CHANGE OF CONDITIONS
With the rezoning of the. C-Ntract adjacent to the Varsity Apartments,
the construction of. the church under. a Conditional Use Permit, and the
cOI).structiohOf theJazzercise, non-residential developmenthas slowly
pushed itself further south. along Wellborn than the. Plan would have
allowed. This requestis for the next lot south of the Jazzercise.
SURROUNDING LAND USES
The uses listed in the A- P district would not be in conflict with the
Jazzercise (also zoned A-P) to the north. There are possible conflJlcts
however With the single fantlly residential uses to the east along Grove.
. The develoPl11ent policies state. that in cases where it . is unClvqidClble to
locate . commercial development adjacent to residential, the J:wo uses
should back up toone another. In this ease, however, bothtbesubject
building and the residence on the . adjoining propertywillfa.ceGrove
Street and share a common side lot line.
The development policies also state that office uses could serve as buffer
zones between. residential and higher intensity commercial districts.
This policy implies that office and service uses are not necessarily
inc'ompatible with..residential uses.
NEED
There is a vacantC-N tract. between the church and the Varsity on
Wellborn Road. The proposed use fora hair salon would be consistent
With the Cl-lrre'htzoningontha t property.
IMPACTS
The area has experienced some deterioration due to the large percentage
of rental occupancy. The Wellborn Road Corridor Study recommended
against piecemeal rezoning of property to c()rnmercialalong Wellborn and
recommended instead.. that the City. invest Community Development
money and increas~code enforcement to upgrade the area. . The result
has been an upgrade of the area but is more apparent on the interior of
the neighborhood.
If this property,is rezoned, nonconforming use status will be.lost and the
applicant must bring the property up to current code. Parking lot and
landscaping standards must be met before the property can be converted
to anythingotherthafi single family residential use.
The fact that. this site is located on the periphery of the.. neighborhood
should lessen any negative impacts. Uses listed. in the A- P district
cOl1lbinedwith the relatively small size of this lot should result in little
detrimental impact to the neighborhood.

RECOMMENDATION
While the proposed use as well as most of the other A- P uses are not
iI1compatiblewiththe residential uses to the east, staff cannot support
the request for the following reasons:
1. ..The piecemeal approach to redevelopment of an area is
incol1sistent...with sound planning principles which. call for
consolidation of property for a.more. comprehensive
approach. Changes to land uses should come about in an
effort to meet all goals and obJectives of a well studied plan
for. the area.
2.. ... . Although . the area contains much ..rentalhousing,. it
retains its residential character and is entitled to as much
protection through zoning as owner-occupied housing. 'fhe
City should make an effort . to retain as much affordable
housing near the core of the City as possible. .
