AN ORDINANCE ADOPTING THE "IMPACT FEES" CHAPTER 15 OF THE CODE OF
THE CITY OF COLLEGE STATION, TEXAS, 1992i PROVIDING THIS

WHEREAS, by Ordinance No. ,theCityCouncilof the City
of College Station, Texas;, after a series of public
bearings and extensive input from the community,
adopted the 19_comprehensivePlan; and

That the "Impact Fees" Chapter of the Code of the city of
College station, Texas, 1992 , be and the same is hereby adopted_
so that hereafter said Chapter shall be and read as fol.lows:

ARTICLE I
GENERAL PROVISIONS
Section. 1.01
Short Title
This Chapter shall be known and cited as the College station
Impact Fees Chapter.

This Chapter is intended to assure. the provision of adequate

Section 1.04
(1) AdvisorY Conunittee means the city's P1anning and zoning
commission, as duly appointed -by Resolution
(2) Area-relatedfacilitvmeans a capital improvement or
facility expansion which is designat,ed in the Impact Fee
capital Improvements Plan and which is.nota site-related
facility. Area-related facility may include a capital
improvement which is located off-site,' within, or on the
perimeter of the development site.
(3) Assessment means the determination of the amount of the
maximum impact fee per serVice unit which-can be imposed on
new development pursuant to this .Chapter.
(4) Capital im-orovementmeans eitller a roadway facility, a water
facil;ty,orasanitarysewerfacility,w.ith a life
expectancy of three. .( 3) or more years, to be owned and.
operated by or on behalf of the city.

Chapter.
(10) Impactfeecal;)ital improvements plan means either a roadway
improvementsplari, a water improvements plan or a sanitary
sewer improvements plan adopted or revised pursuant to this
Chapter. Impact fee capital improvements. plan may refer to
either the, plan fora .pa.rticuJ..ar.. service area or to the
aggregation of capital improvements or facilities expansions
andtheassociated.costsprogrammedforallserviceareas
for..a........particular.. category ofca.pital improvements or
facilitiesexpansionsq.
(11) Land use assum~tionsmeansthe projections of population and
empI()YJIlentgrowthandassociatedchanges. in land uses,
densities and intensities adopted by the City, as, maybe
amended from time ,to time, upon which the impact f~ecapital
improvements plans are based.
(12) New development means a project involving the construction,
reconstruction, redevelopment, conversion I.. . structural alter-'
ation,relocation, orenlarge1l1entofanystructure, or any
use or extension of land, which has the ef,fect of increasing
the requirements for.capitali.mprovements or facility expan-
sions, '.measuredbythen'i.llnber . of service units . to begener-

ties fees pursuant to this Chapter.
(24) sinqle-family residential lot means a lot platted to
accommodate a single-family dwelling unit, as authorized
under the city's zoning regulations.

is for the primary use or benefit of a new development
and/or which is for the primary purpose of safe and .adequate
pz.-ovisioll.of l:'oadway, water or. sanitary sewer facilities to

impact fees capital improvements plan and for which the
developer or property owner is solely responsible under
subdivision .and ..other. appl.icableregulations.

service,including,butnotlimited to, land or easements,

Chapter, and no building permit shall be issued. unless the
applicant has paid the impact fee imposed by and calculated
hereinunder.

section 1.09
Assessment-of Impact.Fees
A. The approval of any new development shall include as a
condition the assessment of the impact fee applicable to
such development.
B. Assessment of the impact fee for any new development shall
be made as follows:
1. For a development which is submitted for approval
pursuant to the City'S subdivision regulations
following the effective date of this Chapter,

impact fees due for the new development in the following
manner:
1. The amount of each impaqtfeedueshallbedetermined

unit fortheserviqe .areausiIlg, Schedule 2. Then'Umber "
ofserviqe.units shall be determin~d.by using the
conversion table contained in the impact fee capital
improvements ..plan.
2 . The amount of each impact fee due shall be reduced by
an allowable offsets or credits for that category of
capital improvements, ..in . the manner provided in Section
1.12.
3. The total amount of the impact fees. due for the new
develapm~ntshallbecalculatedandattachedtothe

The Capital Improvement Plan for sanitary Sewer service Area "92-01" was
developeClusing the adopted(draft) LanClUseAssumptions for the Service
area. It consistso:f extending agravity<flowsanitary sewer pipe from
Graham Road on the southeasterly corner of theser:vice area northerly to
the low land along the North Fork .of ,LIck Cree.k,. providing service to
both sJdesof the creek; thence westerly'alongthecreek to Shaefer
Road whereltw~11serve about 145 net acres of the. Van Relt property;
thencesoutherl~ to Graham Roadiandfinally westerly along GrahamR()ad
to near Wellborn RO~d serving properties on both sides of. Graham Ro~d.
Design of this project isexpeptedto be completed within two months ·
Bids.will be advertised as soon as all easements are available.
The preliminary estimated pr05ect cost $315,000. includes: construction,
$23s,OOO;engineering and land surveYing,$50,OOOiand land acquisition,
$30,000". Based on the preliminary estimates the maxImum fee that could
be charged in this service area for sanitary sewer is about $70.00 per
LUE.
