LANDSCAPING Dear Mr. Parkman, While in the- Northgate area yesterday I noticed that .your arkin lot at Patricia and First St. is now 'open for business. P 9 The lot appears to comply with all of the terms of the 5/1:4/86 Project Review Commi tee report except item #9 which references re wired landscaping. Your approved site plan indicated -that you q w©uld satisfy the- landscape requirement by planting six 1-1/2" caliper. oak trees and honeysuckle groundcover (4" pots @ 15" on centers in the setback area on the west side of the property. The site lan also... noted that a spr inkier system would. be installed p to water the landscaped areas. As landsca in is a re uirement of College Station's Zoning p 9 q Ordinance 1638 Section 11 'you must bring your project into com liance b com letin the plantings and sprinkler within 45 p Y P da s of receipt- of this -letter. Applicant was referred~to the Zoning Board of Adjustmentfar consideration of this sign. 6) The City Engineer referred to construction note number l and'the note at the bottom left portion of the sito plan and p©inted out that these..notes must be changed. to reflect t'construct new curb and curb cuts.. in accordance with City of Col~legf~ l P.R.C. $6-4Q8 5-14-86 Page 2 Station standards." 7) Vates were cast by the P.R.C. regarding allowing the 64 small identification signs for each parking space, with Mr. Cableway casting a no vote for Mr. Mayo, and. Mr. Pullen Nand Mr. ~rochu each casting aeyes.vote. The decision was reached to Allow small parking space identification signs no arger than 6" x 12" with a numeral only to identify a parking space :number. 8) The P.R.C. then cast votes regarding the landscaping requirement of 8 foot islands, with a unanimous decision to waive that requirement due to the larger than required landscaped setback area being proposed. 9) it was pointed out that because landscaping is not waived by ordinance, landscaping points es set forth in the zoning ordinance .must be met, those being $72 points required, 436 of which:.must be in canopy trees. The applicant stated .that he plans to include groundco~er (other.,:than grass) in the large setback area, and agreed to include a minimum of 436 points in canopy trees. Mrs. Johnson also pointed out that the landscape section of the Zoning ordinance requires tha groundeover must attain 100 coverage. with~.n ane ye~rr, so spacing of the plan s is critical. Also, she informed~~p.~~~-~~~:~~that ordinance requires either. a sprink er system or hose bzbs to help with Maintenance of the landscaping. (Section 11 Ordinancce 163$ was. given to the applicant.) Thee P.R.C. indicated as a group that steel posts, fewer in number than the creosote :posts proposed on the site plan are more acceptable, but are not a requirement, such posts {number and material}..being up to the discretion of the applicant. The Cit p 9 y Attorney's Office is in charge of criminal prosecution. ~1s pras- ecutors, we have some impact on the outcome of cr~nlnal itiga- tion,.but as you are aware, the court is the final authority: ~'he goals of the prosecutor's office are -to ~ l } seek ~ ust ice, (2 prove the elements of an offense, and ~3) to enhance the cred- blity of prosecution witnesses. In order to prove the elements of an offense of minor in possession of are alcoholic beverage, we-must have someone testify that saw the offense occur. A police officer is not able to tes- ti'fy when he has simply issued a ticket :for the offense. In or- '~, _~~r to accomplish -any successful prosecution, we need the as's i s- tance of both ..yourself and your employees, not just at your res- taurant, .but. also in tie cour..axo~zm..~~_.~. _.:.. .__` . _ _ ..~...: ...~.- ------------.._.._._. -As I stated earlier, the other goal of the City Attorney's office is to enhance the credibility of pro ecuton witnesses. We feel that with Judge Banks, that. cre,~ibilty is greatly en- ~i hanced where Jud e Banks feels that there is fair treatment of g the accused. Specifically, he wants to feel that al indiv~.duals are treated equally-and fairly. If the Judge: defers adjudication, he can assess court costs and require community service, attendance at alcohol education classes, require no drinking, etc. 'Judge Banks fre- quently requires as a condition of probation. that the defendant ~' not be allowed to go into businesses that sell alcoholic bever- ages. Mr. Canter 'za publicly objected that the person who has been convicted is not allowed to go back. into his business.
