With re and to your memo on the Woodson Village. Subdivision .Plat, I .did not intend to

offend. you when l .asked you to put your request..in writing. In retrospect, L should have
! realized that you took my requestpersonally when you stated that L was ..not providing

You have probably been informed by Tom Brymer that the Executives met and made
changes to :.how they are doing business. This meeting was spurred by a need for us to
find ways to accommodate each other's need . As as resu t of this meeting, one. of the
decisions made. was that the Legal Department would no longer be taking walk in traffic.

months I have. answered this eery question on two separate occasions, once for Elrey
and once for Jim.
To be specific, the current ,developer had stepped into the shoes of the previous
developer. As uch he now has the same ..rights and responsibilities of the previous
developer with regard tO these subdivisions.:The approved plats subdividing the .parent
- tract required the construction of thatroad to Holleman Drive... The Planning and Zoning
Commission does not have to approve a plat that does not provide for the construction
~~ of the road. Additionally, you can require a construction guarantee for the construction
of the entire road., I would point out that it was my recollection that Elrey did not intend
~ to require more than a driveway to the lot. in the adjoining subdivision. I would
recommend that you visit with him in this regard.

ITEM: Consideration of a Preliminary Plat of Pershing Park, a 6.25 acre,: 17 lot single family
subdivision located southeast. of Hawthorn and Thomas Streets.
.ITEM SUMMARY; Two final plats were .approved for this property in the mid 1980's. Neither plat
.was filed for. record and the property has remained vacant. The previous plats provided for access from
Thomas tc~ Holleman via this property and an adjacent subdivision. This preliminary plea. eliminates that
connection and provides a cul-de-sac. There_s existing right-of-way in the adjacent subdivision where
the. connection was to occur. The street was not' built at the time of the adjacent -subdivision
development, but was to be fiuilt with ths.phase. with this-plat and the: lack of connection there is a lot
in the adjacent subdivision that will be without access. Access should be provided. with the .finale plat of
:.this. property either by guarantee car by construction. At a minimum a drive from Holleman to the lot in
question wild be sufficient.

.Impact studies show adequate water availability and adequate sewer capacity for these 171ots. Final
design information concerning the floodway ~.nd detention area will be provided with the final p at but
preliminary analysis shows the propdsed detention area will be sufficient. The impact studies state that
some of the residential structures will consist of pier and beam foundation. A note should be placed on
the plat to inform lot buyers and the City's permit office of`this,

Several ;concerns were expressed at the P&Z meeting znd prior regarding sanitary sewer problems in the
area.. These lets will tie into 112 inch line that was repaired two years ago and has more than adequate
r
capacity for this development according to the impact...studies. Another line in the area was found to be

in need of repair this summer and will be addressed as part of the City's normal maintenance program.

The entrance to ahe subdvs-ion is a boulevard with entrance and exits. on either side of the boulevard.
For emergency vehicle access both sides need to be ` a minimum 2O foot pavement section. The plat
shows only a fifteen foot section for the exit drive.
STAFF REC~MMENI)ATIONS: Recommends a royal with resubmission conference comments

2. Provide access to lot 9 in he adjacent .subdivision
