ITEM: A public bearing to consider an amendment to section 9 of
Ordinance 1638, the zoning ordinance specifically affecting
standards for temporary parking lots.
ITEM SUMMARY: This proposed amendment is in response to the
Council's d~rectivethattbestaffandCommissiondevelop
standardsforsituationswhereaddi tionalparking, "inexcess of
wbattbeordinancerequiresand/or what wasinstalledwben a
facility first, opened, "is necessary, to 'accomodatebusiness ,that
was unanticipatedwben .tbebusiness first opened. This item
originated with' the Aldersgate>Cburcb gravel parking lot that was
appealed to tbeCouncilafterthe'Commissiondenieda conditional
use permit.
Tbe amendment provides for .standards that address surface
material t,drainage,access , blowing dust, tracking of, mud onto
public streets and screening. It requires approval by the
t)ommissionand allows a temporary lot to exist fora 12 month
period, after which time' it shall be removed or brought up to
full parking lot standards.

STAFF RECOMMENDATIONS: The Planning & Zoning 'CommIssion held" a
public bearing on October 6, 1988. Tberesults of that hearing
will be available at the Council meeting.

Mr. Callaway reported that in May of this year the City Council heard anappealo!
the Commission's decision to deny a." Use Permit for a tttempo_rarytt . parking lot at the
Aldersgate' church, ..andafter . hearing the appeal. remanded the . use. permit request back
t()theCoDDDissionforconsiderationof a time period and any other specific
conditions which might be imposed in order to allow the usepermi t to. be granted. He
added.thatthereconsideration of the request for a Use. Permit for the Aldersgate lot
would be heard ata later dat'e.
He went on to report that at the same meeting, -Councilp8S$eda motioDasking'the
CODDllissiontoeonsider setting some guidelines or requirements to be considered for
pa~kinglots pfa t.eJDPoral'Y' nature for fac.ilities where the temporary lot would be in
excess,'of. that . required by ordinance, and...that is .what. this discussioDshould' be
directed toward at this meeting.
Mr.. Callaway. then suggested' possible areas ....for. discussionmigbt include landscaping
orscr~ening requirement~, time limitations, size limits as a percentage of the total
siteordevelopedarea,provisionstopreventtrackingofmud or gravel onto public
stre~ts,dust control, application of "temporary . lot" standards for overflow lots at
facilities that meet <parking standards, or anyotherarea>theCoDDDission identifies.
Mrs. Sawtelle asked if it is likely that the use of an overflow lot D1ight,be
addressed at the onset . of a project, tp which ...Mr.. Callaway replied t~t.. h, f~els
certain it. would not, but. rather would come up at a late.r time to handle peak or
seasonal. demands.
Mr. Dresser. said. he thinks. thereare..2 different .subj.ectsto.be. discussed: (1). a
tftemporary".parkinglotwhichmight remain substandard. until it is completed and
becomes a permanent lot, and (2Jatttemp.orarytt parking lot to be used as an overflow
lot with no time constraints. Mr. Callawaystatedtttemporarytt would mean that it
would ..not be. used....forever.
Mr.Itresser asked if the result of this discussion would be the intent to amend the
Zoning Ordinance. Mr.Callaway.repliedthat ..theCouncil asked that the CODDDissioD
deV'el(jp some standards, and now staff is requesting for suggestions or direction so
staff:can develop some guidelines to presen.t. Mr. Dresser asked what vehicle would
be. used. t.o implement.. these <guidelines. Mr. Callaway replied that he believes that
would ,be best addressed by a change in the ordinance.
Mr. Colson stated that all areas, and not only the Aldersgate church, will have to be
addressed or considered if the ordinance is amended, and he thinks that some type of
time limit should be the main issueona>d"temporarytttype parking lot, and added that
he would, be againsttmything thatwould.be.proposed to.Qe .~sed()ver a period of ~,
maximum of 12 months.
Mrs. Sawtelle said if an applicant proposed a "temporarytt parking lot for a very
short period of time, he probably would not want to include any landscaping or
fencing which ..wouldbothrepresent additional expenses. Mr. Colson agreed, pointing
out that all standards not set by ordinancewouldhavecto be buried.
Mr. Dresser repeated that he thinks there are several issues being discussed
including (I) the Aldersgate "temporary" lot which the church does not want to pave or
bring up to standards.because it would not be a good. use of.. it's money,. and no
agreement to do it in "x" months was suggested; and (2)an "overflow"parking lot
which..always. appears tobe..tthandiertt.than...the permanent, .paved...lot. so it...seems that
more people use the ttoverflowtt . lot than the permanent .lot. He added that he does not
thinkanyo"fthe.itemsdiscussedsofarwould.solvethe.Aldersgate problem, and. also.
that. . he. wishes .theCoUDcilrepresentati.ve would be present at the meeting tonight,
because it is not at.allclearwhatCouncilwantstheCoDDDissiont.o do. He finalized
bystatingthat..thisCoDDDission has made its statement twice regarding the Aldersgate
issue, and now he thinks it is<up to Aldersgate to address something.
Mr. Callaway said he was not. attempting to address the Aldersgatesituation at this
meeting but wouldlikeforthe>Commission to>consider establishing some type of
~idelinesfor 2 types of.parking lots: . (l)a "temporary" parking lot. which would not
be · used for the life of the facility, but which would be of a temporazrnature, to be

