I think we're all confused>about this one. Shirley is working with Joe
Cast.illo because he .calledm.eon Friidayand.w.antedtoknow why he halsn't
been scheduled for PRe. He. thought that he would go back to PRe before P&Z.
Shirley's still trying to. get in touch with him. He did say that he
addressed all of the comments on the PRe report -he just told me thlis on
Friday. But as far as I know , it is stlllscheduled for 2/3 P&Z. 'I'he
rea.son it didn't go. to the last P&Zwas that it came in a day or sob.efore
packets were due.

ok - that's cool 1 guess the 4 of us just need to keep the others informed
until this thing goes through. i don't think we should take it to pre again
until it's bee to P&z. i guess we're all agreed on this, but the ordinance
requires that all other prc comments need to be addressed before the thing
can be scheduled. SQ. i do need to check it. soon.

instructions sent to him from both you and me on several occasions regarding
how to file an appeal. I really thought you had seen this - I gave it to
Natalie when it came in and thought it might be on the last P&Z, but: it
wasn't! I have a call from him, so maybe we need to talk about what's going
on before.! try to call him back again. Natalie says he's not a very happy
camper.. She called him bac.k forme last Friday.

What is it that is betn<:l appealed? I do. not have enough information to
determine that. I have.re\Tiewed the site plan dated "revision 1/10/94".
the only item not in complliance with our ordinance is the width of the
driveway. It is demensioned 23'. The minimum required is 24'.
Mr. Castillo seems to be discussing an alte.rnate location but that location
is not shown. I quess he isreferringto.the location next to the Taco
Cabanna drtve which was present.ed in the site plan we reviewed in December.
There seems to be some confussion as to the discussions surrounding the
drive way at that location. A variance would be required to locate a
driveway w-ithin 150 feet of .the existing drive. staff discussions with Mr.
castillo centered around modifying the. existing drive to. serve both
properties, City Slickers and Taco Cabanna,not ellim.lnat~ng the drive.
In order to process the appeal I will need to transmit to the P&Z "all
papers constituting the record upon which the action appe~led from was
taken." I believe that to be.the site pLan reviewed Dec. 22, PRC minutes,
Ordinance>1991 and the appeals requests. l/will preparethose< ~or the P&Z
week.

City Slickers revised site plan
I have had several discussions with BillWetterman regarding the site plan that you submitted
after the first plan was denied by thePRC. I. have put my comments on the revised site plan as
submitted for your appeal to.the Driveway Access Location and Design Ordinance. The
following items should be addressed on the site plan that you plan to submit for PRe review:
- CoordinatedUlnpster type and size requirements through Jim Smith and then
discuss screening through Sabine in the Planning office. There "may be additional
space needs. Concreteblocksdo.not meet Streetscape screening requirements.
- The end islands at the rear of the building may or may not be acceptable. The
Ordinance calls for 360 square feet of landscaping to define two rows of parking.
ThePRChas the discretion to" allow the islands to tie in to additional landscaping.
- Parking spaces numbered 42 through 45 need to be 20 feet in length because
there is no 2 foot overhand provided. The City cannot authorize overhang that
will encroach onto adjoining property.
- If any parking spaces on.the Taco Cabana site are to be used to count towards
the City Slicker's parking requirement,. there must beaparking and access
easement dedicated. There are several alternative available to accomplish this
dedication.
.. Ifnone of the Taco Cabana site is to be officially used to meet ordinance
requirements, and the intent is not to encumber either site, please remove any
reference to that site.
-Be prepared to address Fire Department access to the site.
- For"the purposes of parking requirements, the square footage can be
recalculated to adjust" for the outside" waiting area. If this area ever becomes a
service area, additionalparkingwill"have.to be provided.

Gentlemen:
The City of College Station Engineering stafi'has recentlyinfonned your contractor on the above referenced
site that the parking 10tisnotcoIlStrocted in .accordance with the approved.plans. The parking lot grades
shown on the grading and drainage plan were establish~d by your engineer to comply with the City of
College Station's Drainage Ordinance. The southedyportion of the parking lot was. specifically designed to
detain storm waterbefore it enters the downstream. system. As .coIlStructed, it .does not serve this purpose
and, worse yet,>mrects the flow from the parking lot away from the original designated outlet.
At this point we have . left word with your contractor that.this.. problem needs to be resolved before a
certificate of occupancy pan be issued, and with thisJetter, we notify you of the same information. The
options you have. are:
1. Have your engineer determine if the existing pavement grades can perform the function that the
original design intended, and ifso, prepare and submit a revised site plan and report accordingly.

