BE IT C?RDAINED SY THE CITY COUNCIL. OF THE CITY-OF COLLEGE STATIO~J, TEXAS I. That Chapter 9 Seaton 9, Subsection 9-E of the Code of Ordi- nances of the City of College Station is hereby amended to read as follows:, "9-E BRIDGES Subject o statutory restrictions and approval of the City Council, the City may enter into a development agreement agreeing to participate in the cost of bridges where the width required by he City is in exces's of those requirements specified in Section 8.G.10 and agreeing. to participate in the extra cost according to the following guidelines: r 9~ The proposed bridge.: and right-of-way, necessary for it must be located inside the city limits of the City of :.College. Station at the: time-the construction of the bridge is to begin. 9~ The plans and specifications for the construction ®f .the proposed bridge ..must have been reviewed and approved by the City Engineer of the City of College Station. 9-E 3 The bridge must meet the criteria described in the :City's Future Land Use Plan, as follows: (a~ A principal arterial located and designed to provide a direct traffic route over fairly long distances within the metropolitan area. (bj A minor arterial located and designed to serve the high volume traffic needs of the loca area. r 9_. E.6 ~ At the time of the preliminary request he City Council reserves the right to evaluate the overall economic benefit of the bridge to the City. The..:City Council may elect not to participate or it may elect to 1-unit par- ticipaton. 9-E_7 The City's participation will be limited to a maximum of thirty percent X30%~ of the. engineer's estimate unless the Council agrees otherwise and the project is placed aut to public bid. II. SEUE~BILITY If any sec ion, subsection, clause or .phrase of this.: ordinance is for any reason felt to be t~nconstitutiona ,void, or invalid; the validity of the remaining portions of th ordinance shall nit be affected thereby, it being the intent of the City Council in _: .. ~ I .. adopting. this ordinance, that no part thereof, or provisions or regulationscomained herein sha l become inoperative or fail by reason of the unconstitutionality or invalidity of any section, That Chapter 9, Section 9, Subsection 9-E of the Code of Ordi- nances ofthe City of College Station is hereby amended to read as follows: "9 E BRIDGES f :CULVERTS . The subdivider shal at his own cost, dedicate all rights-of-way and construct all drainage facilities according to the Drainage Policy and Design Standards of the City of College Station. when, in order to comply with the Drainage Policy and-Design Standards, it is nece sary to install bridges with capacity in excess of that required to serve the area being de~el- oped, the developer shall construct .:.such oversize structures) The City may participate in he cost of oversize bridge structures according to the following guidelines: 9~ The proposed bridge or culvert must be-located inside the city limits of the City of College (Station at the time construction of the bridge or culvert begins. 9~E.~2 The plans and specifications for the construction of the bridge ar culvert .must have been reviewed .and approved by the City Engineer of he; City of College Station. 9-E..3 The proposed bridge or culvert must,. be on a new street. The street must meet the criteria described in the -City°s ".:Future Land:Use Plan" for amajor or minor arterial. The bridge or culvert must either have a span greater than twenty (20} feet or have an open end area, greater than two hundred {200} square feet:.
