n~tification list for. the public hearing of the conditional use permit that allowed .the expansion i of the
c~urch.TheCommissiongranted the use of the expansion on October 18, 1990. The site plan was
re-viewedby . theCommissionon.June 4, 1992. Both. items required a public hearing with iproper
notification of all ,property owners within 200' of the site. On January 15,1993, the owner c~f the abutting
Pl1operty,Mrs.FrankieSanders,stated that she had not received notification of the second. raeeting.. Staff
reviewed the Jistof property owners and asserted that she had not beensenta.letter of notification. The
City'sJegal department hasd~termined that the Commission's action is invalid and the site plar must
th~refore come back before the Commission for official validation. . Sixteen surrounding property pwners
were notified of this public hearing with one response in the form of a letter from Mrs. Frankie Sanders.
Assistant to the City Engineer Morgan informed the Commission that Mrs. Sanders and Mr. Eknoyan
attended. th~.October J8,1990meetingatwhich they sent a letter expressing their concerns with the
proposed expansion pertaining to increased drainage and noise in the area.. At that meeting, there was
discussion about a small berm that runs between the church property and Mrs. Sander's property which
th~ church installed several years ago to help address the drainage problem.. on Mrs. Sander's property.
Over. the past sev~ral months, staff. has met with Mrs.. Sanders and representatives of the S1. Thomas
EviscopalChurchto. discuss Mrs. Sander's concerns. Mrs. Sanders receives.drainage from the church and
the alley northeast of her property due to the natural topography of the area. The church, as currently
d~signed, \'Villnotchange their existing drainage and the run-offwiU notincrease. The church has met the
dr~inageordinance by... retaining any increased. run-off due to the additional impervious area, in a
detention pond.

erect a 6'. privacy fence between their property and Mrs" Sander's pr()perty to help minimize the effects of
noise orl the. playground. .. There will be no increase. in noise on the property. . The new. classroom replaces
the existing white house that is currently being used for classrooms.

Commissioner Gribou moved to ratify the original conditional use permit granted to theSt. Thomas
Episcopal Church on June 4,1992. Commissioner Mariott seconded the motion> which passed unopposed
(4 - 1.. -..0); Commissioner.HaIl.abstained.

operate anigb.tcIubin the fonnerCampus Theater located on the southwest comer of University Drive
and Boyett; 217 University Drive. (93-707)
Staff Planner Kuenzel presented the staff report for. a proposed nightclubto be located in the former
Campus Theater.. This applicant has repeived previous approval for a nightclub much like the one
currently proposed which also included the additionaLparking lot across Patricia Street. Twenty-eight
surrounding property. owners. were notified with.. one.response by someone who does not live in College
Station; but, she is concerned that this is a ; quiet area and should not be disturbed.
Commissioner Hall opened the public hearing.
Tom Parker of Group 4 Architects and representative of the applicant,.Don. Ganter, approached the
Commission. and . offered to answer any .questionspert(j.ining..to the proposed request. He stated that the
original building permit issued for construction ihas.sinceexpired and that construction was never started,

Act) .requirements · pertaining to .the.se{)ond floor. ...If.Mr. Ganter. decides that. itjs...not economically
feasible to place an elevator inthe>buildtng to meet the ADA requirements, the second floor may be
eliminated; thus, reducing the total occupancy load.
Doctor Reverend Th()mas. Estesi. of the . ~. & MPresbyterian Church approached the Commission and
stated that heisiconcerned with the parkfing deficiency in the entire Northgate area. If this particular
nightclub requires.192. parking spaces and only provides .52,theremainderoftheN()rthgate area,
including neighboring businesses and churches, will have to provide theadditionalparlcing. Doctor
Reverend Estes stated that another. major ,concern is with .. trash in the area. There . iscurrerltly a problem
with beer cans, broken bottles and trash in thearea.~ ..... With the proposed nightclub, the city is allowing
more of thesanie in the. Northgatearea.
Norma Bankston of 1103 NortliEleventhStreetin Temple informed the Commission that she owns five
apartment buildings in the Northgate area. One of the apartment buildings is locateda<ijacent to the
proposed parking area for thenightc1uh. Ms. Bankston stated that she currently has problems with
patrons ..ofsurrounding . businesses .... parking in..... the .. tenant spaces; with the... proposed . nightclub, this problem
will only get worse. Ms. Bankston > concluded that trash is also 'a major problem in the area and that the
safety. andcQp1fort.ofthe .residents...is.her main concern.
Larry French of Bay town, Tex~sinfortned the Commission that he is the owner of 306 First Street. He
stated that his main concernswithJheproposed nightclub are parking and noise.
Grace French also ... of Bay town, Tex;as and owner of .~06First Str~~t,approached the. Commission as a
memberoftheAggieNIomsClubandaTetired teacher. She stated that as a mother alld parent, she
would prefer not to haves tudents loitering around a bar.

