The. roblems with the interpretation of "capacity" have resulted p in a difference of opinion that does not allow reconciliation. The. result is that the City has been presented with two calcula- tions for capacity in the same request. One calculation reflects how oversize panicipatonis paid on streets. Than is, a part of .the -request is for the total construction costs for a bridge over thirty-nine feet X39'} in width. The other request is for the payment o f f orty-.five percent t 4 5 % } of the remaining construction costs for the bridge structure. Additionally, the ordinance does not call fore the inclusion of drainage channelizaton `costs. This is because the Council, in ado tin the Storm Water. Management Ordinance, placed responsi- . p g ~~ bilty for drainage~faclity construction costs on owners and develo ers. In November, 1989, for the first time the Council p _ expressed an interest in paying channelizaton costs. ~; On November 29 1989, the Council directed the staff to negotiate -based u on ercenta~'e However the lack of clarity of method p p g and- the applcant's~~failure to provide construction estimates 'g it t : x i ~ i with Y~ 1In April of 1990, Bill Thornton, Sr., the applicant's attorney, told the Council that the cost for the 39' bridge is approxi- mately $190,040 and aforty-seen foot'(4T~ bridge is $200,000. The difference is $14 435.66. City's Estimate. Allen's Estimate. Street $ 24,645.98- ($ 23,:644 Bridge $ 67,943.34 $ 83,381 Channel , $ 90,000.00 $ 90,00 $182,589.34 $197,025 Earl at MDG is aware of the difference; however, I am not sure if Allen understands the numbers are lower. The calculations i used are shown on the attached page. a 1 ~ .. ~ ~ ~ . The $90000 for channel participation and the $ 67,94.34 for bridge part~cipatlon are fixed amounts. They will not change when the actual construction costs are determined. They are based on amounts set by :Council and not on unit prices for additional widths. However, we had. agreed the CLOMA must be obtained (written approval from FEMA) prior to the release of an ~ Y oversize funds. To my knowledge, MDG has not pursued his request from FEMA.. She also stated that dump trucks from waste water plant are coming through Emerald Forest instead of using the road to the East By Pass. I know there was a Council hearing and they were suppose toblock -off those streets so trucks Could riot access them.
