Non-Profit Corporate n (hereinafter "Wiiliam:'s Court"} k WHEREAS, Wi l i i m's Court wishes to beautify ...the Rock Prairie Road Corridor and enhance the Wi l i am's Court and Wil l i am's~~~: Estates neighborhood area .and requests permission to i andscape certain property l ocated as general 1 y indicated on tfie attached Exhi it A, consisting of approximately two thousand. one hundred (Z,1OO~ iinear feet n the southeast side of Rock Prairie Road and nearly seven hundred (100 linear feet on the northeast side ~of Victoria Avenue wi-thin the public :right-of-way, as platted i n the Westchester Park Subdivision Phase I map filed in Volume 1054 Pages 373-313C of the Official Records of 6razos~County, Texas; and WHEREAS, Willi m's Court desires to :install the l andscapi ng to improve the streetscape, to prov'de a natural and aesthetically pleasing visual and noise buffer;. between.. busy ~ treets and- homes, and. t0 continue to beautify this South College Station l oca ion with mostly xerophyte a plants that need l i ttl a water or mai ntenancQ, after th y are established; and WHEREAS, the stal 1 ate on and maintenance of `all the 1 andscap~ng are i l be the exclusive respon ibility of William's Court; and WHEREAS, such landscaping installati+an and maintenance by William's Court wi l include but no be limited to maintaining and mowing the right-of-way, maintenance of the irrigation -pipes and appl i ances, and maintaining the 1587003b.OJ OJ~I c~ j r: 060391-6 1_ V4~ v ~'~G~ 0 9° , ~ ~ ® ~ 1 andscaped area so a - to keep sidewalks safely passabi e; and WNEREAS Willi m's Court'shall use a drip sys em rather tfian a sprinkler system::wherever poss ble to irrigate the landscaping in order-to minimize the water used and avoid ~sprayng vehicles and pedestrians; and WHEREAS, W ~ l i 's Court agrees to not damage. anythi ng i n the right-of-way or ..any easement, ag es to i~anedi ately replace any structure located i n the right®of-way or any a sement tfiat i s damaged by Wi 1 l i am's .Court acting under this.. Agreement, and agree to immediately remove any landscaping that fiinders or .obstructs in any way he visibility of vehicles or pedestrians; and EAS, CITY r WHER tans the right to remove any part of such landscaping that Wi 11 i am's Court does of maintain, .becomes un i ghtly or hinders or obstructs i n any way th'e vi si bi l i y of vehicles or pedestrians; and WHEREAS, Wi l i a 's Court agree to not damage any City uti 1 ty whi l e acti ng under this Agreement- nd agrees to inunedi ately repair or compensate the City for the repair- of any Ci t ut 1 i ty damaged by Wi 1 l am's Court ' why 1 e acting.. under th s Agreement; and WHEREAS, this greement supersedes the landscaping permit isued by the City Engineer, dated arch 11, 1991, .and obtained by MYRAD Real Estate, Inc., a Texas Carporat on {he ei Wafter "MYRAD"~} with respect o the same portions of Rock P:rari a Road and Vi ct ri a Avenue; NOW, THEREFORE, for and in .consideration of the recitations above and in consideration of the promi es and covenants herein expressed, the parties do hereby .agree :and cov Want as fa lows 1. William' Court shall install landscaping on that certain property 1 ocated general ly. a outlined on the attached Exhi b~ t A consisting: of approximately wo tho sand one .hundred ~2,100~ linear feet on the southeast side 1587003b.OJ OJ~l c1 jr:060391-B 2 1"""~ of Rack Prairie Road nd nearly seven hundred (100) -linear feet on the northeast side of Victoria Av nue within the public ..right-of-way, as platted in the Westchester Parke. Such landscaping installation shall be to im rove the street ca P e, to provide a natural and aesthetically pleasing visual and noise buffer bet een the streets and the homes., and shat i utilize mostly xero h tic lants t Py P at need little water or maintenance after they are established...:. 2. The i nsta 1 ati on and maintenance of all tfie 1 andscapi ng will be the exclusive respons i bi 1_ ' ty ` of William's Court. 3 , Such l and cap ng i nstal l ati on and maintenance by W i l i am's Court wi l l include but not be limited to maintaining and snowing the right-of-way, maintenance of the irrigation pipes and appliances, and maintaining the landscaped area so as to keep sidewalks safely passable: 4. William's' Court shall use a drip system rather that a sprinkler system wherever possi ble to irrigate the landscaping in order to minimize the water used and avoid praying vehicles and pedestrians. 5. Wi l i am's Court a tees ~o not lama a an phi n n .the .r ht-of-way or g 9 Y g 9 any easement, agrees o immediately replace any structure located in the right- of-way or any easeme t that is damaged by Wii1am's Court acting under this Agreement, and agree to immediately remove any landscaping that hinders or obstructs n any way he visibility of veh i c es or pedes r ans 6. CITY reta 'ns the right to remove any part of such landscaping that . This Agr ement supersedes the landscaping permit issued by the City En i~eer, date: Marche g ll 1991, and. obtained by MYRAD with respect to the same portions of Rock Pra ie Road and Victoria Avenue. 9. William' Court shall note be deemed as having any franchise under this .Agreement.. 10. William' Court shall not uti i ze such property other.. than as authorized herein . 12.
