Amendment of Section 12 Sign Regulations
As you know,theA&M COllSolidated Football Team has won the State Championship.
In tribute, the Tiger Club would like to place signage on Cityrights-of..way and.in City
Parks. ..The club..is.alsoconsideringpaintingthewater tower.
Allofthese proposals would constitute commercial off..premise signage, which is
specifically prohibited by Section .12 of the Zoning Ordinance. Representatives from the
Planning and Legal staff metwith the Tiger Club to review the options.
We concluded that the request is not unreasonable, and thatthe. City should be able to
accommodate this a nds imilar proposals. To give the City this option, we will need to
amend the sign regulations. The attached draft is one thatwe feel will meet the City's
community interest concerns, as well as preserve the integrity of the ordinance.
The changes include the following:
1. Signs are divic}ed into two main categories: non-commercial and
commerciaL Commercial signs are then further divided into on- and off-
premise signage.
2. Commercial sign regulations will now allow off-premise commercial
signage through an act of Council when the sign meets certain community
interes ts.
3. Non-commercial signagemay be allowed on private property with the
consent of the property owner.
4. Political signs will be categorized as non-commercial signage and will be
processed .as such.
5. Non..comlllercial signage located on City property may be allowed
through an act of Council when the sign meets certain community
interests.

Please find attached a rough draft of some ideas I have for
changing the sigl1()rqinanceo. .rr'he.biggest.problem thatI.encoun-
teredwith.our.current.ordinanceisthatunder recent case law we
are.. not allowed to distinguish ..betweentypes .. of . off-premises non-
commercial speech. Either we . allow it or we don't. . T.his pre-
sents a.problel1lin.ourcurrent o:t'dinance~n that we are allowing
off-premises politi.calsigns. I think that in truth weare not.
These signs are. not allowed in the State right-of-way by state
statute. They have been placed in "cityrigh.t-of-way" but prop-
erty owner permission is obtaine.d. Byway.. of example, I may let
steve Smith put a political sign in my yard, but it. is really a
political sign that I am putting .up . because ... it expresses . my
political views.. The. second point is th.at we practically . allow
other forms of non-commercial on-premises sig.nsdespite the ordi-
nance provision that restricts it to "works of art."
I have changed the ordinance to allow.. on-site commercial and non-
commercial signs. I have also changed the ordinance to prohibit
all forms.ofoff-premisessignsunless the City Councilautho-
rizes a sign on city property to recognize an ntof community-
wide significance. Please note that o'n-site c m ercial signs do
not require a building permit under thisdra