2. Effect minor modifications to the parking area to meet the City ordinance.
3. Replace the rear parking lot area to the grades on the approved plans.
It is unfortunate that we need to inform.you at this time of the improper concrete parking lot grades placed
by your contractor and the problems. this will create in the timing of your certificate of occupancy process,
but it is an issue that should be addressed as soon as possible.
Our planning statIhas also identified several area ofnon..compliance which will also hold up the issuance of
the certificate of occupancy. Those areas are the lack of a screening fence around the dumpster area, the
fact that the entire parking lot is full of debris and dirt. and the landscaping. is not complete. The last item is
one that can be addressed by means of a financial guarantee, but the other items require compliance prior to
issuance ofacertificateof occupancy.

Dear Mr. Fisher,
In response to your faxed letter received today, I am providing the following comments.
First of all, Mr. Janak and I did reach a conceptual agreement as toe:xtending the swale and using rock to
buffer the flows rather than grass, . in an effort to allow your client the. most efficient means of handling this
situation~ However, yo.ur submittal does · not include the detention calculations necessary to determine if the
resulting detention meets. our drainage ordinance.
As explained to Mr~ Janak by phone last week, we will need to see the revised detention routing calculations
to show that the developed peak flows are . equal or less than the.flows.from the undeveloped site, for all 5
design storms. This is the same process that. was performed for the original approval. The mention of a
concept to meet the ordinance does .not. meet the requirements to show the compliance through engineering
calculations.
I also reminded Mr. Janak this moming that there are three solutions to obtain the Certificate of Occupancy.
The first is through a Temporary CO. agreement whereby non safety related issues may be financially
guaranteed for a short time fram.e rather than completed. As explained to Mr. Janak last week, this requires
the drafting ofa legal agreement which is currently taking about aweek.toput into place.
The second option is to reconstruct the parking area to meet the grades on the approved plans; where the
detention had already been reviewed and approved.
The third option is to gain approval of another means of meeting the detention requirements, and then revise
the site accordingly to meet the revised method.
Until the detention at the . site is bonded in accordance with. our Temporary C.O. Agreement or meets an
approved design in the field, weare unable to issue aC.O.
We are equally open to all three options, and await your direction as to the desired method.

This. letter .is . written as a formal . appeal.. to our meeting wi tJhthe
Planning & Zoning commission on December 22, 1993 with respect to
the referenced project. The commission denied approval of our
development. site plan and landscape plan due to deficiencies that
were supposed to have been directed to us two months ago in a
meeting with Sabine Kuenzel.
During our meeting with. Ms. Kuenzel on the referenced project she
issued us a copy of the Development Ordinance for College station
and additional information on our proj~ct to meet all issues. At
that time we showed her a site planof~the intended development
and we thought that all major issues were discussed and defined.
In our opinion all issues were addressed in our submittal to the
commission. At this point we feel that we should appeal the case
and ask that we placed on the agenda for the next available
Planning & Zoning commissions meeting.

1993. This letter shall give our concerns on the driveway access and problems
that college station shall haV:~ in its future. We have studied the solutions and
problems on the site plan very carefully and have concluded that if the drive off
Live Oak streetiseliminatedyouV\lil1 create serious problem with traffic flow. At
this time La QuintaMotorlnn and 707 Office Complex use the access road which
is owned by the owner of the proposedsteal<house. With all the traffic that is
flowing through that access road by existing business we can conc.ludethat there
will be a bottle necl<effect on traffic flow with added business of City Slickers
Stea l<hollseResta u rant.
Please consider the problem ( traffic flow) that will occur by the suggestion, of
removing the drive off LiveOal< street. We would also consider the drive way to
be made a one way access off Live Oal< if that will help the cause.
Back in October 1993, we had a Meeting with Ms. Kuenzel and Mr. San Angelo at
that time we were given an ordinance book, what we thought was an ordinance
bool<, to follow in which to design the project. Since then I have been in
constant contact with Ms. Kuenzel by phone or by fax. I have sent Ms. Kuenzel
fax onup dates of the site plan and the subject was never brought up of the drive
being a problem. I thinl< the problem should have been tal<en care of at the
beginning when we held the conference meeting bacl< in October 1993. Thats

why we wanted the conference to resolve any problems early in the planning of
this project.
We would appreciate aconclusion on the subject matter of this project and would
