review the 'subject proposed access for possible devel.opment

Texas Avenue and Gooner,andstaff recommends denial of the
proposal for the following reasons:
1. ENGINEERING--TheCollege Station Code of Ordinance
des ignatesthe>responsib i1 ity of access approval to the Ci ty
Engineer {Chapter 3 . Section ,5 J.). "The City Engineer's
office hasdeter'mined that the proposed access'fromCooner
to the properlyis<acceptableand meets all the standards
set by the Acc'essManagement& Dri'leway Design policy.
However, the proposed a,ccess from Texas Avenue to the
property ,is notin",eomplianee "withthe"'8ccess "policy"",because
it is within 350 feet of the Cooner Street/TexasAvenue
inters eel ion, and .,therefore,theproposed dri veway cannot b e
approved bytheCityEngineer~s office.
Assistant City Engineer Mark Smith did point out that the
one mitigatil1g feature of the applicant's proposed driveway
from Texas Avenue.tsthe designation as a "one-way only"
entrallcein tothep roper t y ,\'ihich\A10U I dl1el p to. e limina t e
left turn conflicts which currently exist "li ththepresent
configuration. Mr. Smith pointed out that this feature,
while an improvement over previous conditions, does nQt
al1o\Alapprovalby the City Engineer's of,fice'. If the
applicant wants to pursue his proposal, he is advised to
appeal this decisIon to the City Cou~cil.

City Engineer Pullen e,xplained this item,. fIe referred toa graph-
ic 'showing .'the, location of the proposed restaurant "at, the inter-
section of Live Oak arldTexas . Avenue ,currently the Saber Inn.. He
stated,' that, '.,the "",,'current,.proposal ,is ","to, level ,the,.,..,existing ,building
and sub-dividethepropertyandbqilda fast food restaurant. He
explained his reasons for denying approval of.this street access
as proposed. He 'pointedoutthatitwillbesa.fer and more con-
venient for 'the users of this property if> access is taken exclus-
ively from Live Oak Street.
Councilman Boughton asked if the users could utilize the 707 ac-
ce.ss. to this property. . Mr.. pulleR replied that the only drive
access he would approve is the drive toward the rear on Li veOak ,
l85'fromitscenter to~the" edge of Texas Avenue, this locat ion
does not meet the full requirementofthepolicYi however, given
the relative low volume of traffic on Live Oak, he would support a
variance to the policy statement of 200'minimum.
Councilmanr.1cIlhaneysuggestedthat a drive access located further
squth from Live Oak may alleviate some of the traffic congestion.

The owner of the property, ~1r. E.VJ. Schultz, came forward to
present a brief presentation of the proposed project. Reempha-
sized thatr1r. pullen' sconcernis thesafetyEor motorists exit-
ingand entering the site. . The applicants, Taco Cabana , have re-
vised t11eirplarl to limit tIle entrances to one access from Texas
Avenue. He pointed out thattllistractofland, 707 Complex and
Saber Inn coraplex has two different lenders. This creates a
prolJlembecauseneither one is willing to allow changes in the

Councilman Baddox asked if the property is developable.witholJt a

PARD Assistant Director Cisneros stated that the Community Center
staff and Advisory Committee set two goals in celebration of the
semi-centennial. The first phase vias the "Golden Anniversary
Ball fI . which was held on "r'larch 25, 1988. The secQnd phase of the
celebration is to develop an a'udio-visllal history presentation for
the schools andpllbl icuse.
Community Center Supervisor Gracie Calbert presented a slide
presentation. ,She'statedthatP11aseIIwill include a ser.iesof
interviews bylocalmediapel:"sonal ities with long-t imeresid.en ts
on, their ,memories ,and ,,~xperiences.of their past 50 years in
College Station. Completion date of the audio-visual is scheduled
for october 31, 1988. Netprobeedsfromthe" Ball "were $3200.
An estimated costs analysis indicates an additional $4500 is
needed to complete this project. She stated thatfundsVlil1 be
lnadeavailable ,from the General Fund Contingency Funds 'upon ap-
proval by Council.

A Presubmission Conference was held on December 13, 1989 to
review 'the subject proposedacce~sfor possible development
of the tract of land located at the northeast corner of
Texas Avenue and Cooner, and staffrecommen'ds denial of th.e
proposalfc;>r the following reasons:
1. ENGINEERING -The College St.ation Codeo.f Ordinance