Commissioner Esmqnd moved to approve the minutes from the meeting of May 7, 1992 as
presented. Commissioner Hawthorne seconded the motion which "passe.d unopposed (5 -0).

Thomas Episcopal Church to expand theIr facilities at 906 George Bush Drive. (5)2-708)
Staff Planner Kuenzel presented the staff report requesting an addition to the existing St.
Thomas Episcopal. Church to include a sanctuary and a. classroom building. .The "future
classroom building" shown on the site plan is not being requested at this time; lout, will be
coming to the Commission in the future. The applicant is proposing to bring the parking lot
up to current City standards. They will be providing 80 parking spaces; 79 spaces are
required by ordinance. Access is provided from. Dexter through Aberdeen and through an
alley; emergency .vehiclescan .access the property through the alley. The revised site plan
meets allPRCrequirementsexcept for the existing and proposed fire hydrant locations: and
the location of the sewer line. The Commission has the discretion to require im]provements
, to Aberdeen . with . the conditional use. permit.. A . drainage detention facility was added since
the last approved site. plan because the previous site. plan did not address. additional runoff
created by. the proposed .improvements. Sixteen property owners were notifieldwith two
inquiries.
Vice Chairperson . Colson . opened the public hearing.
Representative of the . applicant, . David Woodcock of 1511 Wolf Run, approached the
Commissionandexplajnedthat..~the fire hydrant and sewer line .locations should be on the
site plan; if.not, they will be .added. A conceptual plan of this site was approved in October
of 1990.. Mr,Woodcockrequested.that. the church be ....able. to expand. its existing seating
capacity that was established when the church was originally built in 1938. He anticipates
that construction will begin around mid-summer and complete by the summer of 1993.

along Aberdeen.
Mr.\Voodcock stated that traffic will be increased on Sunday mornings due to the increase
in seating.. capacityandparkitlg.area. . The hours. of operation do. not conflict with the
existing Jewisb..Center. .located in the . area. There .are.only. a .few residences that exist
irnmediatelynearthechurch;most of which are rental property. Mr. . Woodcock concluded

Mr. \\l()odcpck. stated that the church has not budgeted for road maintenance or
ilnproveme ntsto Aberdeen Street. The church is currentlymaintaininga:portion of Newton
Alley even though the alley is located outside of their immediate property line.
Assistant to the City EngineerN[organ stated that there is ac1ause. in the development
permit..which states that the contractor is responsible ..for repairing any > property that is
damaged.. during...... cons truction.
Commissioner Mariott,stated thatin this particular case, requiring the contractor to repair
the road does not seem fair because the road is not built to City standards. Pot holes and
ruts will occur with everyday traffic, not just construction traffic.
Ken Harding of 200 Pershing . approached the Commission and stated that he is a member
of the church who lives in the immediate neighborhood and is in favor of the proposed
expansion.
Ben Aurand of 203 Suffolk approached the Commission and stated that he is the director of
the.St.ThomasParishand is in favor .of.the proposed..expansion.

Senior Planner Kee presented the staff report and recommended approval of the proposed
rezoning. The request . complies with the. master . development plan and does. not conflict
'with.anyofthe City's development policies. The thoroughfare plan shows\\'elsh Streett
extending southward as .a.minor.arterialwith.. Victoria .Avenue serving this function, and
being. the western . boundary> of this property. Development of the land will demand
improvementstb the existing gravel streets. If this land remains as an agricultural use the
gravel streets are adequate to meet the needs.of the land use. This portion of Victoria
Road is not included in the preliminary plat and has recently become a part of the City with
the Graham Road annexation.

Ms.Kee . presented the staff report. ..She stated that the applicant has prepared a conceptual
site plan but is only seeking approval of th(;) expansion at this time. Kee presented slides of the
current facilities. She said that.. the. applicant has. agreed to gutter, curb, .and pave the ... gravEtl
parking lot if approved.

. Mr. Esmond asked if P.R.C. will review the site plan after approval of the use.

