Staff requested this item to be tabled to allow~tm~ for problems which were identified to be~ resolved. Mrv Esmond made a motion ©table the item. He explained that the purpose of thee. plat. is to provide access and electrical easements between tw© properties. Mr . Esmond asked i f there were- and i~.pro~rements to be made as a result of the plat. Wells- said that this issue is currentl under negotiation. He said that the . y . burden is on Mr Swoboda to provide the right of way hnself ~f necessary. iVis. Kee referred to the Presubmisson Conference Report which stated the re uirernents of adjacent property owners in regard to the preliminary plats., q J Mr. wells re ested a variance to the sideway xequirernents on North Forest Parkway (one is .required, none.. are proposed, and on Appomattox two are required, one is proposed. 1~Ir. Dresser asked if staff had the opportunity tc~ research the sidewalk issue. Ms. Knee said that A. onzattox currently has one sidewalk. She said that there is . p~ _ . one on the west side ~n Ra~ntree, and one on the east side ~n Emerald forest. .. the said that the fact that no lots back onto North .Forest. Parkway maybe a reason to consider that variance. Mr. Dresser :asked if the sidewalk is ue had to be resolved tonight. ;, s ee said that for a variance to be a roved it must be considered by the M . Lack of sidewalks. - ~i Mr. Gentxy moved for a recommendation of approval of this Master Preliminary., I'` Plat conditioned `upon the receipt prior to submission to Council of approval of ~~ ~ the adjacent land owners with respect to dedication of the 30' section of North Forest Parkway, and subject to a granting of the variance on the sidewalk on I' ,~ppomattox and denial to the variance on North Forest Parkway. '~ Mr. Dresser ecanded the motion. ~~~ , ,, ~~~ ~srnond still strongly disagreed because of the concerns mentioned tonight. No vne came forward to speak. Chairman Sawtelle closed t e public hearing. ' Mr. Col on moved to recommend approval. Mr Esmond econded .the motion which carried unanimously. (6-0} 89-346: Reconsideration of Master:: AGENDA ITEM No. 4. Preliminary Plat -Emerald Forest Phases 8, 9, 10 & 11. Mr. Callaway pointed :.out the difference between the plat under consideration at this meeting and the plat of the same area which was considered earlier in 1989 by the~Commisson and then taken to Council, not for consideration flf the lat, but for consideration of financial participation in p , the construction of the br~.dge portion of Appomattox. He s ated that his revised plat does not provide for the extension of what had previously been designated "North Forest Parkway", but does include the extension of ~ Appomattox via the bridge in which :Council has-committed certain funding. He also informed the Commissioners what the area between this property and the Bypass is not- drawn to scale on the plat, and is actually much longer that it appears to be on F, the plat. Mr. Callaway went on to inform the Commission that the City has a ''blanket easement" which provides continuous, '~ uninterru ted acce s through thi tract of land to the wa to water treatment plant, and the developer has indicated on the ...:plat that he p ans to relocate that access wary to the ,, north side of his property, and outside the boundares'of ~~ ,, thus plat.. Mrs. Sawtelle asked foran explanation of the "half street" ref erred to in the memo from Mark Smith. Mr . Smith replied that the subdivision ordinance prohibits platting half ~; streets, and it is his opinion that the reserve strip in - '~ ~ which the developer has proposed locating access to the , waste water treatment plant could represent a "half street" ~~ - in the event it is determined that this is he location for the collector street whch`is indicated as part of the Thoroughfare Plan.
