AGENDA ITEM NO. 3:
Building. Official Perry presented. the staff report for..a. variance request to.. allow a Group A Assembly
occupancy in excess of 5,000 square feet to be enlarged without installation of a sprinkler system. He
stated thatthe existing building is a total of 8,000 square feet which was. allowed by a variance that the
owner received when the occupancy was changed from .a. GroupMMercantile to present . occupancy (a
restaurant) in 1989. The. owner (Joe Ferreri) now wants to add 405 square feet without the addition of a
sprinkler system. Mr.. Perry stated the variance was g~anted.in 1989 with the condition of the
installation of a3hour.firewaIlbetween the kitchen and thedin.ingarea.. Mr. . Perry then explained that
there is a local amendment to the code which requires a sprinkler system for any building over 5,000
square feet instead of the 5,000 square feet per floQrallowedby the 1991 code.
Mr. Sears asked where the. 405 square . foot addition would. be and Mr. Perry showed the location and
explained the addition is to the dining room and not the kitchen.
Mr. Gribouexpressed concern with the number and location of exits, explaining that it appears on the
plans that there. is not.adirectroutetoan exit.
Chairman Sears opened the public hearing. Mr. Christian .Galindo,representativeof the owner, Mr.
Ferreri, came forward and. clarified the request, spoke of the location of the fire hydrant, fire exits and
explained that he is only asking for a variance to thelocalCollege>Station Codes (amendment to the
1991 Standard Building Code), rather than to violate the Standard Building Code.
Mr. Wilson asked what the new wall and existing walls were constructed of. Mr. Galindo explained by
pointtb building plans. Mr. Ferreri came forward. to help with the explanation of what is being
proposed. . (Conversation covered comments made while point to a set of building. plans, and were not
distinguishable to the. audience who could not seethe plans. )
Mr. Gribou stated that because the building does nothavesprinklers, itisvery importanrtohaveproper
exits for emergency egress. He said only one legal exit out of the second floor is a real problem in a
restaurant, and although he realized that was done before, it makes additional exits more critical now.
Mr. Galindo then explained special circumstances which exist on the site which make a sprinkler system
prohibitive,.. and cause that request for a varian.cein 1989.
No one else spoke.. The public hearing was closed.
Mr. Wilson askedMr. Holster and Mr. Gri?oU if the new proposed fire exit would be adequate with the
existingfire exits, or wouldtherebea be~ter~ay to do it ora better place to put it.. Mr. Gribousaid the
proposal would representtheabsoluteminil1Ium of what would be required and he still has a concern
about having a public assembly place witht~e only pair of exit doors swinging in. He added he would
like to be able to look at the otherdiningr~om because not having a sprinkler system would be only
problematic ifthere are publicassemblyroonlswithout legal exits.
Mr. Wilson pointed out the other dining mOrn without exist is in an existing phase and should have been
caught in .1989. Mr. Gribou agreed. .Mr~\yi~sonthensaid that once a variance js issued it is there and it
would. seem. that they are addressing that~i~~ this addition by having 2 accessdoprsyery near the new
space. Mr. Gribou said it would be hischpi~ethaHhere are no publicspaces witho~t~r,accessibleexit,

He conc1udedby stating. that ifthebuilclirW; is not going to be sprinklered, he WQuJd like no spaces
without readily accessible.. exits, that is, legal fire exits.
After conferring with City AttorneyNerny.ik, it was determined that stipulations qmbe placed as
conditions to be met if this variance is granted.
The Board then as a body reviewed. the building plans with the applicant and the engineer to make a
determination as to the number and location pfany new exits to be required.
Discussion followed as to whether the previous variance allowed the restaurant upstairs. No positive
determination was made.
Tom. Wilson made amotion to grant the variance with the stipulation that the pmposednew exit door
next to the proposed addition .. mustbe included to the side of the waiterstation, and that the door in the
existing private dining. space eitherbe turned around to swing. in the. opposite. direction. they swing in
now,. or another door is added to the outside which would give the optimum number of doors without a
sprinkler. system.
Julius Gribou seconded the motion which carried by a vote of 5-1. (Jim Hol~ter voted against the
motion.)

Building Official Perry presented the staff report for Fire Marshal Bland Ellen concerning the variance
request to the following Ordinance: No building of any type of construction for occupancy shall be
constructed in such a manner that any part of the structure is more than one hundred fifty feet (150')
form a public street or highway, provided; however,

The Project Review Committee met on Wednesday, February 17, 1993 to discuss the above
mentioned parking lot plan. Thefollowing.....comments were made by the various .reviewing

Note that.the existing sanitary .sewer.line is private.
Verify the location of the .public waterline. Coordinate location with Engineering

Mark through any details shown> on the site . plan that. are ..not proposed.
