Assistant to the City. Engineer Morgan presented.- the staff repor>~ The applicant is
proposing to replat four existing lots into three larger lots. 'T'his amending plat does not
affect any dedications; it is simply:.. removing three interior lot lines and replacing them with
two interior lot lines. There will be no affect on utilities or easements. Staff recommended
approval of the. final plat... as presented.

Representative of the applicant Larry Wells approached the Commission and stated that the
variance is being requested for two reasons:
(1) Nantucket is an :.established subdivision and 100 ear flood lain

.Information has never. been required: on previous. plats.
(2}Health, safety and welfare concerns are not effected because the lake has
been ;:.:.permitted by the state of Texas with a 500 ear flood level

estabhshed. There are minimum fmrshed floor elevations required through
deed restrictions that are more stringent than other re uirements.

is no data to back up a 100 year flood plain line on his plat. There was never a lake study
done upstream .because .,one was never. required. If a flood study is necessa it should have

been done at the beginning of -the development, not upon completion: In order to establish
the 100 year flood plain line, a -.very costly .:flood study would be re wired. These additional

fees place an undue burden upon the applicant. The developer Is wanting tO develo and

The developer wants to live on the lot and he is talon the risk and burden as far as

financing, etc, Commissioner Hall 'concluded that.: he does support staff on the issue but
would be willing to -work with the developer in this particular case.
