Dear David,
Please receive this letter as.a written request for a variance to the. Subdivision Regulations, Section 8M,
Sidewalks. Pursuant to the regulations, exceptions to . or partial waiver of the requirements may. be
granted by the City ..Councilwhen adherence to said requirement . would be. unreasonable and not
consistent with the purposes. and goals of the regulations or the comprehensive development plan.
We are asking for. a partial waiver of the sidewalk requirements,.. i.e. for the street called Crystal Oaks
which is 300' long. Sidewalk does not exist on WildewoodCircle. If Sidewalk on Crystal Oaks is
constructed,. it will not .connect to..sidewalk onWildewood. This. is not. consistent. with the goal of
providing continuous sidewalk throughout the City.
There is side.walk proposed for Spring Creek which will connect up with existing sidewalk along Spring
Creek in Phase 8, and with proposed sidewalk along North Forest Parkway when it is constructed.
Should this variance request be incomplete, please contact meat your earliest convenience.

Dear David,
Attached please find . the - revised Emerald Forest Phase 9 Plat. The revisions reflect questions raised
shortly before the Planning & Zoning Commission meeting. The changes include:
1) The 20'utility easement on the rear of Block 14 has been correctly labeled as 20'.
2) You asked about the 10' utility easement on the rear of Block 13, and if the 10' was for bothsides.of
the.propertyline.Attached..isthe legal description of the 0.19..acre easement. It does not. cover the
easement on the existing. Phase 8. The 0.19 acre easement covers only the 10' on the Phase 9 side. The
plat reflects this..
3) . Since the Planning & ZoningCemmissionmeeting, the electrical. department has supplied us with
their layout, therefore we have also added 5'. utility easements to cover the street light circuits. In addition
we have deleted the. general. note stating additional utility easements will.be required for street light
circuits where necessary.
The attached copy of the plat. has .the changes highlighted. This copy is yours to keep. I have ~~ven
Natalie the appropriate copies for the agenda packets.

On June 18, t993 , Allen Swoboda, Debbie Keating, J.im Callaway, Cathy Locke, and
myself met to discuss.Allen's.iIIegal subdivisions in .Emerald Forest. Allen volunteered
that he sold three (3) parcels by metes and bounds to:
1) Britt Rice, owner of Lots 3 and 4, Block 1, Emerald Forest,
Phase Two;
2)
Scott Kelner (spelling?). owner of Lot 3, Block 4, Emerald
Forest, Phase Six; and;
some individual. whose name Allen could .not. recall that owns
Lot 5, Block 4, Emerald Forest, Phase Six.

It was agreed that:

within 120 days from ..Wednesday,. .June 23,..1993, Allen
would prepare and file for approval a boundary plat of all
three (3) ..... metes and . bounds.. parcels utilizing prior
established. boundaries;
the new plat need not be basedupon a new. on-ground
survey;

SUBJECT: FINALPLAT-ElneraldForest Phase 9; approximately 9.40 acres divided into
21 single family lots generally located east of State Highway 6, north of Emerald
Parkway and adjacent to the proposed North Forest Parkway. (93-219)
A Presubmission. Conference was held Wednesday, June 23, 1993 to discuss the above
mentioned final plat. The Project Review Committee. made the following comments:
ENGINEERING:
Add a note stating that there will be no driveway access to North Forest Parkway and
driveways will access.the lesser street.
In the construction documents, address the... barricading of North Forest Parkway at
Spring Creek and the removal of the barricade once North Forest Parkway is built.
Staff is recommending that the filing of this final plat not occur until the portions of
tracts. that. were. .801d 'by. metes and bounds to be included in Phases 2 .and 6 are
addressed. in a plat and filed for record.