Mr. Michel saidheiscertainly.happytohave that clarification, because he had come
tonight>prepared to discuss temporary lots in general, and not specifically the
Alder~gat~situation.Mr. Callaway stated again that the Aldersgate situation would
be. addressed at.8.1ater date when the church comes back with some type of proposal to
take under consideration.
Mr. ~~ch~l pointed out that aa he understancls it, what the Commission is being asked
to address at ,thismeetin.g is temporary or overflow parking lots for all facilities -
not .j~st the churches. but ... commercial businesses as well. Mr. Callaway agreed, and
adde~i ~ha~perhaps aome. busineasea/orany facilitiea could be identified which might
need, lilome! typeofadditi()nalparking()n a .seasonal or temporary basis, and. that

Mr. Michel said that he thinks a time limit should be ranked high on the conditions
for use of a temporary lot, and he also would think that a.time.. should be established
,as tqiwhenthattime,limitshouldbegin;that is, doesthetimelimit..begin when the
CitYr?otifiesthe subject of anon-compliance, or actually when the use of the
temp~farYfacility began. He stated tha~ other things which might be considered ia
whether or not curbing should be required,and also, if the specific '

have! ~nputas. to what is anticipated to be.. tttemporary" . He gave as an. example the
Northgate..Merchant's Associationl ..andwhatinput an .organization of that nature might
have.that might have to be considered by the Commission.
Mrs. .Sawtelle .said she ag:rees.that .a time. .limit is important, and. when. that time
begins should be an important ,consideration as well. She went on to state that'she
does not like the idea of allowing a permanent overflow lot, and if the use of a

facility is anticipated to be that intense, then a standard lot should be built,
whetherit'sachurch,smallora.restaurant under consideration. She pointed out
that Post Oak Mall has a lot of parking available in anticipation of only the
Christmas s. eas on demand, and that's as it should be.
Mr. Dresser said that as a practical matter he thinks that churches should be
considered somewhat differentlyfrombus-ines'ses, and gave as an example aehurch that
had an annual festival which h~thinkssh()uldjustbe allowed to happen,with parking
whereever i tis postlible to find .. a place to park, whether it be on a grassy lot or
on the streeto.r whereever, but that if regular use of an additional parking lot is
required, then. he thinks a lot. with..standard, permanent, required features should be
devel9ped.Be.add~dthatheis s~illhavingaproblem with definitions, and he would
prefer, that specific definitions be supplied with examples of each before any action

Mrs. < Sawtelle gave as an example and a definition, the following: IfAldersgate
church.needs additionalparkinguntils.morepermanent expansion of the standard
facilit)' can be made with a permanent parking lot which goes.with it,then they could

Mr.Dr~ser .interjected that.if."temporary" also means. unpaved, he.thinks some things
absolutel)'must be'considered according to standardengineeringstandJu-ds, those
being drainage, mud,. dust,access to public rights--of-way, etc. Beco~tinued by
saying that a requirement of18lldscaping, visual barriers, etc. can be considered in
quitf7 ..~differentlight and could be addressed .when the time limita~i9~ is set. Be
said U' .the use would be for only 6 months ,it mi~htbefoolish to req~ire complete
standar4s to be met, but if the use were to extend for 5 years, a different
consideration should be given.
Mrs. Sawtelle said she would like for staff to seriously look into the consequences
to the City of tracking mud onto public streets and clo.gging storm sewers, etc. from
a temporary, unpaved.facility.
Mr. ~allawaypointed out that although the City Engineer is not represented at this
me~t1ng,staffwilladdressany questions to h~soffice regarding surface materials,
curbing, drainage, mud, etc. before it brings back any suggested guidelines for
consideration by the Commission.

Mr. Dresser then directed Mrs. Yolk to include a statement in the minutes that the
Commission thanks Mrs. JO}lnson for Iler illustrations, and that the Commission
considers both the illustrations and guidelines presented as excellent. All
Commissioners present agreed.
AGENDA ITEM NO. 5: 88-803: A public hearing to consider
amending section 7.11 of the Zoning Ordinance (Ordinance No.
1638} to exempt areas in the C-NG Commercial-Northgate zoning
district from specific landscape requirements and to allow the
Proj~ctReviewCommittee the flexibility to require landscaping
where appropriate.
Mrs. I{ee~xplainedthe proposed ordinance amending Section? .11 ,of the Zoning
Ordinance . simply ,provides for tileP.R.C. to. revieh' the 'applicant's proposed
landscaping and to have the authority to require landscaping \vherei t is deemed
appropriat.e. just as it has the same authority for parking requirements.
Mr.Callalvay clarifi'edbye}{plaining that the ordinance amendment provides the P. R. C.
tIle flexibility to r,equire landscaping \vher,e appropriate, "'fhichwasthe intent of the
ordinance.\vhen it was written.
Mr. Dresser made amotion toreconnnend approval of the proposed amendment to Section

Mr. Callaway then referred to a list of sizes of 10 convenience-type food 'stores
locatedlnvariolIs locationsandvari()us zonlngdistricts,with the average size of
these 10 stores bein.gjust under 2100 square feet. He did point out that most of
these stores,whilen:otin ,p~Ndistrictsbut .ratherinC-ldistricts ,are not highway

Mrs.Sawtelleagr.eedthatthe district regulations should not be changed. Mr. Michel
agreed and asked if the ages ,of the buildings listed were available so a
determination couldbie made as to the trend. Mr.Callat\lay replied that some of. the
buildings on the listarequlteold,and some have been approved but have not been
'built, and it is his opinion that the floor ar,eahasprobablybeen determined by the
