Re: Rezoning of Property on Miller's Lane
DearMs. Kee,
Enclosed you will find rezoning application's for 9 tracts of land located south of Miller's Lane,
between Texas Avenue and State Hwy6 Bypass. Doucet & Associates, Inc., on behalf of the
existing property owners is requesting a reclassification. of the zoning from R-l to. C-l. for general
retail sales. We believe this request is justified because the property is adjacent to the FM 2818
extension (Miller's Lane) and has access to Texas AvenueandHwy 6 Bypass. Miller's ~Lane is
designated as a major arterial which is. typically the most . desirable place for retail commercial
uses.
The area in question is physically contained between the roadways and the creek to the: south.
With the exception. of a few tracts that would be left designated medium density residential and
office commercial the. rezoning will consolidate the geographical area into retail commercial use.
The roadways and the creek will provide.adequate buffers from more restricted land.uses.
The draft copy of the 2818 Extension report states on page 37 paragraph 1 that "Because of the
accessibility of the area east. of the Dartmouth Street extension and south of FM 2818 with its
location on a major arterial and a proposed minor arterial, it is appropriate for commercial types
of land uses, particularly office-commercial."
Although the City Council approved the area for Office Commercial uses on August 13, 1992, we
believe this area, because of its transportation features will be a high traffic area and is appropriate
for retail uses. This is especially true when the proposed retail use can be confined geogra]phically
as is the case in this request.

Planning and zoningisliketbeenvironment~-it requih~saproper balance. Hyou upset that balance,
the result is. not sometbingyou like to live with.
In my opinion, by rezoning 38 acres of land from residential to commercial you are upsetting the
balance. Theprobable..esUlf~llbe21argeblocks of vacant space in addition to the vacant Wal~
Mart Store and a number of local merchants will a1sobecasuaities of <the rezoning. And the
commercial sector was just getting on its feet after the oil disaster of the mid eighties.
The reason I invested in College Station was because it was a zoned community which I thougll1t was
committed to orderly growth. Let's hope thecouncilsees fit to keep it that way.

Concerning the rezoning of FM 2818 and Bypass 6 , I wouldlilr:e to
express <my opposition for the following reasons.
This contradicts the year of work done by our planning and z()ning
committee.' Also, rezoning this commercial would cause a dc)mino
effect which would surround Central Park withcommel:-cial
property. It woulddecr.eaSe the value of the . homes locatE~don
Mile Drive and cause the rerouting of the proposed Dartmouth
extension.
This would also cause another building to be vacated creatin~1 yet
a,nother eyesor.eforCollegeStation residents and visitor~) and
also destroy the integrity of the citizens and the pl.annin~1 and
zoning commissions 1 wishes.
When my husband and I moved here in September 1992 , there wel~e no
houses or apartments available in College Station. We found only
one house available in Bryan/ so that was our only choice.
Therefore I I believe College Station does not need anc)ther
commercial area when there are needs for more residential areas.
We hope to be future homeowners of College Station soon.

Dear . Mayor. . Ringer:
I am writing you and each of the Councilmen regarding the issue of a proposed
Wal-Mart . Superstore in COllege Station. I feel such a move is not in the better
interests of College Station. My reasons areas follows:
1. We just.recently had three new major grocery stores/including Sam's established
inCoUege Station. In addition two new major grocery stores .were added at the
same time in Bryan~ We are currently overbuilt on grocery stores and need no new
additions.
2. The current College Station Wal-Mart is a large modem store. I assumeWal-Mart
would vacate it in favor of the new site. To do so would not be in the bestinterests
of the community.
3. Currently there aretht.ee Wal-Mart stores (two regular Wal-Martsand one Sam's)
in the Bryan/Colleg.eStation area. These stores are in relative dose proximity to
. each other. There is no reason, in terms of community need, for a Superstore.
4. The nearby town of Hearne recently had aWal-Mart c10sedand the town was left
without adequate retail stores. During the timeWal-Mart was in Hearne, many of
the former local merchants were forced out of. business because. they simply could
not compete. The current plans suggest some of the same could happen here.
5. For Wal-Mart to build a Superstore in College Station, or Bryan, leaves the
impression Wal-Mart is trying to grab a disproportionate share of the local retail
market.
Thank you for reviewing my concerns. Yourdedsion asa Council may, of necessity, have
to be made on the basis of other factors. I can accept that. For the good of the community, I
felt it important that I voice my feelings.