Sawtelle opened the public hearing.
Don Garrett of 3912 Hilltop in Bryan came forward as the engineer and sUIVeyorforthis proJect.
He said there will. be . nq additional students intha school. He stated that the sanctuary will be
expanded but there will not be immediate expansion of the congregation. He explained that
some exisfingbuildingswillberemoved.Drainagefacilities will decrease the flow of excess
water due to paving the Jot. The proposal willinclude2detentionponds..He pointed out that
parking. spaces will be. added. .As with most. churches, . windows will. be fixed (not able to bE~
opened) so'the noise level will be controlled. The playground will be in the same area as itis
now.
Sawtelle read the letter to the Board. (See Mrs. Sander's and Mr. Eknoyan's letter.)
Mr. Esmond asked if the 2 proposed detention ponds are currently in existence.
Mr..Garrettsaid they were not.. The drainage basins will. be created.
Mr. Colson asked about water retention efforts on the property.
Mr. Garrett answered no. However, he explained the..location.ofa small.berm and associatced
water routes.
Mr. Colson asked. if the current number. of parking . spaces . will be . enhanced.
Mr. Garrett said. that it" would be. -~,
Sawtelle asked ifthere.would be a buffer between the.classrooms.and the homes.
Mr Garrett said that. the buffering consists. mostly of vegetation. He said that the applicant vvill
comply with the City's ordinances and conditions for approval.
w. B. Lancaster of 303 Dexter came forward. He said that he owns the property with the
common boundary. He has probably received most of the water in the past and is not worried
about the new expansion. . ..... Enhancement is welcomed and would improve th.e. area.
Mr. Colson asked how much water comes off of the. parking lot.
Mr. Lancaster said that he receives run-off but believes that development will help the situation.

Mr. Don DeLuiseof20lSuffolk came forward to voice concerns. He said that he was ~.
concerned with the drain.age plan and. the loss of trees and natural vegetation which coUld,
result with the proposed expansion. . He believed . there should .bea <definite buffer ·
Sawtelle.saidthatthey are trying to retain as many trees as possible and showed him the
conceptual..siteplan.
Mr. Gary.Nelson ofllOPershing came forward. ,He voiced concern for the drainage issue and
for preservation of privacy. The deed restrictions for St.. Thomas are in effort to preseIVe
privacy.
Sawtelle said that the buffering and lighting issues will be considered by the.P&Z Commission.
Mr. Colson asked if Nelson would prefer the vegetation 'as buffering instead of a wooden fE~nce.
Mr. Nelson said that the deed restrictions give the option of a brick fence whiqh would, ~ea
sharedexpensewith'adjacentproper1yowners. .
Mr. Esmond asked if the deed restrictions run with the entire subdivision.
Mr. Nelson answered no. He described the..land affected, by said restrictions.
Mr. Colson asked if the church is . knowledgeable of deed restrictions.
Mr. Nelson said that they signed the lease so he would presume so.
Mr. David Woodcock of 1511 Wolf Run came forward. He is Chairman of the Building
Committee for St. Thomas. He explained that the church is attempting to. control drainage. He
said that they do notwanttoincrease.thenumber.afstudents in the school and 3building~l will
be removed. He.said..that the increase inparking.provided is.due to. Council'sconcem fOI'
adequate parking. for public gathering . facilities. .He said that they are conscientious of buffers
and noise control. They are also aware of deed restrictions.
Mr. Colson asked about the location of the berm.
Mr. Woodcock explained. He said that it. has been somewhat effective but their engineer will
finish addressing this situation.
Mrs. Sanders of 200 Suffolk said that water flows through the church property onto the lower
portion of her property.below the berm.
Ms. Sawtelle closed the public hearing.
Mr. Esmond asked if this item still must go to P.R.C. for site plan approval.
Ms..Kee answered.yes.and added that.it..will return to P&Z.as well.
Sawtelle remarked that. Staff must be aware . of lighting concerns (brightness) for. the parkin.g
area.
Mr. Colson said that Silvey property is zonedR-l and churches can exist in R-l as a
Conditional Use. Permit.
Mr. Gentry made a motion to recommend approval. Mr. Colson seconded the motion. Mrll
Esmond . thanked people for. expressing their views. ..Sawtelle conunentedthat everyone seems
willing to cooperate. The vote passed unanimously ina.voteof4-0. Mr. Hall abstained due to
a conflict. of. interest.
