RE: Illegalsubdivisi()ns in Emerald Forest

As per my previous convers at iohs with you on this subject, it is
clear that a subdivision has. beeIl created in Eme:t"ald Forest.
According to Chapter 9, section 3 of the Code of Ordinances of
the City of. College station, a Subdivision is defined as:
"the division.ofal()t,tractl....or.parcel.of ..land into
two (2) o:t"more.parts,Tots,orsites, for the purpose,
whether . imnlE3diate or>future, of sale,. division o.f
ownership or building development. This also includes
the resubdivision.olf land or lots which are a part.of a
previouslyrecordep.subdiv.i.sion. . Divisions of landfor
agricultural. purposes, where no building construction
is involved, inparcels of five (51 acres or more,
shall not be included within this definition, unless
such sUbdivisionof<fhTe(5) acres or more includes the
planning or.deyeloPlllent of.a.new street or access
easement. An addition isasubdi-visionas defined
herein."
In ace o:r;d ance with these regulations you will ne13d to plat those
pieces that have been sold byme.tesand bounds. descriptions.
These pieces need to be incorporated into the adjacent lots to
which they were sold.
As per Patti's request, I have looked .. into what might be expected
wh.en the land is plattecLas single lots. After speaking with
representatives from FEMA,the National Flood Insurance. Program,
and several banks in the area I found that the decision to force
the homeowner to purchase .. flood insurance lies with the lender ·
The decision.typicallyde.pends on the placement of the struct.ure
and the lender's policy.
I would also like to make you aware of my conversations with
Debbie Keating,of. Urban<DesignGroup, regarding further plat..ting
in the area. You are. requesting review and approvaldfa
s ubdivis ion plat ...covering ..a five .(5 ) acre tract near ... the
intersection. of Emerald parkway and Bent Oak. The City is
willing to .allowyoutoproceedwiththe platting of this

and page of the metes and bounds description filed for record . in a deed of trust.
