Chairperson Hawthorne stated that hy was surprised that the driveway issue was not addressed during negotiations for the property. Since the adjacent property has a second apcess point., the tenant does not have an easement byuseorprescription~ City Planner Kee stated that there are alternatives still available such as. relocating the drive or . the property line. Commissioners Herring and Smith agreed to withdraw their original motions.to grantthe conditional use permit. The final plat is being submitted as the second phase of a four phase master preliminary plat of Emerald Forest Phases 8 - 11, which was approved by the City Council in early 1990. The finatplatconforms to that approved preliminary plat. AGENDA ITEM NO.8: Public hearing to consider a Zoning Ordinance amendment changing the..dedication requirements in the Wolf Pen Creek Zoning District. (93-812) Assistant . Director of Econ()mic .. and Development Services . Callaway presented the ordinance . amendment to. the Commission. ...Herequestedthatthe Commission make comments .and..recommendations. on the proposal. Developers in the Wolf Pen Creek Corridor currently have the option of dedicating areas planned for creek improvements. (lakes, walkways, bank ..improvements, ...etc.). or...developing ....the.improvements. The proposed amendment removes the option of dedication or development and requires.. both the dedication and improvement of.propertyreflectedonthemaster plan .for the corridor. Commissioner Gribou stated that consistency ..... is important in developing the Corridor. Consistency in development and maintenance of the creek improvements is an integral part of the overall plan for the Corridor. City Planner Callaway stated that. staffcould....addinformation..that. would address .standards to further clarify exactly what is expected in the way of creek improvements. The key to continuity and quality of the development will rest primarily with the Wolf Pen Creek Design Review . Board and the Parks Board. Chairperson Hawthorne expressed concern with the. piecemeal development of the corridor. Continuity will. be difficult to obtain considering the spot development that will occur. City Planner Callawaysta.ted that the same lype of piecemeal development occurs ..with. other. public improvements such as. streets. . The City may have to complete theportionofa street if there is a public necessity; however, the developer isresponsib Ie for. the portion of the street. on their . property.
