Just talked to a Mario Tour, an architect for "The Gap", who was interested in
finding out what has to be done to make an expansion to the existing HEB
shopping center. He has already talked to Sabine, Lance or Carl, and they
have told him what they need for a 15,000 square foot "Old Navy" store which
would require the addition of apx3000 sg ft to the rear. of this project.
Sabirl:e thinks they have enough parking based on 1/200, but without pulling the
file, etc., I told them that decision would be made when. they turn in a
revised site plan which shows whatiscurreritlythereandwhatthey are
purposing to add. I told them if the~~were notaddingp~rking:spaces they
would not needaPRC, but if they peed to add parking spaces then they will
need a PRC. If anyone wants to talk to him his name is Mario Tour and his

Sheets SD-2 and 8D-4 containing. the grading and drainage
plan and the site paving plan should be turned in
simultaneously prior to 'site plan approval.

The 35' radius on the proposed drive along Holleman should
be widened as to allow for large vehicle traffic.

The history of the drainage review on this project is
lengthy. We approved an original regional detention
tacility for three property owners, Polarbek, HEB, and
Target. Since that time, and during the construction
process, HEBhasrequested
1) the City waive the construction of the regional pond and
allowHEB tobui1.daddit:i1onal pipe under Anderson Street,
2) the city allow a change to the plans to eliminate one of
the access points to the pond reducing the amount of
concrete needed for the walls, <thereby reducing the cost of
the pond.
3) the city consider waiving the construction of the
regional pond prior .toe.o.
4) the. city consider the construction of a smaller or
inte:rimpond without plans to. .go .by, or permission from
property owners.
Prior to thebegining otconstruction, and during the review
process, the city was .aske.d to review several scenarios fOli"
onsite ..drainageimprovments/aswell.as u.tilitylines,. due
toproblemsinacq1;lisitionofpropertyfrom Target. Staff
did review several scenarios to accomodatethe
develope.rlengineer, and keep. the project on schedule.
However, it caused quite a bit of contusion for the
development review team, and eventually the field
inspectors. .

"Yesterday"Tuesday,June11, I spoke with Ricky Palasota and . informed him . that
he was ....responsible.. for. the . damage .' to. Holleman Street..... thatoccured. as .a. result of
the overloaded . dirttrucksfromtheHEB>site. He claimed he was not
responsible,<since .he was not. the general contractor.
However, he is currently barricading the area and proceeding with the repairs at
his expense.
In addition, David Dobbs has instructed the contractor to NOT drive on any city
streets.

Pat called to see what could be done about the fact that
H.E.B.had not ,yet secured from a bank a letter of credit
forthelandscaplng, the water <llne, etc. to date, and 10,

Als 0, he asked what he would have t.o do about the curb and
sIdewalk damages. Pullen was standIng nearby and replIed to
my questIon about the dollar amount of the damage reported
by Dobbs, to which Pullen reiplledthathe hadn't fIgured it
up yet. When I pressed for an amount, he ,gave the figure of
$5,.000...
I relayed that lnfor.mat lon to Pat, and saId that under the
cIrcumstances, ltappearedthattheCltywould have to be
satisfIed with a fax from the bank of record regarding the
letters of credit. When Pat asked If> he could submit one
letter for the.ent ire amount (landscaping, water line and
br oken infrastructure ) and Irep.lled that he could ,buthe
probably wouldnotwantt:obecausebewould most 1 i kel ywant
to be released from that oblIgation on one item before the
other 2 had been completed! He agreed, and said he would be
. havIng the bank fax copies of thelettersofcred i ton
Tuesday morning, wIth overnIght delIvery of the actual
letters to follow on Wednesday (10/16).

