MEMORANDUM
TO: Planning and Zoning Commission

SUBJECT: Temporary and portable building standards.
At a recent project review .thePRC."was presented a proposal for the
placement of a portable building within a commercial parking lot.
Theappl icant descr ibedthe use of th.e building as tt temporary at
that locationU but also stated that the bull"ding. would remain there
"as long as it was profitable".
At the conclusion of the review Commissioner Colson expre~sed
several concerns with the manner in which project,s of this nature
were handled. Ci tinga need fo.r guidelines and standards to provide
for consistent review of such propo.sals .,CommissionerColson asked
that the topic be brought before the Commission for discussion.
We have placed this item on the agenda as a discussion item so that
the Commission can identify all areas of concern prior to Staff
drafting any proposals. Areas of "concern identified by the PRe
included standards for site improvements' associated with small
facilities, possible time 'limits for the use of portable structures
and policies for addressing placement of structures in non- .
conforming parking lots.
Landscape Guidelines for the llorthga teZone

In an effort to promote an attractive and functional urban
s~ttingin llorthgate; the following ideas should be incorporated
into landscape/streetscaperequirements for this area.
1) In areas where buildings and sidewalks exist, maintain a
minimum pedestrian walkway of 60" (5'). This is the minimum
space requiredbyA.N.S.I. standards for the side-by-side
passage.of two wheelchairs. This. walkway space may ei ther be on
the building side or the curbside of the sidewalk. Many
existing building sites in Northgate lack enough space to include
any landscape/streetscape additions. These sites shall be
considered exempt from requirements.
2) The landscape/streetscapeimprovements should encompass at
least 1/3 of the width of the building frontage. Doorwaywidths
shall be excluded from frontage calculations. Live plant
material must be included in each proposal. What we are asking
for is that the developer/businessman contribute visually to the
neighborhood in a positive manner.
3) Elements of anattractivestreetscape might include raised
planter boxes, at-grade planting beds, seatingbenches,light
features, trash receptacles, and decorative railings, banners,
etc.. The Commission might consider placing style;standards on
some of these items.
4) Items'usedinthe streetscape must be durable to weather and
humans in order to maintain a good appearance over time. When
considering plant materials, one must look at the ability to
withstand and thrive in restricted settings and harsher-than-
average growing conditions. Initial planting size and mature
height/spread are importants issues. A plantlistemphasising
small trees, 'shrubs, 'andfl owersshould be com pi led.

6) Upon acceptance of a set of gUidelines, the Planning Staff
shall produce copies for distribution to,developers and owners of
businesses in the Northgate zoning district.
Discussion of Temporary and portable building standards.
suggested guidelines for regulations to follow in placement or
establishment of small or portable businesses within the City:
1. Meet all required setbacks in subject district, and/or
construction of non-combustible materials as required for any
other business.
2. Meet all fire code regulations, specificall~Thood
extinguishers in cooking facilities.
3. AIlpartsoffaci Iity must be tvi thin 300 feet of fire
hydrant; distance to be measured as the hose lays.
4. Meet all state Health Department regulations as enforced by
County Health Department, {includiIlg agreement \-1ith other owners
for use of sanitation requirements).
5. Determine specific number of exits to be required; i.e., if
structure largerthan.A~~__ square feet, or has 2 or more
employees, ___~_____exits are required.
6. Written agreement for trash pickup (with neighbor with
dumpster or garbage bag pickup).
7. Meet all parking requirements (number of spaces).
8. Additional out-buildings will not be allowed in current non-
conforming parking lots.
9. Vehicle circulation pattern proposals must be approved by
City Engineer during theP.R.C. ,review process.
10. Post bond in the amount of ,j-..{lQ.O dollars .to cover removal
offaci 1 i ty if unoccupied for a ~riod of --crtl-- days. (Reduces
possible dangers to public health/welfare as could be affected by
occupation by transients, etc.).
11. Required landscaping similar to proposed Northgate
landscaping guidelines.
12. Must be properly anchored, either to sur.face of lot or on a

REGULATIONS FOR TEMPORARY COMMERCIAL STRUCTURES
Amarillo: Building Official oversees; No bldg. permi,t. if on
wheels (electrical permit/inspection if hot), pro:posed
use must be in accordance wI zoning district,. . can'Dot
interfere wi parking, . n.o pa.rking requirement (only what
applicant feels is needed.) Must comply w/iHealth
codes.
Galveston: Temporary Concessions - the only category which
allows tfhardconstructionft, and these must comply wi
engineering requirements to withstand 140 mphwind.s.

Lubbock - Walk-up Kiosk business allowed only in parking lots in
ttHeaviest Commercialtt 0-4 (wholesale-commercial.)
Other detached businesses (ATMs, Film Places, AND fuel
pumps/canopies) must go to ZBA if they are located in
front of the AVERAGE BLDG.. SETBACK LINE of 43' (ci ty
avg.) In any case, (I) the out-building must have the
same facade as other mainstructure(s), (2) must not be
w/in 300' of another kiosk, (3) must be removed if it
goes vacant. (sno-cone shops stay away!)
M'idland - Temporary Land Use Permi t{for use not allowed in
district) good for up to one year. Typically used for
carnivals etc., but I guess could fit for a summer only'
vendor. Site plan review is required. Parking
reviewed by bldg. official.
Odessa - All regular requirements just like permanent
installations (setba'cks, parking loss/needs,
inspections) No island or landscape requirements.
Portable bldgs. must be skid-mounted and anchored to
ground.
Plana - K.iosks - bank drive-thru 4 stacking spaces per window;
restaurant drive-thru7 spac.esper window; non-res t. 2
stacking spaces per window. Full site plan review.
