Limitation on Hours of Operation of Bullwinkle's
As you will recall the P&Z approveda~onditionalusepermitforthe operation of a
nightclub calIed BuHwinkle's in the Culpepper Plaza Shopping Center. One of the
limitations placedon the use was that the operation would be closed at 11:00 p.m.
Attached is a memo from Legal. indicating that this kind of limitation is pre-emptedby
the Alcoholic Beverage Code.
Because this condition was not Jegal ",eare bringing the item back to the Commission
rather.than.allowing the appeal. to go before the City CounciL The. Public Hearing has
already been held and it would be atthe.Chairman's discretion to hear from the public
again. . Staff has notified the applicant, the property owner and the owner of the Bentley
House.ApartmentH()telabout this meeting.

The Commission should keep in mind several things when reconsidering whether this
limitation was a decidingfactotin the approval of the Use Permit. Previous existing
businessesat this location have hadalconol permits and been of the restaurant I nightclub
category. Previous uses have utilized the outdoor patio area without limits on hours. The
Bentley House adjacentig zoned commercially and is considered a commercial land use
although there are some permanent residents there.

your request for a Conditional UsePeffilittolocateBullwinkles'.Grill and Bar in
Culpepper Plaza in thenorthemmol)tlease space. Section14D. of the Zoning Ordinance
gives the P&Z discretion to condition the use of the property. in order to mitigate any
negative impacts the use may present. I have attached this section ..for. your informatioJo.
The Commission found that the proposed use may have negative impacts on other lease
spaces due to parking concerns, and on th~abutting~partment!h()teldue to late-night
activity. .To mitigatetl1ese impacts, theCommission-grantedthe Conditional Use Perl10it
on. the following conditions:
1. Provide adequate lighting in the rear parking. area.
2.. Modify the sidedo()r(facingthepatio)tomake it the main entrance and
use the. Ufrontdoor" (facing Quick as a Flash} as . an.. "exit .only".
3. Place.a...directional. sign.at....thec1J~bcutthat leads to. the rear . parking .area.
4. Provide.. a~idewalkfromthe rear parking area adjacent to the. patio.
5. Provide a physical barrier between the rear parking area and the. parking
area. at Bentley/Ho\1se . to prevent9ross-overparking.

'l'he City of. College station's Planning and Zoning commission
cannot limit the hours of the sale of alcoholic beverages. This
is pre-empted by the .' Texas.. Alcoholic. Beverage Code pertaining' to
'hours for the sal~.ofalcohol. Also, we cannot limit the use of
Bullwinkle's outside area 'to a certain time.

CONDITIONAL USE PERMIT- To allow a restaurant and bar to be
located... at 1601 .Texas ..Avenue, the northernmost lease space in the
Culpepper shopping center. (9Z-703)
A Pre development Meeting was held Wednesday, February 5, 1992to discuss the above
mentioned conditional user permit request. The following comments were made by the
various reviewing agents:

Submit a. floor plan showing the interior design, proposed stagea.nd table la)Tout prior
to the Planning and Zoning Commission meeting, to Building Official Coy Perry to
determine the maximum occupancy for the lease space.
Replace the. existing sprinkler head in the closet near the phone booth towards the
rear. of the building.
Suggested building at least on.e ramp to the second level to be wheelchair 2lccessible.
This is not required.
LEGAL:
Expressed concern of the speakers located on the patio and their proximity to the
adjacent residential. property. Advised applicant to.be careful so as not to elicit noise
complaints.

ENGINEERING:
Submit construction. plans for. the proposed sidewalk to be located in the right-of-way
along Dominik. This.. sidewalk must be built to . current ... standards. and should be 6'
wide. .Coordinate:requirementswithAssistant to the City Engineer Morgan at (409)
764-3570.
If a sidewalk is installed, a. Drainage Developl11ent Permit is . required prior tC) any site
grading. '
PLANNING:
The rear parking area should be well lit to encourage parking. Suggested that the
applicant include existing and proposed lighting, if needed, on the site plan forP & Z
consideration. (If additional. . lighting. ..js . required, coordinate requirements with
Electrical Superintendent Ray. Havens at . (409).764-3660.)
Suggested that. the.. side entrance be. the main entrance and that the front entrance. be
an . exit only. The front entrance could be modified to direct people to the side
entrance.
Suggested a directional sign to be placed at the rear curb cut to encourage parking
behind the building. This .. sign would need a building permit and must comply with all
Zoning .Ordinance.requirements for traffic . directional signs.
WATER/WASTE WATER:
Requested that applicarttshow the proposed screen fence at the rear of the b'uilding to
ensure that no utilities are .blocked.
The Project Review Committee had no problems. with. this.. conditional use permit proposal
because previous businesses in this location.havebeen either.equallyintense or more intense
uses.. The Commission should base theirdecision..on.. this information as well as the public
input at the public hearing.