would,guess that .allstQr~s would . like .togain a larger share of the locBli
market. In addition,ia,though all of us'!ouldlike to see the existing stores
prosper, I do not view the Council's role as preventing the'establislwent of new
storesc~etingwithexistingstores.. If that was the case, where dowe~draw
the line? Should we have not allowed the new Albertson's store, the Randlall's,
the Target? Whether or not to establish anew store isa business decision to
be made by the company. I vi'ew the Counci11 s role as to ensure it is located in
a proper location, one which is compatible with the landuse'plan andwhic:h does
not have a detrimental impact on the surrounding area or the city.
Wal-Marthasindicated they will vacate the present location if (or when)
they build the new store. I understand they have a long term lease on tble
present location and will attempt to sublease the store. Tn regards to the
other Wal-Martstoresinthearea, my discussion with a Bryan Realtor (nolt
involved in the proposed land acquisition) ,is that businesses suchasWal-Mart
view the two cities as separate markets.
This requ.estbYWal-Mart hasbroughl several questions before the Council.
It is difficult to separate the proposed use, and the potential tax revenue for
the ci tyandtheschooldistrict,butthemajorquestion is, ''What is the
appr<?priateuse of the property locatedalongthe'extensionof2818?H Th.e
answer to this > quest ion will dictate the response tothezoningrequ.est.
Rezoning requ.estsmu.stbeevaluated in terms of "the best and highest
appropriate use of the land." Although it is difficult to do so, the Council
should not consider the request on the basis of a particular applicant or
pro,posed.use(inthis .case,Wal-Mart) but on the basis of all the permitted used
under the proposed zoning.

Dear Council Members:
lam enclosing an article from the New York Times whichYOl1 may not have
seen...which recounts. Wal Marrs procedures in trying to . open outlets in
Ma.ssachusetts.There are obviousparnllels .to their current efforts in College
Station and Bryan
Unlike many other towns they are currently located on our main business
artery. Consenting to their establishing satellite shopping areas on the
periphery-of town will inevitably draw commerce and traffic frem our main
shopping area adversely affecting established businesses. and this is obviously
their intention
College Station has a very healthy commercial economy at present which has
.inrecent years absorbed and supportedagr~t number of ne\v supermarkets
and other s'hops. It \\'ould be unfortunate 'if the Council to decide this issue
only on the basis of the increased tax revenue from the parcel they \\;ish to
rezone.
Other than taxes Wal Ma.rt contributes very little to College Station except the
custom.ers they draw who also patronize our shops and restaurants. Their
main value to College Station at present is as a commercial 'anchor at _ the
southern end of our business district Encouraging. them to locate along the
East Bypass will give new meaning to that name since many of their customers
at that location will inevitably bypass central College Station altogether.

I oppose the proposed Wal-Mart SuperCenter project in College
, station for.the following reasons:
1. Their chosen site. Either College station has zoning or
itdoesnl't. As-a council you control the zoning. Use
that power or do away with ..zoning.
2 ,. TheSuperCenter itsel.f. The store will bring nothing to
Coll'ege station that is not already available at
competitive-prices. Surely a city the size of College
station can exist comfortablywit;hone Sam's Club/one
Wal-Martandmany large supermarkets.
If a College. stationWal-MartSuperCenter. ;is inevitabler make it
conform to the city rather than the city acquiescing to the g'iant
Wal-MartCorporation. We don/t actually need any more of t.heir
outlets. Apparently, they see additional riches from us.

several clients in the Emerald Forest area in the hope~s of
preventing a ..lawsuitandunnecessary litigation costs ·
:It is the firm belief of my clients that without an objective
impact study and a procedural safeguarding. of the administrative
modification process .of the master plan . for this area, the granting
. of a special exception on behalf of . the self-serving special

since there is already one in College Station. The communities needs can be

Moving Wal-mart from Manor East Mallin Bryan, in.. my opinion, may help
them to.gainmore.customers.than they have since the location is not optimum

r'm writing on behalf of the new site proposal for the
Wal-Mart Superstore. Having read a couple of articles earlier last
year pertaining to the locations Wal-Mart considered to op~rate
on, I am convinced Wal-Mart has no consideration to the surrouncling
businesses. Wal-Marts 1 arrival with its large scale bu~ring
programs is sure to affect the local merchants , especially the
inefficient ones.
The Wal-Mart currently located in College Station is doing
subs.tantial busines's. Why fix somet.hing if it isn't broken?
Since the proposed area to build Wal-Mart on is alr€~ady
flourishing, why not build in an area that needs a revenue
over-haul? ..for example, Downtown. Bryan. Iunderstand
the measures taken to improve retailing in Downtown Bryan would
be costly. However, having a Superstore in the Downtown area
will increase the INDEX OF RETAIL SATURATION, thus' bringing
businesses in the area causing Market Demand Potential.
I hope careful planning will be implemented in this proposal.
We, asa city, cannot risk what: happened to Hearn.e, Texas in :l990
happening to us.

