A REVIEW OF SMALL AREARJE~ZONING
IN COLLEGE STATION
PURPOSE
Recently the Planning & Zoning Commission considered . a .,request
fora zonechangeinasmallareaalongJaneSt. The request was
forachangefromA--Pto~-l. At the applicant'srequest"the.,
item was tabled. . At'thattimetheCommission requested staff
.to review and address small "arearezoriingreguestsinCollege
Station.

PAST REQUESTS
Numerous small area rezoning requestshavebeenheard'bythe
Commission in the past. These haveyaried consi;derably in nature,
purpose and location. Somehavebee~ for zoning districts that
would allow, uses comparabletopermi1fteduses intbe current
district, but ,would provideforamo]["eefficient use of the land
as in the case of a change fromR-lil:(.> R-IA. ..Others have been to
allow for redevelopment, (sometimest<?uses incompati;ble with
existing area uses) . Others havebern sought to allow utilization
of> different sign regulations asinC;lchangefromC-N to C-3. A
summary of some ofthecasescon'sidetedisincludedattheend of
this report.
SPOT ZONING
In cons ider ing rezoning requests for ,small area . zone changes
carernustbetakento insure, thatthe.requestsareappropriate
for the area in ... question. OtherwiseAa"spotzoning", situation
can arisewithnegativEflmpacts 'fort.he>surrou'ndingland'uses.
Although the definitionof"spotzonJng"issometirnesdebated, it
is generally accepted that a spot zone is invali<lwh~n<allof the
following factors exist: 1. anarea~ssingledoutforspecial
treatment and is zoned differently<f~omthezoning()fthe
surrounding area i .2. .the benefit is ~orthe . particular ...1C;lnd
owner and not in the public interest rand 3. it iSll~ually for
an incompatible use and not for the 'purpose of furthering the

CONCLUSION
While,~tis important to avoid spot zoning of small areas, it is
also 'irnportant,.",toi'.",'avoid' ,categorizing'all,small,'area rezoning
request1s as spotz()nes. "Aslt is much more difficult to apply
comprehensive. . zoning thinkingtoa,small..parcelor to .one lot,
there is atendency.for.thedesignationo.f spot zoning to be
applied,to one-lot zoning , far more than to larger area zoning .
As a result the mistaken philosophy has been created that the term
spot zoning applies onlywhereYQuhave amended a zoning map to
dravla ,district boundary around a lot in. one ownership. This
does not necessarily hold .true." (2) If aproposed zone change is
part of an appropriate '. phase of u7e or development for the area,
is compatible with <arga. uses, and is not contrcl.ryto the city' s
plans and policies, then that request is valid and should not be
classifiedasaspotzoneontheb~sis of size alone.

basic elementsof.the consideration of any zone change decision.
