Commissioner Gribou.expressed concern that the building and driveway is facing the opposite direction of the proposed. one waytrafficalongthe:Highway 6 frontage road. Architect Tom Aeyington<approachedthe ColIllllission and stated that the proposed scheme makes the building look more . massive and provides an attractive public qd~velopment in an entryway to the City. Chairperson Hawthorne opened the public ~earing.Seeing no one present to speak in favor of or in opposition to the . conditional use permit, he closed the public hearing. The City has the opportunity to close the drive that does . not meet the current . access ordinance. ,) '#if Chairperson Hawthorne stated that he was surprised that the driveway issue was not addressed during negotiations for the property. Since the adjacent property has a second access point, the tenant does not have an easement by use or'prescription. CityPlallner Kee stated that there are alternatives still available such as relocating the drive or the property line. COmmissioners Herring alld Smith agreed to withdraw their original motions to grant the conditional use permit. Commissioner Herring moved to delay action on the conditional use permit request until the~e~ting of the Commissioll on August 5, 1993, to allow staff the opportunity to explore alternatives to the drive~ay ,~nfiguration asshowll on the site plall. COlllmissioner Gribou seconded the motion whkh passed unopposed :(9 -0). Consideration ofa preliminary plat for the PershingParkSubdivisioJi.' This item, was removed' from the agenda prior, to the meeting. Consideration of afina.lplat for 'the' Emerald Forest Phase Nine Subdivision. (93- City Engineer Pullen stated that there isadeveloplllent agreement addressing the timing of~orth Forest Parkway; however, he will have to look over that agreement to see if there is a time frame for the Citr's portion. AGENDA ITEM .NO. 5: 221) Consideration of the final plats for Emerald Forest Phases 2A & 6A. (93-220 & City Engineer Pullen presented the staff report and recommended approval with the Project Revie-w Committee comments. The two'finalplatsare to correct an ~xistingsubdivision of land that wasndt platted ,(it the time it was subdivided. They are located within the existing Emerald Forest Subdivision,PhasesTwo~~d Six. The property was sold to adjacent property owners as additional backyard space and is currently ibein~: used in that mallner. All lots in these two plats are located within the floodplain of Bee Creek. The applican~!ilis requesting that these lots be platted without public utilities oraccess,whkhis not in accordance with the q1& Subdivision Regula tio llS. The develQperhas addressed that issue with a note on the plat which states that the~e lots do not have public utilities, are not buildable and ,have limited access. There will probably not be restrictions on the type of ,'traffic that is:allowed to use the driveway. August 5, 1993 Page 4 J Commissioner Hall' moved to amend the original motion of approval to .include that staff address the issues that were presented by Commissioners Herring, Hawthorne and HalL Commissioner Gribouseconded the amendment which passed unopposed (7-0). The original motion to grant the conditional ,use ,permit as amended passed unopposed (7 - 0). Considerationof'a final plat, for the Devonshire Phase,II Subdivision. (93-225) Commissioner Hall questioned staff as to the time frame of the proposed extension of Victoria Avenue. City Engineer .Pulleninformed the Commission that staff is still in the preliminary stages and that there is some right-of-way that needs to be acquired. City Engilleer Pullen stated that he anticipates that by the early part of next year, Victoria' Avenue. will be under, construction. CityPlannerKee ,presented the ordinance amendment to various sections of the Zoning Ordinance. The change in the definition of a nightclub is in respollse to recent case law where it is not permissible to vary certain regulations based on alcohol sale. Currently the City tequiresconditional use permits for nightclubs and not restaurants. The current definition of nightclub hinges On the sale of alcohol. .. The proposed definition deals with the nature of the operation aside from any alcohol sale .andcollsumption. The change in the definition of restaurant allows the City to make a distinction bet\veen .the two types for parking calculation purposes. Other proposals in theOrdillance amelldment deal with the parking requirements for multi-family housing, requiring use permits for sexually oriented ellterprises (City Code currently regulates sexually oriented enterprises but there is no special permit required), and strengthening lheProjectReviewCommittee's ability to require sidewalks at the time of site plan, visual screening of dumpsters' and certain parking areas and require compliance with the City's adoptedStreetscape Policies and Plan. (93-713) A Project Review · Committee meeting was held Wednesday, June 30, .1993 to discuss the above mentioned site plan for the conditional use permit reqllest. The following comments were made by the various reviewing agents: ELECTRICAL: Coordinate the. relocation of. the existing utility pole located. in the proposed driveway with Electrical Operations Coordinator Tony Michalsky at (409) 764-3690. Submit a letterreq uestingundergroundelectrical service. Provide two 4" conduits from the transformer to the pole for electrical service. Submit electrical load data including service size and transformer location. ENGINEERING: A drainage development .permit is required prior to any site work.
