The proposed driveway on Texas Avenue is a shared access drive and located such that it is centered
on the property line between First . American Bank and. the <property owners to the. . north, Stanley
Investments Company . Sometime .atter. Staffapprov!1d the two driveways, . the property owners . to the
north informed the bank that they.. would not entetintpasharedaccessagreement .unless the driveway
would . allow for "left turn.intlAlovements.
Therefore,. the.panknow. requests that.. the. driveway ..onTexas .AvenLJe . allow for. left .. turn ..indmo,!ements.
Staff..denied this request since it is not in accordance With the City's . current Driveway Access Policy and
would create unsafelrafficconditionsand. a potential. traffic safety .hazard. .( ..:'
It should be noted thattheright-in right-out driveway onTexasAvenue,asproposedby TAC Realty,
does by no meansmeetourdriveway POlicy's spacing requirements. It was approved, . however,since
left turn movements in and out of the driveway were 'to be . prohibited.

2.) Potential Conflicts between right-turning vehicles off of Miller's Lane and left turning
vehicles from Texas into. the bank. When complete, Miller's lane at Texas Avenue will
pro"ideJorachannelized rightturn lane. This turn lane is . designed to. have a very large
curb . return radius (117 feet). to allow for. high ...speed .rightturns.for"ehicles coming. from
Miller's Lanf3 on to Texas Avenue. A high speed right turn combined with an insufficient
downstream .comerclearance would create a high potential for accidents at this location.
3.) Conflicts between vehicles on Texas.Avenue desiring to turn left into the bank and
vehicles desiring to turn left onlo Miller's lane. Thev.ehicles trying to turn left into the
bank will wait . (queue) in the left turn . queue storage ..areaintended for vehicles desiring to
turn left from Texas onto . Miller's Lane.
Staff. has. done .considerable..workwith..TAC.Realtyand.Stanley.lnvestments Co. trying to come. to..a
solution.TACRealtyhasobjectedtoa drivewayplClcedatany location other than one that is wholly or
partly contained.. on their. property. Stanley Investments . has objected to any drive that does not allow a
"leftin" turn movement. With these two criteriaestablished~ we have come to a point of no resolution.
Insummation,staffhas vis itedt his site numerous times to measure the driveway distance from the
intersection, observe traffic speed and volumes,and tp check the sightqistance and visibility motorists
would have if such a driveway were in place. It was evident by our field visits that allowing the left turn in
movementwc>uldcreate. an ..unsafe . traffic ...condition,..'a ...potentialtrafficsafe~ ..hazard and unnecessary
traffic delay.
As you know, . representatives of First American Bank plan to appeal staffs' decision . to deny the left-turn
in movement atthis driveway. Please let me know if you need furtherinformation.6r .wouldlike to discuss
this matter further.

GTE:

FIRE:
All parts of all buildings must be within 300 feet of a
fire hydrant as. the hose is lald from. the truck. It
appears that. the distance to afire hydrant is greater
than 300 feet on this plan.

DRAINAGE:

Re:
Spoke to Pat Williams at TxDot regarding the proposed FirstAmerican Bank facility. He
had questions regarding the drainage and needed moreinformation from the applicant.
Told him we needed same . and would forward to him upon receipt.
He also asked that. with. the plans to widen this portion of Texas Avenue, the applicant
coordinate any storm sewer to match with the plans. I told him the City would prefer for
the ditch section to be eliminated and storm sewer . installed .to handle the runoff. He
agreed with the installation of curb, however, he preferred .not having the storm sewer
placed unless be.sized such that the widening project does not have to replace it.
He also mentioned that the smallest size culvert they allow in rights.ofway was 18". I
told him we had same policy and would ask applicant to upgrade the two ISH culverts
underthe proposed drive.

We discussed the sheet flow vs. concentrated flow, and the detention requirements within
floodplains. Earl asked . if there was a. way to. relieve. the . bank of the . detention
requ,irements. He wanted. to approach the bankwith.thepo.ssibility of regaining the area
of the detention pond, to compensate for theoffsite improvements.

1. The storm water culvert . under the entry drive has been revised to meet the

Department of Transportation and he . suggested changes that will be
beneficial to long range Texas. Avenue . widening and improvement. These

ITEM: Appeal to the City Engineer's decision . to deny " left turn in "movements from Texas
Avenue.to. the proposed driveway to the First.AmericanBank to..be located ..atthe Northwest
corner of Texas Avenue and Miller's Lane (F.M. 2818 Extension) intersection.
ITEM SUMMARY: Staff has approved the location and design of two driveways to the
proposed bank. A driveway on MiIler's Lane would allow for full access while another located
on Texas Avenue would be designed such that left turnmovements into and out of th~property
would be prohibited and only right turn movements allowed. The driveway 01) Texa~ Avenue
was to be shared between TAG Realty and Stanley Investments Co., the abutting property
owners. Stanley Investments is not willing to participate in a shared.accessarrangement with
TAG Realty unless "left turn in" movements are allowed. Therefore,TAC Re~Htyrequests that
the previously approved driveway now allow for "left turn in" traffic. Staff has done
considerable work with <both property owners but a solution amenable to all parties could not be
reached.

STAFF RECOMMENDi\TIONS:.. . Staff denied this request sinceitis not in accordance with.
the City's current Drive:wayAccessPolicy, would create unsafe traffic conditions and a potential
