employees, a non-exclusive t'~s~p.nt over. across. and upon all driveways from time to time
constrUCted on the Restaurant Site for the limited pwpoSe3 of ingress and egress to and from the 707
Sites and a non-exclusive park.iIq; easement upon all parking ~ from time to time constJ:'Ucted on
the RestaurantSite.Thc use of suc,'" easements by 707 Center and the present and futureownels of
the 707 Site shall not be exclusive, but shall. be in common with Briniterandits! successors, assigns,

rights over and across. the easements as may from time to time exist.
During construction on the Restawant Site, Brinker shall provide at least one (1) reasonable
all weather access. for passenger vehicles to. Lots 3. and 4 of the 701 SIte from T ex!! Avenue;
provided, however, 707 Center acknowledges tb:tt the location of such access will be relocated from
time to time to accommodate Brinker's construction schedule.
If during demolition or construction on the RestaUI'8J'lt Site, Brinker or 707 Center shall
detmninethat existing utiJities for the .101 Site arc located on the Restaurant Site, but outside utlJity
casements and corridors shown on the rpp1:lt of the Restaurant Site, ilien (0 provided such utility
lines do not interfere with Brinker's building on the Restaurant Site, Brinker shall grant an utility
easement to 707 Center covering the arclCt .whcu~ the ~~ing utilities ore loaded, or (jj) Brinker
shall coordinate with the owners of the 707 Site :so that the owners of the 707 Site may move such
utilities to a platted utility corridor or an AcccssEa$ment.
In the: event any utilities are not otherwise available to the 707 Site, Brinker agrees that 707
Center shall have the right topcnnanenlly utilia the Access EascmeDt$ for in5tallation and
maintenance of utility lines serving the 707 Site. 707 Center shall use reasonable effortS to obtain
utilities from other locations rathet than by use of the Access E8.SCll1ents. Upon completion of sny
iRStalJetion, mnintenancc or repair of any utility IjJ)e.'\hy 707 Center. the AcccssEasements and all
surrounding property shall be restored to a reasonably similarconwtion (including replacement of
any paviItg as ap~vcdt>Y Brinker) as it ~ .im.mcU.iatcly ptlC)f to such instPllatioa. main.tenaJJee
or repair. and cleared of all constl'tlction materials end debris. .707 Center agrees to use reasonable
efforts to in.mll any necessary utilit)'lincs prior to the installation of the pavina on the Restaurant
Site.

(d) 707 Center shall repair and maintain the portions of the Access Easemcnt

(e) If there is a fallure by either party to perform, fultill or observe any covenant
c<muinerl wjtbjnthi~ F.a.~ement which continues bevonrl the Cure Period
(hereinafter defincd),the rton-defaulting party may, at its option, ~ure sUch
failure erbIeach on behalf ufllte defiw1ting party. As u:;ed in tbi6, ~~h,