He submitted. an easement agreement for .. the construction . of channel.. improvements downstream of the pond on the LULAC
property. The LULAC Board signed the agreement, however, the legal description of the easement was not signed by an RPS. I
told him we would not considetitasavalid agreement unless it wasdsignedby an RPS. He offered to sign as aP.E. I told him
no, that for nowthedescriptionwasnotgoingto be used for platting purposes. However, when the as-built plat is submitted for
approval of the remaining easements, it would be necessary to have an RPS signature. He agreed. I told him for now, the city
was concerned with getting permission from LULAC to have the work done on their property. Since we had LULACs signature
on thepermitapplication and on the easement agreement, the city could approve the plans for construction on their property.
He also submitted the application fora permit to place the excavated pond material onto the Polarhek site. I processed it and
issued.a .permit fotthe Polarhekproperty.
He alsosubmi ttedrevised sheets for the walls of the. pond. The construction. plans previously approved had thicker walls, and
deeper footings. . The revised sheets were distributed to the contractor without City approval. According to Dobbs, the contractor
hadpartiaHy buiItportions of the walls according to the revised plans. When asked about the smaller dimensions, Mr. Hammons
replied that. the reductions were done in order to save money on the project. He assured. that. the smaller dimensions met code,
and he submitted the revised 's heets with his signature and seal.
He also submitted the outlet control details for the permanent detention pond thatwehadbeenrequesting ad nausea.
I approved the. permanent .pondplans with revised sheets for the walls, the interim detention pond plans, and the outlet control
structure details.
I distributed four copies:
1) Dobb's. inspection copy
2) Shirley's copy for attachment to buildi ng plans
3) Engineering copy for t1atfiles
4) Copy for the development permit file
Mr. Hammons is expecting a city inspection of the drainage facilities, Monday, October 14. ThiswiHallow them approximately
24 hours to make any necessary adjustments prior to the request foraC.O. on the 15th.
At this time, iris feasible that the contractor could complete the interim detention pond in time.
Mr. Hammons and I DID NOT discuss any of the OTHER requirements for issuance of a C.O.

requirement before the issuance of the certificate .of occupancy for their
pantry. store in College Station. We . understand that this waiver is
temporary in nature <mdthat thepol1d would be completed in early
November. ... Our ...conc.ern is that the detention would.not be in place when
it is needed (i.e. when the lot ~as impervious cover). The improvements
that have already beeU1l1.<3.de increase therun.off from the lot during any
rainfaUevent. It is iIUpoi"tant that any development.within the City of
College Station detain (lny incre(tse in runoff that they have created, thus
avoiding any damage to upstream or downstream properties created by that
development.
At the outset of this project, City staff was concerned about the drainage
situation..and iearedthat .thedrainage . would become an issue at the.. time
of certificate of occupancy. In order to avoid this problem, a letter was
sent to HEBoutliningthese cOl1cernsand requiring the simultaneous
construction of the detention facility and the .HEBsite. It appears that
despite this early warning, we are at the situation that we feared from the
beginning.
It is our . understanding that you wish to . provide .. some interim facility. To
accomplish this, we must have approved plans for the facility as well as
approved phasing diagrams.W e received these plans in our office today
9/30/91 at 1:00 p.m. Upon an initial cursory review, these plans are
incomplete and not ready for our review. In our opinion, BEB does not
have enough time between now and ()ctober 16th to submit revised plans
for review and approval and construct the interim facility. We MUST have
detention in place that is fully functional for the site that is. built and at this
late date, the only thing we thinkI-IEBcando in order to open is to
construct the detention facility that is already approved for construction.
It..isalso our understanding that you <\vish to . delay the construction.of.the
waterline loop around the TARGET facility. We will allow you' to delay

1.2 Description of Work -This section is a Performance
Specification. Extent of area to be irrigated is indicated
on site plans. Note that plan of irrigation head layout is
part of contract documents. An on site visit by irrigation
contractor will be required. The irrigation contract is a
subcontract under the landscape work.

