STAFF COMMENTS:
There. has been a day care facility operating.fromthis residence
for approximately 4 years. It is an owner occupied residence.
The applicant was unaware. of. the need. for a.usepermit from the
Ci ty but has appropriate licensing from the State . Durinlgthis 4
years there have been no complaints that lam' aware. of from
surrounding neighbors . The need for au.se.permi t became evident
when th.eapplicant sought abuilding pe.rmitfor a.n. additilon for
the day care operation.

Conditional use permits are granted by the Commissiol1,
subject to appropriate conditions and safeguards, when the
Commission . finds.:
A. That. the .proposedu.se meets all the minimum stan(lards
established in the Zoning Ordinance for this type of
use;
B. That theproposeduseis.in harmony with th.e purl>ose and
intent of the zonlnqordinance and the plan far physical
developmento.f the. district as embodied in the
comprehensive plan far the development of the Ci1:y;
c. That. the proposed use will not be detrimental to the
health, welfare, and safety of the surrounding
neighborhood or its occupants, nor be substantially or
permanently injurious to neighboring property.
