One of the limitations placedon the use was that the operation would be closed at 11:00 p.m. Attached is a memo from Legal. indicating that this kind of limitation is pre-emptedby the Alcoholic Beverage Code. Previous existing businessesat this location have hadalconol permits and been of the restaurant I nightclub category. Previous uses have utilized the outdoor patio area without limits on hours. The Bentley House adjacentig zoned commercially and is considered a commercial land use although there are some permanent residents there. (9Z-703) A Pre development Meeting was held Wednesday, February 5, 1992to discuss the above mentioned conditional user permit request.
