I note in your staff report the comment that thesubj ect.tract "had
been used at one time as a restaurant - theinterurban"and that
the applicants request II is generallyon.thesame . level . oifintensi ty
as the previous use. II I disagree with the comment in that a
nightclub, where the serving of food is not the principleb.usiness,
is of a much. higher level of intensity than a. restia~~9.rt which
serves food and beverag,es primarily to persons seated Vii:thin the
building. The staff report ..alsoconcludedthat "parking on site
should be adequate, especially in light of the fact that the
proposed use had differe.ntpeakhours than the rest of the center · II
I must also disagree with such comment in that Scott. & White, Drs.
Jenkin & McSpadden, Charles Burris and other tenants in our office

building have hours of operation that extend normal peak hours to
approximately 10:00 p.m. each evening.
Based on the foregoing, parking and the adequacy thereof becomes a
critical problem. I would appreciate your furnishing to me your
staff calculations on this matte.rthat would support its conclusion
that the parking accommodations are adequate for the proposed
nightclub use. To.the extent.that your calculations may include
the parking areas appurtenant to the. 511 building , please so
indicate. If your calculations were foundationed on an unrecorded,
"approved site plan" I woulda.ppreciate a copy of.sl.lch gpcUrnent.
Lastly, if upon re-examination of this matter it is d~term~ned,t.hat
