Ricky Miller, owner of ::Sneaker's, is pro osing a parking lot on the proper ad'acent
and east of his business. A portion of t e ht would be paved and meet al co es. The
remainder `is proposed to be gravel. The Zoning Ordinance allows P&Z to consider
overflow parking hts to be gravel on a emporary basis (not to exceed one year with no renewal).....
The Design Review Board recommended approval of the proposal by a 4-1 vote .with
several conditions.:: The P&Z made: a motion to approve and it failed on a 3-3 vote so the proposal was denied. The Commissioners voting to deny thee. ro~osal were
concerned about the impact of a gravel. `lot, even on a temporary.: asis, rn the V~olf Pen
Creek Corridor.

Has operated as a me club since shortly after opening and as such has

parking alone will not solve the parking problem however and Mr. Miller realizes
he needs a lot more parking than ord. requires.

So has to be reviewed by the DRB. and recommendation made to P&Z DRB
reviewed request and recommended approval to P&Z.

DRB expressed concern :about establishing precedent in WO1f Pen Creek .and
unanimously agreed that if this re+quest for temporary lot was for a new project it
would be denied, but in this case was a compromise to solve an existin rob~em. a L

P&Z members in favor expressed that the plan submitted is far ~.bove standards
for: a temp. lot and the applicant pis making- an effort to bring property up to
standard.

another "1VIIJD" lot and damage to he existing trees. on site.

The- De ign Review Board {DRB) met :to review the above .request. Their report
and recommendation is attached. This item is before you for two reasons; (1) it
is a :.project in the Wolf Pen Creek Zoning District. where it is required that .the
DRB make a recommendation to the P&Z and (2) all requests for. temporary
overflow parking lots are to be considered by the Commission..
The DRB recomme d d approval of phasing -the parking :.lot and:. allowing some of the lot to have a temporary surface for -one year. The :following conditions
were included:
Install parking lot lights for the: entire lot,..
Provide a, landscape screen along HW 30,
1 Provide curbing along the frontage of Hw 30,
Barricade around the .group of .trees at the north corner of the property,
Improve or dedicatee the: area (as defined in the Wolf .Pen Creek Master
Plan and Zoning Ordinance) remaining on .Sneaker's property and all- of
the adjacent property being used for parking and
.Provide the owner's assurance that at end of one year if the lot is knot fully
brought up to code, then the lot will be removed and the area resodded.
Asll conditions are to be included as a part of Phase I.

Garrett stated that the applicant intends to create a
permanent parking lot and may be able to install bases 1 and p
2 initially depending on financial obligations. He requested
condi Tonal approval of the parking lot plan subject to the
recommendations outlined by staff.
Design Review Board member David Brochu approached the
Commission to answer any questions or concerns.
Mr. Dresser asked Mr. :Brochu if the buffer along Harvey Road
was too extreme or elaborate. He also :asked' if the cluster of
trees in the North corner -could be preserved permanentl b Y Y relocating the parking lot closer to the creek.
Mr. Brochu stated that the Board would like to see more
treat e screening; however,: the Board's main concern is the
establishment of precedence for other projects in the' Wo f Pert
Creek Corridor . 3'he Board `unanimously agreed that f the
temporary parking lot request was for a new project, it would be .denied; but the Board agreed that in this case, it should
compromise to solve an existing problem. He stated that the
lot would be permanent in nature because screenin and _li ht
g g fixtures would be initially insta led. Pavers are not cost-
effective and would be permanent therefore in conflict with
the temporary nature c►f the lot. ' Mr. Brochu informed he
Commission that he felt the applicant was makin an honest g attempt to comply with City requirement and solve an existin
g traffic safety hazard.
Nir. Garrett stated that much of the parking lot would be in
the reservation line if it was relocated closer to -the creek.

Mr. Brochu explained to the Commis ion that the Design Review
Board requested amore permanent parking lot plan ~:nstead of
the temporary plan initially submitted, adding that the hoard was reluctant to approve a temporary parking lot without
knowing how the permanent lot would be developed. The. Board
wanted to know how the permanentlof would impact the land and
the assurance ghat a permanent parking lot would be installed.
Mr. Garrett informed the Board that if the bank wa willing to
dedicate the land; the applicant will' be determined to finish
the project.