construction of ..a Wal...Mart Superstore .. in College.. Station. I have heard many sides. of. this . complex
situation. I have even witnessed two.citizens physically defend . their point of view!
The major arguments seem. to center on the issue ofzoning;commercialor homestead. Of course, Bryan
needs toexpfUld its commercial tax base, The superstore in Bryan may work out well for the city of
Bryan and their residents. .The superstore in College Station is. another situation all together. If you
ignore all th~ logistics of traffic flow and ecological change, the issue should be one ofconveniencce. Can
College' Station support another major discount operation? Will the proposed site interdict with future
home development?
On one side,. the proposed area currently has several 'commercialdevelopments in place or under
construction. . Thereisa ne.w bank under construction, a large car service and convenience store, a
multi-story building, AMSand less than half a dozen houses (some .of them are vacant and falling
apart). The street improvements have affected a change in the natural runoff of rainfall and cleared a
large portion of indigenous timber and brush growth. Wal-Martcouldalsohelp. move some of the
.vehiqular traffic off an overburdened Texas A venue and push expansion of College Station east instead
'of south. Wal-MartWill also add many new jobs so desperately needed in the community.
The other side carries the.. same encroachment tune sung by home owners since the invention of the
suburbs. It isunderstan.da.ble that a home owner does not want to nvenext to any business. Businesses
and homes do not belong together. Where doyoudraw.the line? I justdo.notsee how Wal-Mart can
possibly. be encroaching on anyone. The proposed site seems to be a natural extension of then.onnal
growth pattern established y.ears ago.
The compromise should be toallowWal-Mart to build theirsuperstore at. the proposed site but not give
away any of College Station's tax benefits loaid them. IfWal-Mart wants to make this large a V1enture,
do not give . away the . people's benefits in . the way .of.. tax credits Or utilities subsidies. MakeWal-Mart
pay the bill/not the homeowners, residents and taxpayers.

Theattachedproposed.scope.of~orkwas faxed tome for myreview.and.comrnent. I spoke.with
Mike Mcinturff by phone and provided him the following comments:
I noted that .hehad three driveways listed - that he and his client should be aware of the
requirements of our driveway . ordinance. He noted that while the. plans were still conceptual
that they had plans for one driveway off of 2818, one off of the new extension of Dartmouth,
and one off of Texas Ave. I said that sounded good.
I. told him that I would provide. signal timing and phasing for Texas/2818 .as soon. as I got it
from Mark Schoenemann.
I told. him that the question signalizing the. Dartmouth/2818 would. surely come. up. It was
decided that this would be addressed in the scope. He asked that if a signal were found to be
warrante~wouldhisclientbe responsible for any part. of. it and do . we have an ordinance 1that
would require them to ..beresponsiblefor any.. part of it. .1 said yes> that they would be
financially responsible for. a. percent of the total cost equal to the percent of the traffic going
through th.8 intersection that was. site traffic. For example, jf 50 percent of the traffic through
the. intersection was. corning .from .or .g.olngto. the site thantheywould.be responsible. for 50
percent of the. cost of the signal. I told him that while this was not in ordinance form we do
have it as a written policy. He said that sounded fine - that was the way Austinls Traffic Siglnal
I mpact Fee worked.
I informed him that the City had ROW for Dartm.outhfrom SW Parkway, through Krenek lrap
and then through the Kapchinsklproperty.ending almost at Bee Creek. He understood where
I was talking about.
I told him that all impact stUdies would have to b~ accepted/~pprovedbythe City prior to their
scheduling a .prelim.platfor P&Z. H.e asked how long it would take for. us to review impact
studies .lsaidthatV1iasneariropossible for roe to ansWer that he should just get them in as
soon as possible and that to-15 "business days would probably be <a ball park figure for lOur
review time.