6.1 General. -Unless otherwise indicated, comply with
requirements of the Uniform Plumbing Code, current edition.
6.2 Connection to Main - Connect to piping and vacuum breaker in
location indicated.
Install new tee, valve, and union.
6.3 Maintain uninterrupted water service to building during
normal working hours. Arrange for temporary water shut-off
with Owner.
6 . 4 BackflowPreventer - Double check valve assembl,y with valve
box. Install 6" layer of gravel in the bottom 'of, the valve
box for drainage.
6.5PVC Pipe
a) Laying of Pipe: Precautions shall be taken to prevent
foreign.material from entering the pipewh.ile it is
being placed in.line.At times, whenpip~ laying is
not in progress, the open end of thepip'elshall be
closed by a watertight plug or other means. approved by
the Architect. Pipe in th.etrenchwhich qannot,
temporarily be jointed shall be packed to 'make as
watertight as possible. This provision .sriall apply
during the noon hour as well as overnight."

e) Solvent Weld Joints shall be made in the following
manner:
1) Thorouahlv clean the mating pipe and fitting with
a clean dry cloth.
2) Aoplya uniform coat of solvent to the outside of
the pipe with an approved applicator.

Re-aooly ..alight coat of solvent. to the pipe and
quickly insert it into the fitting.
Give the pipe or fitting a quarter turn to insure
even distribution of the solvent and make sure the
pipe is inserted in the full depth of the fitting
socket.
6) Hold in position for 15 seconds.
7) Wipe off excess solvent that appears at the outer
shoulder of the fitting.
f) Care shall be taken.soasnot to use an excess amount
of solvent, thereby causing an obstruction to form
on the inside of the pipe.
g) The jointsshall.beallowed to set at least 24 hours
before pressure is applied to the system on PVC
pipe. .
h) Use of Crosses: Crosses will not be permitted in this
installation.
6.6 Backfilling of Trenches -Because of the expansion and
contractionofPVCpipe, backfilling shall be done in the
cool part of the day if possible. Selected fill, acceptable
soil materials, or sand shall be used, if soil condition is
rocky or contains large clods.
6.7 Sprinkler Heads- Flush circuit lineswithful1 head of
water and install heads after hydrostatic test is completed.

the project.
On Tuesday, 9-24 I received a copy of a letter sent to the
attention ot DavId .. Pullenwhlch listed specifIc issues the
Company was asking the City to allow phasing for in order to
open before. total completion. I gave Elrey the original of
the .lette.r to David and then Elrey and Veronica and I
v!lsltedabout t.herequest. Elreyasked that I check on
parking and landscapIng and Veronica was to handle the
detention and fire service loop installation issues.
Jane & Nanette have agreed that if REB putsupa Bond or
Letter of Credit to the City intheaDlount of $63,000 for
landscaping and Installs the parking to meet ordinance
requirements lor the size of the store (proposal Is. for 144
spaces which is adequate to meet that requirement) they have
no problem with Issuing the "Interim C.O." requested.
Veronica reported that the Company's engineer, Roy Hammons
has not submitted<.any proposal or plans for anything to
handle the runol f during the' "i.nt eri m per i od of time", so
she is unable to address that. request.
Veronica also saldshe would check on the flrel1ne

2 hydrants already installed. (On Wednesday, 9-25 she
reported when I asked that she is unable to check those
figures because although the engineer, Roy Hammons was asked

would have to contact him to ask that he supply them again.)

Roy Hammons just called and indicated the "person preparing
the fou.ndation plans" would be calling me this morning. A
Larry Funk with S.C.A., the structural engineering firm
doing the structural plans for project just called and
indicated he had no problem indicating the information under
#1 and #3 on the foundation plans, but that the information
requested In #2 and #4 should be in the $peciflcations. I
indicated that w.e do not have written specifications, and to
the best of my recollection (alld PD.il San Angelo's)',. we did
not.ge.tspecifications,thus, we did nof get that
information. Helndicated he would contact H.E.B. and get
them totorward that information to us so we could release
the; "Slab Only" permit A.S.A ~P.
Larry Funk plans to "overnight" the plans (3 sets) to Coy
today,,-ith arrival to be Thursday, 6-21--91. I have
contacted Roy Hammons to tell him we will need a site plan
to attach to each of those sets. Once all the information
and requirements listed in #1-5 is received along with the
foundation plans, Coy will be able to issue the "Slab Only"
permit.
NOTE: The working drawings of the sprinkler plans came in
after lunch today, and Bland Ellen has indicated those plans
show the Fire Department connection on the building, but the
City has asked the Civil Engineer (Roy Hammons) to place it
in an island on the southern side of the lot. Please have
the sprinkler plans corrected.
