mentioned master preliminary plat. The Project. Review Committee made the following
comments:
G. T. E.:
Existing telephone utilities located along Highway 30, including the telephone
pedestals, should be included in a public utility easement. Coordinate details with
G. T.E.RepresentativeLaverne Akin at (409)821-4723.

ENGINEERING:
Corrections to the Plat:
Show the easement for future sanitary sewer service to lot IP.
Designate the. pressure and product that will be contained in the lines located in
the Gulf. States ,easement.
Show themost.curre.nt FEMA floodplain line, o.n the plat and change the general
note 'reflect the most current information.
Include date on title block.
The name of the subdivision should be changed. The, City Council denied this
name to a final plat for an apartment complex last year.
Increase the text size on the word "lot" 80 that it is easily identified.
Note the. zone line.
Place the distance measurement on the . north line of lot 2.
Clarify the note pertaining to the ,.."commercial . alley" 'and indicate that this
easement will be public. Sam's sewer line along this alley is currently private. If
applicantintends to use this line it must be dedicated as a public line.
Corrections to Impact Studies:
Correct the addition error on page 30f the impact study pertaining to domestic
water service.
Submit. supporting data for pressures and velocities in the water line .to lot 1.
Concerned with the radial feed of .the 8" water line. If a break occurred, fire
protection would be eliminated to the entire. site.
Clarify in the impact stu,dy when the. proposed water line will be built. and if there
will be . an extension to the existing Furrowsdeyelopment.
Show supporting data for the 8" water line to the NCNB tract that supports a 6"
section in the center.
Clarify conclusion .. in sewer impact study by. using supporting material from
development in the Burton Creek Are.aand.RWI information.

Submit additional supporting data to verify conclusion that the study should only
address. thy traffic impacts during the week and not on weekends. Concerned
with the. traffic generated from the existing developments and future development
during weekends.
DRAINAGE:
The drainage calc~lation tables sho\Vi1 On pages 5 and 6 of the impact studies
should be recalculated. to be more specific on . th.e C factors and intensity values.
Show the floodwayon tract 3 adjacent to Carter Creek on the' drainage plaIl.
Show hydro graphs for this tract and other tracts. and compare the pe.aks to
determine detention requirements.
Will need highway. department driveway permit for work on the alley at Highway
30.
Will need easements.from each lot to the creek for drainage.
In reference to page 6 of the drainage. impact study, be more specific .about how
the water will be transported.
Work with the Highway Department .on traffic impacts and driveway access.
WATER/WASTE. WATER:
The water and sanitary sewer lines to serve lot 2, shown along Highway 30, are
located incorrectly. . Coordinate the correct locations with Engineering Assistant
Samantha Smith at (409) 764-3660.
The final plat shouldre.flect the proper easements for lot 1 that would come into
the manhole.
Submit construction documents for the sanitary sewer extension to the property.

After, reviewing, the Staff Report, to the Planning ,and. ?oning
Commission last 'Thursday (Octobe'r1st) and ,conversations with Ms.

city 'staff has ,the- 'following concerns regarding the ".Fu,ture 8 II
waterline" along the propose<:i al'ley as shown, in. Figure 4:,
1.. Is the line 'needed,
2. If so, when~is it needed, and
, 3.. 'Who' is to be the resp,onsible party 'to provide the line?
What is the 'need for an 8" looped' ;waterlinea.~ong' proposed alley?
At the Movies ,12 Tract, the propose~ 8"waterlines wh~ch tie,
to the e'xist,ing 18"alongS .H',;Hwy6 and Sam's 8" are a'dequate
.to provide both the water and fire demands planne~. There 'is
no need for the future 8 "-loop shown in Figure, 4 fpr this,
tract. '
B9th Lot 2 and the,; East Re,served Tract could 'develop without
the need f'or water from. the 18" water,line, since there is' a
12" waterline along Hwy. 30. Water services' to t~neselots
could:be simllarto thetracts'fronting on, S .-H.HWY. 6, a,'
Ipoped service from, and back to, the 12t'waterline. There
wo'uld be no need for the looped SI' waterline.
If a park were, tOdeveiop alorigthe alley of the East Reserved
Tract (behind Sam's for instance) , ~he Sam"swaterlinesco,uld
be extended for service. The loop tieback to the 12" line
would not be needed, based on:present p'lanned' demands.

I am writing to confirm our conversation dated October 12, 1992,
with regard to the attached plat. You inquired whether the City
could put a note on the plat restricting development of Lot 1P
because the owner of Lots 1 and lP only wants to use lP for park-
ingand thu.s, not extend utilities to lP.
We cannot put a note on the plat restricting. development on Lot
iP. After a discussion with Cathy, my recommendations are as
follows:

utilities to the area because it will only be used for
parking and second, if the owner wishes to subdivide at
a later date, then the City has an opportunity to re-

on LotlPandreference the development agreement that
staff is preparing; have a section in the development
agreement thataddresses,the desire of the owner not to
extend u,tilities to the parcel and the conditions on
which we will permit the owner not to extend these

As requested, I have. reviewed the development agreement prepared
by RolandW. Biela of Freedman, Hull, Mathews and Price.. I
understand.. from your . comment. on No. 3b... that ..we .are' notwilljLng to
accept.a dedication of the alley at this time because the
hazardous dJ:"ainag-e condit~onha~notbeen.cor:t'ect~d. I.also
agree that No. 3 c. is contradictory. . ,I fthe acceptance has 1:aken
place, then the compliance is not possible. '
I read your comment with regard. to No. 3c(i)to'be that the alley
as dedicated may not be ,sufficient ,for all of. the improvements
required by ordinance. When I read No. 3f"which addressed the
installation of.the . eight ... inch . water line. by COllege. station, I
also thought that they might need to change their, thinking ()n
this ,matter.
I have a question about the dedication under, No. 3f. will this
easement'that is being dedicated by. Bank ,United to Cinemark be
dedicated to the city ,in turn?' If not, why would we care about
the form?
I am, concerned that No. .3adoes not clearly identifyCinema1"k as
having the burden . to, 'construct and pay for the. deceleration lane.
From the standpoint of nece.ssarydedications ,are you comfortable
with th.eNo.1 requirement that we don 'trequire a final plat on
other tracts of land before the Cinemark tract?
Finally Iwoulda~kthat.the first sentence of No. 5be removed.
I. see no advantage to the City in creating a duty that may have
different meaningsto,each of the parties. I'm not enamored with
thelastsente,nce', in No .5 and you may want to look at it again
to see if you, have any problems.

You know I thought it was strange that I remembered about the note and a lot not being buildable. And
when I pulled the final plat, the lot along the access easement is shown but not . included in the final plat.
That woulcfbegood ifsorneonecould research the. D.A.before the meeting next week. Help me to
remernberand ask about the status of this atour staff meeting on Monday.

agreement; the staff re,port referred to the use of lot 1P and lot 1 as "movie and fast food restaurant".
Also, in the section of the staffteporttitled"ProposedPubUclmprovements", .it states "...extensionaf
sanitary sewer service to lots 1, 1P and lot 2. The' extension of water service to lot 1P...".
Perhaps the planners should look up the development agreement before the meeting . with the restaurant
people next week! I have the file in myaffice andwiU findtheP&Zminutes for it. It's file number
92-309.
