ITEM.: .Discussion of 'a pro~o ed development agreement with
begonia Corporation fox the development of a ubdivision
located west o~ Brandon Heights, Wes Chester Fark,.and
Williams Court subdivisions.
ITEM SUMMARY: The City Council appro~red he Master Plan of
this area on June 11, 1992. At that meeting se~reral pings
were discussed with the owner's representative, Mr.-Steve
Arden, pertaining to the development of this 292.165 acxe
exact. These items are capered in the attached development
agreement. These include the questo on the extension of
!, Rock Prairie Road and how it would be financed, the
extension of Victoria Avenue and it's financing, the
construction of North Graham Road, the abandonment of Arnold
Road, the construction of drainage facilities, dedication of
' parkland and phasing of the final plats on the entire
ro ere All of these items Were'dscussed at...the: meeting

in June and have-been included in this agreement. Nat

which will be :delivered at a later date prior to the council
meeting that will describe in detail the negotiation of this
eery complex agreement. 'the agreement that is attached does
not contain Exhibit "A" Which will be supplied later-by the
developer. This Exhibit is the legal descrip ion o~ the
property and has no bearing on the council's consideration
of these items.eXCept to describe the property in question.
FINANCIAL SUMMARY.: This will be discussed in the separate
coyer memorandum.
STAFF RECOMMENDATIONS: Staff recommends approval of the
agreement.
CITY ATTORNEY RECOMMENDATIONS: Approved as to foam

along the northeast side of the street segment from Arnold Road, to
H~-sselt Street be waived since it ~aill note be connected to sidewalk
on either end.. We re~rues that we be a lowed to continue onl;~ the
existing eidewalk on the southwest side of Nottingham. Please see
