AREA ZONING AND LAND USE:
Subject Tract: Zoned R-6 developed as single family. The rear of
the lot received a use permit last April for a parking lot. The
site plan was never submitted to the Commission and the use
permit has since expired.
North: C-1 developed as a shopping center
East: R-1 developed as single family
South: R-1 developed as single family
West: R-1 developed as single family
LAND USE PLAN: Subject tract and areas to the east, south and
west are reflected as low density residential. Area to the north
is reflected as commercial.

STAFF COMMENTS:
The P.R.C. reviewed this project on 3-22-89 and had several
comments. The site plan reflects items that will require
com p 1 i a n ceo r va ria nee s toe e r ta .i n co des.
Variance requests will be heard before the the Structural
Standards Board on 4-6-89. The Structural Standards Board IlVill
consider variances to the require~ents of the building code
relative to the use as defined (apartment). It will also
consider a variance to the fire hydrant requirement. Results of
that .hearing wi.ll be available at!.the time of the Commission
meeting.
The Zoning Board of Adjustment will have to consider variances to

the islandrequirementsand/orparking requirements.
The Commission has authority under the use permit to consider the
applicant's appeal of the City Engineer's decision that the
parking spaces be all weather surface.
City staff has met with the property owner and understand that he

satisfy city codes.
Conditional use permits are granted by theCommission~ subject to
appropriate conditions and safeguards, when the Commission finds:
A. That the proposed use meets all the minimum standards
established in the Zoning Ordinance for this type of
use;
B. That the proposed use is in harmony with the purpose and
intent of the zoning ordinance and the plan for physical
development of the district as embodied in the
comprehensive plan for the development of the City;
c. That the proposed use will not be detrimental to the
health, welfare, and safety of the surrounding
neighborhood or its occupants, nor be substantially or
permanently injurious to neighboring property.
