Such was the case with the Charlie's nightclub.P&Zapproved the request subject to a list of
conditions {see attached list). The assumption is that if the conditions are violated, the CUP is
no longer valid. With a CUP, staff also assumes thatthe P&Z.only . permitted activities that were
presented at the public hearing. For instance, if Charlie's weretoo.perate as a topless dancing
place, he would have to come back to the Commission for another CUP.
The question I pose to you is as follows:
Is boxing an activity that we should view as anactivity.that is customarily ancillary to a
nightclub use such as {he one in operation now , and should the P&Zhave expected this and
similar a.ctivities when it considered the Use Permit? Or has Charlie's basically changed the use
that was presented to. the. P&Z?

The following is a list of the conditions of approval fo~a','c:oI!di~ona1,~,':'permit to
operate a nightclub in the former Mitsub~shi car dealersbipbuilding lqcated at', the
northwest. corner of Texas Avenue and' Holl~man: ' .

The proposed non~confonning site ,must be , brought up to current city
codes including but not linrited.to the following requirements:
landscaping must be installed;
curbing must be installed around the entirety of the parking '.. lot;
parking ,islands must be installed ,at the end ofeachparking~9~;
and interior parking islands installed as required; ......... ..:.....
the entrance drive closest to. ..the...Texas-Avenue ,.& Holleman.:
intersection must be closed; and,
a minimum of 119 parking spaces must be provided on~site and .1aid
out. according to current requirements.
The proposed dumpster location must be screened from all street rights-
of-way. .
Parking lots monitors will be stationed in the nightchlbparking lotduring
the busy nights of,Thursday through"Saturday to, ensure customer. safety,
safe and legal. parking and ,deter ,vandalism and ,littering of, neighboring
properties. Signs will be posted at Othe front of the nightclub informing
patrons that vehicles parked in unauthorized surrounding parking areas
will be towed at the owner's expense.
Neighboring properties . .as well as. the nightclub property will be cleaned
nightly by bar staff. ..
If property.damage is . caused by patrons of the....nightclub, all damages will
be paid by the nightclub. . .
The portion of the building facing Texas Avenue that is primarily hein?
used. for. storage,.. will be improved. so as not to appear .. as . a. "storage area'
or "vacantbuildingtt.
A designated driver program will be implemented at ,the nightclub.
Employees of the nightclub will also be available to drive intoxicated
patrons of the nightclub . home if taxi service. is not available.
The application and ,conditions of approval wereoriginallycoI1sidered by the Planning
and Zoning Commission on Thursday, December 17,1992 in which no official action was
taken because of asplitvoteof3. to 3. The Commission approved the application on
Thursday, January 7, 1993 bya vote of 4 to 3. All conditions listed above and any
additional conditions that., were discussed during these meetings will also apply to the
operation of the nightclub, regardless of ownership.

Texas Avenue and Holleman Drive is a major intersection in
our city. It could be, in the near future, the entrance
into the "Ivoli Pen Creek Corridor. If I 'mnot sure, our plan.-

differenttha.n most drinking establishments , but many or
most bar's are not kn.own for having a reputation that

Loitering by Charlie's Patrons
I called Mason Newton to get informationonenforcing loitering laws and drinking in
private parking lots andto also find out jfPatrol is aware of any problems associated with
Charlie's.
Mason said that the loitering and drinking laws are hardtoenforceandit is hard to get the
County Attorney to accept cases dealing with both unless the businesses involved have
posted IINo l.oiteringllsigns.Eveltthen,the property ownerand/ortheir designee have to
call each incident ill ~~jnother words,9liveGarden, aEB, and Target would have to have
someone < patrolling or watching the area to. report each incident, and .. ev~n then, Mason
said it is hard to. get the citations to Itstick"~nlesstheyareviolating the alcohol
consumptionlaws,wmchhave.apublic drillkingcurfew.of 1:30 a.m.
MajorNewtonsaid he was aware of the prClbletnsstemmingfrom FightNight held at
Charlie's lastweekend. 'Evidently, things g?tout of hand and TABC shut them down
early. However, that is the only incident he k:nOWS of since the club opened
Mason said that he would cneckw'iththeevening an.d midnight shifts to see if they have
experienced any problems. Ifso, hecangettl1e information onwhattypes of calls have
corne in. Additionally, he will ask them tOP<itrol the area over the weekend and the first
