Conditional use permits .aregranted by the Commission, subject to appropriate
conditions and safeguards, when the Commission finds:
A. That the proposed use meets all the minimum standards established in the
Zoning Ordinance for this type of use;
B. That the proposed use is in harmony with the purpose and intent of the
,zoning ordinance and the plan for physical development of the . district as.
embodied in the comprehensive plan for the development of the City;
c. That the proposed use will not b.edetrimental to the health, welfare, and.
safety of the surrounding neighborhood or its occupants, nor be
substantially or permanently injurious to neighboring property.

TheP.R.C.reviewed this, proJect on February 6, 1992. There was some concern
regarding the occupancy of the building. . Since that time, the Building Official has
determined that 122 persons may occupy the building .. at anyone time. .. The applicant
does not expect more than 50 occupants due to the nature of the use.
This lease space is currently being used as a nightclub that offers live bands and dancing.
Other similar nightclubs haveleas~d this space. These uses has a maximum occupallcy
of 167 people.
Staff has no problemwiththisrequestb.ecause there have been no complaints that the
past nightclubs have increasedconjestion in the area.