Mr. Esmond moved to approve the temporary parking lot plan at
504 Harvey Road. Mr. Michel seconded the motion.
Mr. Hall expres ed conce,rn of ~creatinq another "Mud Lot's' . 1n one year, the Commission will be in the same situat-ion if the
applicant does :not own the land. By approving a tem orar
P Y parking lot in the Wolf Pen Corridor, a future precedence is ,
being set. The gravel-will permanently damage the post oak
trees. Mr Hall suggested tabling the =item un it the
applicant could gain-more information from the bank concernin g
land dedication and ownership of the lot.
Mr. Dresser stated that the desi n of the lot g would be
acceptable for a ..permanent lot. The size islands curbs r ~
screening, etc are all a~►ove City standards. i
The motion 'failed by a.n even span vote ~3-3 Members
Colson, sak~telle, and Haal voted agains the motion and members Dresser, Michel, and Esmond voted for the motion.

Garrett sated that the applicant intends to create a
permanent parking late and ma.y be able to install phases 1 and
2 initially depending on financial obligations. He requested conditional approval -of the parking lot plan subject to the
recornmendatio~ns outlined by staff.
Design Review Board member David Brochu a roached the pp
Commission to answer any questions or concerns.
Mr. Dresser asked Mr. Brochu if the buffer along Harvey Road wa too extreme or elab►orate. Be also asked if the cluster of
trees in the forth corner could be pre erved permanently. by
relocating the parking lot c oser to the creek...
-Mr. Brochu stated that. the Board would ike to see more
creative screening; however, the Board's main concern is the establishment of precedence for ether projects in the Wolf Pen
Creek Corridor. The Board4~unanimously agreed ..that if the
temporary parking lot reques was for a new project, it would
be denied; but the Board agreed that in this case, it should
compromise to solve an existn roblem He stated that to gp h
lot would be :permanent in nature becau e screening .and light
fixture's would be initially in tailed. Pavers are, not cost- effective and would be permanent.. therefore in conflict with
the temporary nature cif the to Mr. Brochu informed the
Commission that he felt the applicant was makin an honest
g attempt to comply with City requirements and -solve an exlstin g
traf f is safety hazard.
Mr. Garrett stated that much of the parking. Tot would be in .the reservation line f~ it has relocated closer to the creek.
He said that approximately 3~~ of the propert 7 - 10 acres
y f } would hive to be dedicated. He suggested that because the
trees along the ;..:creek would be preserved through dedication
.the cluster of trees in the north corner could be destroyed.
Mr. Hall moved to denythe request for a temporar arkin lot yA g
at X04 Garvey Road. The motion died-due to lack of asecond.
Mr Dresser stated that he approves of a temporary parkin.. lot
g plan. because the first phase will bring the applicant in
compliance with the Zoning ordinance. The lan submitted is p
far above the standards for a temporary parking. 1of. He said
that .the.. applicant is making an honest attempt to bring the property and business up to current standards Mro Dresser
stated that he did not ~ l ike the Chan e of use from a
g restaurant to a night club which had taken lace. He also

the temporary plan initially submitted, adding .that the Board was reluctant to apprc►ve a temporary parking lot without

Mr. Barrett informed the Board that if the bank wa willing to

refer to it, was instigated in June of 1.990. It has indeed become

I do want to mention at this time that Ricky Miller, owner of . Sneakers, had .been notified several times by phone, letter', and

customers from our property, His attitude was and still is brazen

This situation creates several problems for: us. Community z
a earance, safety and evenhanded enforcement of regulations ~ pp
are the most obvious issues. Additionally, these problems I
are occurrin in an area that is a high Council priority. g .
We have.. discussed these problems with Major Ed Feldman and
Fire Inspector George. Spain.. PD and ,the Fire Marshal's
office will review their previous concerns and monitor the
situation for the~next two weeks. Through their efforts we
ho a to et a feeling for the scope of the problem during p g
peak hours as well as verify any understandings reached by
either of these Departments and Mr. Miller.
We find ourselves in a difficult situation in this case.
Enforcement of the ordinance would be relatively smple,:,but 1

traffic :crossing Harvey Rd. to get to ahis location. On the other hand, we cannot let this situation continue

The. Design Review Board recommended approval of the. proposal by a 4-1 vote. with
several conditions. The P~iZ made a motion to approve and it; failed on a 3-3 vote so
the proposal was denied. The Commissioners voting to :deny the roposal were
concerned about he -impact of a gravel lot; even on a temporary asis, in the wolf Pen, Creek Corridor.
